Abstract:This dissertation is a probe into the history of the theory of law, which investigates the theories on political law covering the contributions of Montes- quieu,Hegel,Carl Schmitt and Hans Kelsen,and the theory of Bruce Ackerman on constitutional politics.In the article,the author investigated the theories of public law felling in the continental tradition other than Anglo-Saxon tradition,as well as the dualist political theory of Bruce Ackerman.The author deems nowadays China being in"an unusual epoch",namely,a constitutional politics epoch which differs from that of normal politics.Therefore,the theory of political nation forms the theo- retical foundation of the constitution of China.The ongoing arguments of the jurists on rule of law mainly focus on the rule of law in civil society.A more important is- sue facing nowadays China on constitutional politics is how to sublime the law of lawyer to the law of statesman,or,in other words,how to settle the relationship be- tween civil law and political law properly.The public law theories attributed to the continental tradition and Bruce Ackerman's theory on constitution belonging to An- glo-Saxon tradition serve to show us a new perspective on solving the mentioned problem.
