Abstract:In Late Qing Dynasty, the Chinese Law Family was disintegrated and the Western Law was introduced into China. Finally, China adopted the European continental Roman law tradition. This paper analyzes the reason for China’s borrowing of such legal system and probes its development and reform in the later years. It also tries to answer the question of what will be the possible impact upon the current Chinese legal system since China now implements the policy of “one country two systems” in order to realize its reunification with Hong Kong, Macau and Taiwan. In addition, it will make some prediction upon the future development of Chinese legal system.
Reformation, Inheritance and the Evolvement of Law: A Cultural Analysis of Confucianization of the Ancient Chinese Laws

Abstract:In the 1940s, Qu Tongzu put forth the proposition of "Confucianization of the ancient Chinese law", producing a great effect on the academia home and aboard. Due to the discovery of new historic materials born on bamboo slips in the Qin and Han dynasties, different views have been proposed since the 1970s. China’s legal system features two basic characteristics—moralism and mixed law—for the entire Chinese history. The Confucian legal thoughts prior to the Qin Dynasty represent the theoretical summary of legal experience and practice in ancient China. Legalism in the Warring States Period and Qin Dynasty dismisses the patriarchal clan system and advocates "rule by law" on the basis of the centralized state power. Meanwhile, legalists partially incorporated li (rites or rules of proper behavior) into law. After the Western Han Dynasty, ancient Chinese laws began the process to be turned into part of Confucianization in a comprehensive way. The Confucianization of law represents the integration of Confucianization and Legalism in terms of academic thoughts, the integration of Confucianization and luxue (the study of law in ancient China) in terms of judicial professional training, the gradual socialization of the mixedlaw in the mode of law, and the transformation of patriarchal clan system into statute law in the criminal legislation.

Abstract:Roman laws are general terms for historic periods of Roman Kingdom, Roman Republic and Roman Empire, while scholars used to consider the Corpus Juris Civilis as the whole of Roman laws. Completed at Constantinople in 6 AD when the Western Roman Empire had already been conquered by barbarians, the Corpus Juris Civilis had been repealed for several years till 11 AD. Therefore, those ancient laws prior to the Corpus Juris Civilis have been neglected by scholars. It is essentially necessary to study the texts of Roman laws in their respective time and space sphere so as to avoid the "complanation" of Roman laws.

Abstract:The article studies political and legal thought in Ancient China. Ancient Chinese thinkers in their works reflected their approaches to understanding law. Shang Yang in "Shang jun shu" ("The Book of the Ruler of the Shang Region") considers the law as the only regulator of social relations. Legalists equate the concept of law and law, law is considered as a set of rules of conduct emanating from the state and protected by it, which corresponds to the normative concept of legal understanding. Another version of legal understanding was developed by representatives of Taoism. Lao Tzu in his work “Tao Te Ching” (“The Book of the Way and Grace”) paid special attention to the exposition of his teaching about Tao as the highest law of the development of the universe, nature, society and man. Tao acts as a natural law of immediate, direct action. Taoists are supporters of the natural law concept. In Confucius' work "Lun Yu" ("Conversations and Judgments"), the main regulator of social relations is not the Tao or the law, but the norms of ritual li. The right is not reduced to the law, but is considered as a set of legal relations, and the legal order that develops on the basis of them. Legal understanding of Confucius can be attributed to the sociological concept. In the work of Xun Tzu, there are attempts to bring together the Confucian rules of the ritual "li" and the Legalist law "fa". A new, orthodox Confucianism is emerging, which no longer completely denies the law, but advocates management both on the basis of li and on the basis of fa, with the dominant role of li. In China, a new type of legal understanding is emerging - integrative or synthetic. The article concludes that within the framework of the political and legal thought of Ancient China, there were various approaches to understanding law. After the proclamation in II BC. updated Confucianism with the official ideology of China, the integrative type of legal understanding becomes dominant, both in theory and in law enforcement practice.

