Abstract:It is striking that none of pagan Rome’s jurists felt that the term ‘secularity’, or ‘secularization’, might be necessary to describe a mode of Roman life, or a function of Roman law. Where then do these words originate? ‘Secularity’ is a coinage of medieval Christian writers. When ‘secularity’ occurs in a text by a twelfth-century monk, for instance, it is sharply contrasted with the monastic form of life ( conversatio monachorum ). And ‘secularization’ is a creation of medieval canon law. Originally, ‘secularization’ signified the protocols for laicizing a monastic in the Roman Church. Though both terms are medieval, this chapter argues that they may ultimately derive from a European Ur-text in which the concept of an ‘age’, or saeculum , is decisive: the Latin New Testament. This chapter seeks to show that the saeculum is a motif in Jesus’ sayings in Luke and in Paul’s letters (in their continent-shaping Latin translations).

Abstract:Roman laws are general terms for historic periods of Roman Kingdom, Roman Republic and Roman Empire, while scholars used to consider the Corpus Juris Civilis as the whole of Roman laws. Completed at Constantinople in 6 AD when the Western Roman Empire had already been conquered by barbarians, the Corpus Juris Civilis had been repealed for several years till 11 AD. Therefore, those ancient laws prior to the Corpus Juris Civilis have been neglected by scholars. It is essentially necessary to study the texts of Roman laws in their respective time and space sphere so as to avoid the "complanation" of Roman laws.

The article delves into the methodological and ideological factors that influenced the recovery of knowledge about ancient Roman law. Special attention is given to the role of Roman sources in the development of pandect law, including doctrinal positions, as well as the doctrine of transactions according to pandectists. Abstract:Many modern scholars attribute the problems in Chinese traditional politics to the rule of man,rather than the rule of law.Therefore,the establishment of a society of law is an important part of the Chinese modernization drive.This can be a very influential argument.However,throughout Chinese ideological history,there have been many suspicions about the rule of law,especially from the thinkers in late Ming and early Qing Dynasty.Huang Zongxi,Wang Fuzi and Gu Yanwu put forward different views on rule of law.According to them,rule of law,though necessary,is not the full requirement for state governance.And law itself can not be automatically enforced if man's leading role is not involved.Thus,the formulation of laws should be universally based on the interests and well-being of the people,and the law executors should be morally endowed and out of their goodness to exercise their power.In playing a supervisory role,they should focus on learning to educate the public.

Abstract:The European and American Enlightenment movements of 1688 to 1815 transformed the Western legal tradition, notably in areas of constitutional law, criminal law, private law, legal and political theory, and legal education. Particularly the American and French Revolutions effected massive and sometimes violent changes to traditional patterns of law, politics, and society — separating church and state and placing a new premium on democratic rule of law by the general will and public opinion. These legal reforms were grounded in part in new Enlightenment liberal beliefs in deism, rationalism, individualism, and nationalism — ideas that came to strong expression in the many new constitutions and codes issued in the later 18th and 19th centuries. Even so, Enlightenment legal reformers often worked side by side with Christian legal reformers, and they reconstructed traditional Christian legal teachings more than they created laws anew. As a consequence, until the mid-19th century, there was more continuity than discontinuity between Enlightenment-based legal teachings and practices and those of the Western Christian tradition. The Enlightenment, however, provided new secular logics for many of the traditional laws that it adopted and then adapted, and these secular teachings would later fuel the more strident post-Christian, if not anti-Christian, legal campaign of modern liberalism.

Abstract:The author explores the reasons why scholars have overlooked the importance of judicial rituals in Chinese legal culture and considers this neglect in the light of scholarship on secularization. He explores the issue by analysing the interaction between Chinese and western judicial practices in the colonial histories of the Straits Settlements (now Malaysia and Singapore) and Hong Kong. The concept of secularization appears to be of relevance to the study of Chinese legal culture, given that secularized societies tend to become differentiated into autonomous sub-systems, religion being restricted in influence to its own sub-system. In fact, however, religion has continuously interacted with a range of other sub-systems in China, including legal ones, which indicates that, in modern Chinese legal culture, religion and the law have not evolved into separate sub-systems.

