The Precautionary Principle in the Context of EU Food Safety Law:Retrospect and Prospect

Abstract:The precautionary principle is one of the general principles guiding the legislation and regulation of EU food safety law.It is closely linked with risk analysis and functions mainly in the phase of risk management,providing the decision-makers with a sound legal basis for implementing the precautionary measures.Applied within the EU legal order,this principle is controversial in several aspects such as the apportionment of the burden of proof,the less restrictive interpretation of the triggering factors in emergency measures,and the consideration of "other legitimate factors".On the international plane,the EU's assertion that the precautionary principle become a fully-fledged general principle of international law or a rule of customary international law did not win support from neither the third countries or the authoritative organs like the WTO dispute settlement groups.Therefore,the EU should,while improving this principle,try to prevent those precautionary measures from constituting disguised trade restrictions,which could be complained of according to international law.
