Legal Liability of Violation of Obligation on Administrative Law: Between Administrative Punishment and Penalty——Analysis on Article 7 (2) of Administrative Punishment Law

Abstract:When an act,which violates the obligation on administrative law but undertakes the penalty result,fits in with the constitutive requirements of both administrative punishment and penalty,it should be defined into only one category according to different determinant and application,i.e.circumstances,result,condition,quantity,subject,etc.Meanwhile,as for the procedure,basing on the two opposite models of 'Administrative Punishment → Penalty' and 'Penalty → Administrative Punishment',the essential content of current relevant regulations should be interpreted from the aspects of initiating requisites,running steps and the procedural effects,in order to reveal the legal framework of the cohesion part in the two procedures.
