Abstract:The modernization of criminal procedure should be based on the science of research of criminal procedure.The formation of researchers' legal research methodology is the foundation stone of the latter.Legal research methodology is the wholly abstract description of the methods and approaches of legal research.It reflects researchers' philosophic ideas and basic cognition.It also reflects researchers' pre-value judgment and basic academic standpoint.Legal research methodology consists of “the starting point of research”,“the epistemological basis of research” and “the academically cognitive position of research”.It is very important and different from “methods of legal research” and “legal methodology”.The researchers of criminal procedure should refer to legal research methodology of law and economics,and form their own legal research methodology.

Abstract:The criminal reconciliation plays a more and more important role in criminal justice field. Reforms involving criminal reconciliation are actively carried out in some places. However,it is hard to make some breakthrough in these reforms because of the shortage of basic philosophy research. Zhejiang "Fengqiao Experience" and U.S. VOR Model present both differences and common models in east and west of the world. Taking a serious look at both the similarities and differences between the two models,we need treat legal realism,restorative justice and communicative action theory objectively. Criminal justice should not become "passive" harmony and harmony justice should not be unrealistic "sky rose".

Abstract:Legal realism is a family of theories about the nature of law developed in the first half of the 20th century in the United States and Scandinavia. The essential tenet of legal realism is that all law is made by human beings and is therefore subject to human foibles, frailties and imperfections. It has become quite common today to identify Justice Oliver Wendell Holmes as the main precursor of American Legal Realism. For Chinese criminal justice system, it is a new, helpful and realistic topic. China is a pluralistic society in its transitional period now, and the social conflicts are very serious, which is a big challenge for Chinese criminal justice system. Western legal realists criticize formalism and syllogistic type of trial, look law as a society engine with multiple targets, and pay attention to justice behaviors, disputes resolution and social issues as well. In Chinese circumstance, legal realism does not mean to deny formalism, but mean that we should rationally treat formalism and blend objectivism in it. Moreover, interest balance should be applied in criminal judgments and attentions should be paid to experience summarizing beyond simple deductive reasoning. Legal realism also means that we should focus on turning social justice into reality and constructing a pluralistic disputes resolution mechanism with the litigation system and the alternative one well —connected. Anyway, legal realism is not a panacea for Chinese criminal judicial reform, but can provide a methodological guidance for it, especially for solving extreme social conflicts and disputes. In a word, it will be a very helpful theory for Chinese criminal justice system in transitional period.

Abstract:The study and judicial practice constitute two interrelated aspects in constructing the rule of law.The present research on has the tendency of grand narrative and textualism;while in judicial practice,the formalism has been rigidly followed.These two phenomena have deviated from reality thus causing predicament for study in China.The predominantly traditional legislators' jurisprudence should account for such predicament.It is suggested to overcome the traditional judicial reasoning mode,to transform the position of legislators and to adopt a stance and method of legal realism,so as to establish a judicial path for jurisprudence,which can probably shake off the predicament.

Abstract:While it is necessary to tackle the problem of wrong sentence from the perspective of procedural law,evidence and judicial reform,substantive law is indeed of the same importance in prevention of wrong sentence.An adequate theoretic framework of criminal substantive law must compose of rationality of methodology and judicial regularity and logic,conduce to settling certain judicial conundrums,and ultimately reach the target of human rights protection.To prevent wrong sentence,we must hold a position of criminal objectivism with which criminal methodology and relevant judicial logic will be cultivated.An inherent consistency and uniformity exists in respect of the basic position of criminal law,criminal methodology and criminal justice logic.As such,the four-element-of-crime theory popular in China is required to be improved so as to establish the central and prior position of the objective elements in the structure of criminology and change the original decision based on subjectivism into decision on objectivism,which will inevitably exert positive impact upon the formation of rational judicial logic.

Abstract:The legal method of criminal law is related to the specific issues and therefore falls into the scope of the criminal law studies. However, the methodology of criminal law is related to the Weltanschauung and therefore only belongs to the field of general jurisprudence studies. In criminal law studies, every kind of method has its own function and its limitation as well. It is impossible to complete any criminal law study only by one method. In constructing modern criminal law theory, the method of comparative study is the one our Chinese scholars shall pay special attention to; while the systematic method is the most important method. And the ideal of criminal law is of the fundamental guidance for choosing the legal method of criminal law. Based upon these understandings, the author holds that a comprehensive method should be the best method for criminal law.