Abstract:Modern China legislation was formed under the direct influence of the legal culture of old (traditional) China. The Chinese civilisation has existed for thousands of years, and during this time fundamental philosophical, political, and legal doctrines, which laid the foundation for the legal consciousness of the Chinese citizen have arisen. This is especially true of Taoism, Confucianism and Legalism. While the influence of Taoism on Chinese law is not obvious, the confrontation between Confucianism and Legalism led to a synergy of these two opposing doctrines in the legislation: Legalism stood up for the high Confucian morality. Modern Chinese law is quite repressive, with the institution of the death penalty and criminal liability of organisations. The institution of reporting (denunciation) planned and committed offenses is widespread. This has its origins in Legism. At the same time, developed mediation, legislation in the field of protection of rights of the elderly, the existence of an examination filter system for obtaining official positions is an attribute of Confucianism. Taoism shows itself in the Chinese philosophical attitude to law. It is characterised by a dislike of written law, a desire to keep a respectful distance from the law, a disregard for legal prescriptions. Taoism, Confucianism and Legalism, combined with the law of socialist countries, and the borrowing of progressive West European legal institutions, have created a unique «legal system with Chinese specificity,» which is filled with the necessary laws even today. This «rattlesnake mixture» works according to quite transparent rules, but is difficult to embrace by Western scholars, who believe that the Chinese do not know the law. This is not entirely true: the Chinese do not like positive law, whereas natural law has always existed in their society. This is particularly discussed in this article, and specific examples from contemporary Chinese legal reality are given.

Abstract:Summary This article retraces the beginnings of Roman law studies by Chinese students during the latter part of the 19th century. It relies on archival research in order to piece together the curricula and careers of three pioneering Chinese law students who first came to study law, including Roman law, in England, France, and China. Wu Tingfang’s legal training at an Inn of Court in London, Ma Kié-Tchong’s legal education at the University of Paris and Wang Chung Hui’s study at Peiyang University in Tianjin, all included a more or less in-depth exposure to Roman law. Ma Kié-Tchong’s wrote a thesis on Roman law in Latin. As the first surviving specimen of legal Latin written by a Chinese jurist, his work not only reflects Roman law studies in France in the 19th century, it also sheds light on the level of proficiency in legal Latin which a Chinese scholar could attain.

But whatever measure was adopted, the leaks produced the conflict in the liege relationship could not be walled up because of the autocratic centralism. This caused the guiding ideas of the legislation was: prevention was prior to construction, repression was prior to adjustment and the law became the tool in the political conflicts.

Abstract:The execution of the law in each of the two great legal systems forms an integrated system, of which the main thread is the objects of regulation——carriers of law——ways in which the law is applied——core starting points. The continental legal system is manifested as categories of rights——abstract norms——legal code(set articles)—? 獳nspruchsgrundlage——individual will, whereas the Anglo-American legal system is manifested as specific objects——rules of judgement——judges(intuitive justice)——analogous relations——integral relations. Compared with the idea of individual will, that of integral relations has a more open nature in modern societies. However, each of the two is unique and neither can be simply labeled as good or bad. They are products of and may each suit different historical periods.

Abstract:The Western tradition of the rule of law originated in the Greek poleis. Soon after their emergence in the Archaic period, the Greek poleis went through a stage of law-making and established their political constitutions which ingeneral guaranteed the participation of citizens in the political deliberative and decision-making process. Athenian democracy was likewise based on the rule of law and it for the first time in history gave the power of decision-making to the citizen body, thus subordinating the elite class to the mass. Modern democracies are fundamentally different from Athenian democracy in several important respects, not the least because their political institutions directly derived from Republican Rome. Nonetheless, they have succeeded the tradition of the rule of law common to both ancient Greek democracy and the Roman Republic.

Abstract:Scholars are not using the proper analytical tools for comparing polities and cultures even within the same Civilization. The Unified Theory of Politics is a new approach to History and Politics that allows for comparison across the four Civilizations of the world (Western, Central, Eastern, and Mesoamerican). Mesoamerica is a Civilization made up of numerous civilizations. These civilizations are not compared to each other properly, with Mayans, Olmecs, and Epi-Olmecs all considered as equal units of analysis, which is not true. At the same time, within the Western Civilization, ancient Italy is not being properly analyzed either. The Latins, Romans, and Oscans are equal units of analysis either, yet the categorization of cultures and polities here is little better than in ancient Mesoamerica. The Unified Theory of Politics allows us to bridge seemingly impossible differences in culture, time, and place. This gives us the analytical and comparative tools to analogize between Civilizations. This article will show how the Unified Theory of Politics works by demonstrating not only that the Mayans and the Oscans are comparable with each other, but also that Olmecs and Romans are comparable with one another. This leads to the analogy of: “The Mayans are to the Oscans as the Olmecs are to the Romans”. Also, the article will demonstrably prove that Italians are Epi-Romans. This article will thus show that the Unified Theory of Politics allows us to compare any polity or culture with writing to any other polity or culture with writing, regardless of culture, place, or time.

