Abstract:The 1996 Criminal Procedure Law aimed to bring major changes to China’s criminal trial procedure by adding more adversarial components into trials and providing more protection to criminal defendants. Nevertheless, its effectiveness has been questioned continuously by scholars. Based on students’ evaluations of online criminal trials, this study was designed to explore public opinions on China’s criminal trial procedure. In addition, comparisons between mainland students and Hong Kong students, and between law students and non-law students were explored to examine potential differences between two legal systems and between students with different educational background and training. Data showed that the majority of students were satisfied with the three-phase trial procedure and the performance of major players in court. Nevertheless, they also identified a number of problems, all dovetailed with previous scholarly studies. Despite some nuanced differences, cross-group comparisons between the mainland sample and the Hong Kong sample and between law students and non-law students produced largely similar results.

Abstract:Criminal jurisprudence in China is faced with double missions: one is to modify and reform the theoretical structure,the other is to enhance our perception of issues and problems.Therefore,it is necessary to do trans-culture study on criminal jurisprudence.There are some experience distilled from the development of western criminal law systems,such as interpretation of criminal law by judges, emphasis on the objectivism of criminal law,diversified methodologies and analysis of both system and issues,while there are various problems in the development of criminal jurisprudence in China.Multiple ways are possible to make reform on the future China's criminal jurisprudence theory,including emphasizing on the objectivism of criminal law,constructing a layered system of criminal theory,insisting on substantive criminal theory and improving analysis of current issues.

Abstract:The legal method of criminal law is related to the specific issues and therefore falls into the scope of the criminal law studies. However, the methodology of criminal law is related to the Weltanschauung and therefore only belongs to the field of general jurisprudence studies. In criminal law studies, every kind of method has its own function and its limitation as well. It is impossible to complete any criminal law study only by one method. In constructing modern criminal law theory, the method of comparative study is the one our Chinese scholars shall pay special attention to; while the systematic method is the most important method. And the ideal of criminal law is of the fundamental guidance for choosing the legal method of criminal law. Based upon these understandings, the author holds that a comprehensive method should be the best method for criminal law.

Abstract:Due to the limitations and constraints of the research methods and perspectives,China's criminal procedure studies are facing an unprecedented challenge.In order to overcome the academic difficulties and usher a prosperous criminal procedure law study,researchers on criminal procedure law should not only commit to improving the traditional research methods,but also introduce into it the social science research methods which mainly focus on extracting the viable legal theories from the empirical facts.To this end,we should proceed from China's own legal problems,and extract some theoretical concepts and categories which are of some explanatory power to those problems;we should give up the perfunctory study attitudes of "praise the western legal system" and "criticize China's legal system",and try to find something regularities from a number of experiences and lessons learned from the process of transplanting western legal system into Chinese legal system;we should try to find some theories and disciplines from China's own judicial reform,so as to not only find those systems of true and real vitality,but also advance and bring forward China's domestic legal theory;and finally,we also should redress the wrong tendency of emphasizing too much on the introduction of western concepts and theories of evidence,and try to summarize some evidential rules form China's judicial philosophy,legal history and legal practice,so as to create and bring about our own theory of evidence.

Abstract:While it is necessary to tackle the problem of wrong sentence from the perspective of procedural law,evidence and judicial reform,substantive law is indeed of the same importance in prevention of wrong sentence.An adequate theoretic framework of criminal substantive law must compose of rationality of methodology and judicial regularity and logic,conduce to settling certain judicial conundrums,and ultimately reach the target of human rights protection.To prevent wrong sentence,we must hold a position of criminal objectivism with which criminal methodology and relevant judicial logic will be cultivated.An inherent consistency and uniformity exists in respect of the basic position of criminal law,criminal methodology and criminal justice logic.As such,the four-element-of-crime theory popular in China is required to be improved so as to establish the central and prior position of the objective elements in the structure of criminology and change the original decision based on subjectivism into decision on objectivism,which will inevitably exert positive impact upon the formation of rational judicial logic.

Abstract:Since the Fourth Plenary Session of the 18th Central Committee of the Communist Party of China, the Party Central Committee with Xi Jinping as the core has repeatedly emphasized the need to strengthen the training of foreign-related legal talents. In this context, the importance of bilingual legal courses has become more prominent. To effectively improve teaching effectiveness, the case based original text teaching method should be introduced. The original case texts include international law case texts and country law case texts from important countries or regions such as the United States and the European Union; When teaching, the method of intensive reading should be adopted, under the careful organization of the teacher ,which is to achieve a one-stop acquisition of legal professional knowledge and language skills through three processes: preview in advance, intensive classroom teaching, and reinforcement after class. Abstract:Fire investigation is a comprehensive applied discipline that studies fire traces, analyzes fire evidence, and deals with fire accidents. The case teaching method is conducive to integration of theory and practice, promoting the innovation of talent training mode, improving the comprehensive ability of students, and promoting the mutual benefit teaching. Combined with the training objectives, this paper firstly analyzes the necessity of the application of case teaching method in the teaching of Fire Investigation from three aspects: curriculum system construction, student literacy improvement, and teacher ability improvement.
