Abstract:The essence of negligent crime is the violation of the duty to forsee.In researching negligent crime,similar as intentional offense,consideration must firstly be put on the perpetrating act,which has substaintial of leading to the criminal consequence,rather than focused on the acts which violates the rules or the duty of care.As for the subjective aspect,in addtion to the doer's duty and ability to forsee,the extent to forsee the consequense should also be taken into account.Only by fully understanding the above-mentioned issues,can appropriately handle with the problems resulting from determinating the negligent crime such as voluntary assumption of risk and substitution of lawful action.