Abstract:Characteristics of the ancient Chinese law could be well summarized by the three words of “Emotion (Qing), Reason (Li) and Law (Fa)” which have formed the core spirit of the traditional Chinese legal culture. This paper is intend to clarify the relationship between the three words and consider that concepts of emotion, reason, and law are not independent but a union, showing different sides of the same procedure. Meanwhile, the dynamics of these three concepts form a more generalized concept of “law” in which “emotion (Qing)” is the basis and reason; “reason (Li)” represents the actual social norms and “law (Fa)” is the method to maintain social order.

Abstract:中国古代法制历史经过4000多年的发展而从未中断。在这个漫长的过程中, 形成了特有的法律传统, 比如重农主义的法律传统、重刑轻民的法律传统、重伦常的伦理法传统、多元一体的民族法传统、德礼为本的儒家化的法律传统, 等等。这些法律传统是以深厚的法文化的积淀为基础的, 体现了中华民族的智慧和创造力。同时也受到中国固有国情的影响—农业为主导的经济结构、专制主义的政治体制、多民族的国家结构、儒家思想的统治地位、政治经济文化发展不平衡的社会状态等, 也都给中国古代的法律传统打上了深刻的烙印。关键词: 以农立国专制主义伦理法血缘地缘关系法文化 China’s pre-modern legal system enjoyed a continuous history of more than four thousand years. In the course of this long process, it developed distinctive legal traditions, including a tradition that prioritized agriculture, a stress on criminal law at the expense of civil law, an ethiSIMcal orientation that stressed the five Confucian relationships, an approach to the legal traditions of different ethnic groups that embraced diversity in unity, and a Confucianized legal system based on virtue and ritual. These legal traditions were all based on the accretion of a deep-rooted legal culture which embodied the wisdom and creativity of the Chinese people. At the same time, they bore the stamp of China’s national conditions: an economic structure dominated by agriculture, an autocratic political system, a multi-ethnic national structure, the preeminent position of Confucian thought, the uneven development of politics, culture and the economy, etc.

Abstract:This book, based on the theory of Marxism-Leninism, aims to study the essence, content and features of various legal systems in China in different historical periods, as well as the rules of the development of Chinese legal system. It effectively combines classic and historical analysis to probe the historical facts and elaborate the historical role of the legal system, revealing both the general and the specific rules of the development of the Chinese legal system on the basis of the existing relevant researches. The subject matter is of abundant theoretical and practical significance, as it enriches Marxist legal studies, deepens the readers’ understanding of Chinese legal civilization and offers guiding principles for the creation of socialist legal systems with Chinese characteristics. The chapters are structured chronologically, ranging from the Xia and Shang Dynasties, the Western Zhou Dynasty, the Spring and Autumn Period, the Han Dynasty, the South and North Dynasties, the Sui and Tang Dynasties, the Song Dynasty to the Ming and Qing Dynasties when Chinese legal system took on its final form. The chapters are compiled according to legislation, administrative law, criminal law and judicial system. Besides, the Chinese legal civilization after the Revolution of 1911 led by Sun Yat-sen is also addressed.

Abstract:The spirit of rule of law runs through the whole process of legal evaluation by virtue of the law value embodying good law and good governance. Legal evaluation is the practice carrier of the legal culture; while the spirit of rule of law is its spiritual expression. The spirit of rule of law not only consciously mirrors the legal culture demonstrating the law values but also penetrates into the legal culture so as to"achieve self-awareness". The legal culture is characterized by constitutionality, legality and rationality.

Abstract:The Republic of Rome made a magnificent success in the aspect of politics,which is greatly related to the political system it adopted.Owing to its uniqueness,archon,tribune and curia established the earliest framework of separation of the executive,the legislative and the judicial in the human history.Roman law,whose threshold is named as Law of the Twelve Tables,enabled the Republic to be the precedent of implementing constitutionally-governed democracy and the model of many countries thereafter.Under such a prominent democratic system,the conflicts between lords and paupers,the old and the new nobles,the domestic and foreign races,indirectly pushed forward its political development.To conciliate these conflicts,the Roman political system constantly made amendments and concessions to attain the perfection of its democracy.

Abstract:This article argues that Shang Yang’s philosophy of law was not only a means to enrich the state and strengthen its army, but also envisioned the orderly rule of all All-under-Heaven. Through a fair, universal, and reliable use of rewards, punishments, and also teaching, this vision of laws could ultimately lead to the promotion of moral values, popular consensus, and people’s self-governance. While the authors admit that in Shang Yang’s own historical context, law was no more than a tool used by the ruler to suppress his people, potentially his ideas could contribute to a future Chinese society fully ruled by law and morality, and inspired by the rule of law.