Abstract:As an interpretation method, systematic interpretation changes with the evolution from begriffs jurisprudence to jurisprudence of interests, and it is of great significance for supplementing the deficiencies of semantic interpretation. Systematic interpretation is based on systematic thinking, placing the provisions of criminal law in the entire legal system, thereby obtaining a correct understanding of the text of criminal law. In the dogmatics of criminal law, systematic interpretation can be divided into external systematic interpretation and internal systematic interpretation. Among them, the external systematic interpretation adopts the formal-logical analysis method, which mainly solves the problem of coordination between different laws and the same law, so as to provide a jurisprudential basis for the overall application of law. The internal systematic interpretation adopts the value analysis method to trace the meaning of legal norms and provide common value standards for understanding legal meaning.

Abstract:Criminal jurisprudence in China is faced with double missions: one is to modify and reform the theoretical structure,the other is to enhance our perception of issues and problems.Therefore,it is necessary to do trans-culture study on criminal jurisprudence.There are some experience distilled from the development of western criminal law systems,such as interpretation of criminal law by judges, emphasis on the objectivism of criminal law,diversified methodologies and analysis of both system and issues,while there are various problems in the development of criminal jurisprudence in China.Multiple ways are possible to make reform on the future China's criminal jurisprudence theory,including emphasizing on the objectivism of criminal law,constructing a layered system of criminal theory,insisting on substantive criminal theory and improving analysis of current issues.

Abstract:Following the spirit of formalism embodied in the principle of legality,the formalistic interpretation theory excludes some acts outside the scope of crime,which maybe substantially worth punishing but lackformal provisions.From different levels including methodology,constitutional theory and ideology of criminallaw,this article carries out a jurisprudential inspection on the debate between the formalistic interpretation theory and the substantial interpretation theory.This article claims that the debate between the formalistic interpretation theory and the substantial interpretation theory is the conflict between the principle of legality and social harmfulness theory,and that is also the dispute between the formalistic idea and the substantial idea oncriminal law.The author had ever made a deeply study on the relationship between form and substance in thefield of criminal law.Based on this academic fruit,this paper not only further declares the basic position andreasons of insisting on the formalistic interpretation theory,but also unfolds a comprehensive criticism on thesubstantial interpretation theory.The elaboration on the ground of formalistic interpretation theory make sensefor promoting the chinese academic dispute between the formalistic interpretation theory and the substantial interpretation theory.

Abstract:The interpretation of the law in judicial activity, as well as the search for specific features of the interpretation of the criminal law, belong to the category of topics whose relevance in modern conditions is increasing much. The contradiction between the growing criminalization and the increasing concern about the observance of human rights and freedoms actualize the status of interpretation as one of the most important aspects of legal activity, directly ensuring the rule of law in criminal law relations. In any law-making text, there are always a lot of subjective meanings, only one of which can objectively be the basis of a judicial decision. Based on the generalization of the existing approaches to understanding the interpretation of the law, two of its basic models are distinguished - the model of the presentation of the parliamentary meaning and the model of the presentation of the judicial meaning of the law. It is proved that law enforcement is determined precisely by the judicial meaning of the law, the establishment of which in the process of interpretation is a significant component of judicial legal policy. Understanding the meaning of the criminal law has a specificity being predetermined by the public nature of the branch of criminal law, this impresses the course of action of the court within the framework of the implementation of the principle of separation of powers. However, this specificity cannot consist of, as it is commonly considered to be in science, in limiting the methods of interpretation used by the court or establishing a rigid hierarchical sequence in the application of methods of interpretation. The specificity of the interpretation of the criminal law should be determined not by the methods of interpretation, but by the principles of criminal law. Their content, in turn, should be revealed through an appeal to the goals of criminal law regulation. According to the results of the study, the general approach to the interpretation of the criminal law, which being literal as a matter of priority, should combine a restrictive understanding of any legal restrictions and a broad understanding of any defenses against a charge of a crime.

Abstract:It is practically of importance to study the criminalization and decriminalization in judicature. The accurate meaning of the criminal law is found grudually in the social life facts. The criminalization in judicature does not break the principle of legality. The judicial organs should be positive to promote the criminalization under the second part of Aricle 3 of the criminal law. The first part of Aricle 3 is not the content of the principle of legality, and its function is to limit the power of decriminalization of juditial organs and control the judicial decriminalization. Such content is fit for the characteristics of the articles of the specific part of criminal law of China. The judicial decriminalization is very limited according to the laws of China, so the ideas and schemes in the criminal justice of some western countries could not be copied in the criminal practice in China.
