Abstract:According to the late Roman law the "missing more than half of the rule" only applies to the sale of land.The contract damage rule in French Civil Law has rigid limitation in the scope of application with stringent constraints.and long-standing oretical differences.While,"hitting when others are down"is regarded in theory and practice a coercive act.In Germany and other countries or regions,based on the Civil Code,"hitting when others are down" accounts for profiteering behavior act.China's "General Principles of Civil Law" and "Contract Law" will respectively regarded "hitting when ithers are down " and "unconscionability" the legal act invalid.And the lack of the premise of "unconscionability or restrictive conditions deviates from the fair idea of the rules of civil law.The view "hitting when others are down " will be required to act for the elements of the results of unconscionability,and unconscionability for a relatively ineffective legal matter,it should be returned to the scope of profiteering behavior causes.