Abstract:In Late Qing Dynasty, the Chinese Law Family was disintegrated and the Western Law was introduced into China. Finally, China adopted the European continental Roman law tradition. This paper analyzes the reason for China’s borrowing of such legal system and probes its development and reform in the later years. It also tries to answer the question of what will be the possible impact upon the current Chinese legal system since China now implements the policy of “one country two systems” in order to realize its reunification with Hong Kong, Macau and Taiwan. In addition, it will make some prediction upon the future development of Chinese legal system.
On Jean-Jacques Rousseau'S Concept Of Civil Religion And Its Tension With Natural Religion

Abstract:Jean-Jacques Rousseau writes Social contract and Emile during the same period and he raises two concepts, civil religion and natural religion, respectively in these two books. These two concepts are opposite at political level. For the former stresses particular social identity and the later is from the perspective of universal humanity. What is the real relation between these two concepts is a key junction in Rousseau's thoughts. As for the social contract in the early modern political thoughts, Rousseau thinks that reason alone is not enough for the basis of social contract, so he raises the concept of civil religion in order to give a divine dimension for this contract and strengthen the particular identity of those citizens. On the other hand, civil religion must avoid the malpractice of the national religion and religion of the Priest in the history, which brought bloody wars. At the same time, Rousseau raises other set of concepts: religion of the man, natural religion and religion of the Gospel, which are actually the same religion that originates from the true humanity. And these religions are inclined to a universalism, opposite to the particular civil religion. According to some interpretations, through Rousseau's special definition of civil religion, it becomes a civil version of natural religion in order to combine these two elements. These interpretations sound reasonable, but does not reveal the significance of the tension between civil religion and natural religion. In fact natural religion corresponds with the general society of whole human beings and civil religion corresponds with the particular political society. Unlike Karl Marx, Rousseau has no confidence Of Such a general society and takes a skeptical attitude to it. In this sense lie is not a radical. He pays more attention to the particular society and provides more conservative functions to the civil religion.

Abstract:The Western tradition of the rule of law originated in the Greek poleis. Soon after their emergence in the Archaic period, the Greek poleis went through a stage of law-making and established their political constitutions which ingeneral guaranteed the participation of citizens in the political deliberative and decision-making process. Athenian democracy was likewise based on the rule of law and it for the first time in history gave the power of decision-making to the citizen body, thus subordinating the elite class to the mass. Modern democracies are fundamentally different from Athenian democracy in several important respects, not the least because their political institutions directly derived from Republican Rome. Nonetheless, they have succeeded the tradition of the rule of law common to both ancient Greek democracy and the Roman Republic.

Abstract:The change from natural law to natural rights is a transformative event in the early history of modern political philosophy .It alters the way that a modern man understands his relationship with the society as well as the ethical foundation of political authority . The idea that political society was natural because it suited human nature was firmly rejected by the early modern political philosophy .Leading philosophers at the time began to see political society as an unnatural man‐created entity of social contracts . Li Meng’ s Natural Society offers a methodical discussion of this paramount shift in the history of Western political philosophy . Like his previous works , Natural Society is a creative work of synthesis .This review recognizes Li’s important contribution in the filed but also points out some significant omissions in his book .For instances ,Li intentionally leaves out the crucial role of Christianity in denaturalizing natural law . In so doing , it hampers the reader ’ s understanding of the transformation from classical natural law to modern natural rights .Li’s uncritical adoption of Michel Villey’s viewpoint ,which has been decisively challenged by later studies ,also prevents him to explore the concepts of “freedom” and “subjective rights” in Roman law and how equality , not rights ,influences the formation of modern ideas .
Reformation, Inheritance and the Evolvement of Law: A Cultural Analysis of Confucianization of the Ancient Chinese Laws

Abstract:In the 1940s, Qu Tongzu put forth the proposition of "Confucianization of the ancient Chinese law", producing a great effect on the academia home and aboard. Due to the discovery of new historic materials born on bamboo slips in the Qin and Han dynasties, different views have been proposed since the 1970s. China’s legal system features two basic characteristics—moralism and mixed law—for the entire Chinese history. The Confucian legal thoughts prior to the Qin Dynasty represent the theoretical summary of legal experience and practice in ancient China. Legalism in the Warring States Period and Qin Dynasty dismisses the patriarchal clan system and advocates "rule by law" on the basis of the centralized state power. Meanwhile, legalists partially incorporated li (rites or rules of proper behavior) into law. After the Western Han Dynasty, ancient Chinese laws began the process to be turned into part of Confucianization in a comprehensive way. The Confucianization of law represents the integration of Confucianization and Legalism in terms of academic thoughts, the integration of Confucianization and luxue (the study of law in ancient China) in terms of judicial professional training, the gradual socialization of the mixedlaw in the mode of law, and the transformation of patriarchal clan system into statute law in the criminal legislation.
