Punitive Damage in the World's Major Countries

Abstract:Punitive damage system is to punish and deter defendant’s wrong-doing and to award plaintiff the compensation which exceeds the actual damages. Generally speaking, the attitudes of civil law countries and common law countries to punitive damage are different. Civil law countries do not admit punitive damage in civil procedure while common law countries are willing to use or enforce punitive damage awards. But in recent years, all the countries and regions, including China and Taiwan, have had the tendency to admit punitive damage which is mainly manifested in legislation and the attitudes to punitive damage awards of other countries.
