Abstract:The dilemma of the legitimacy of judicial review,undermined by the controversy thereof,could label judicial review as "difficult to know while easy to do".Both the defenders and the challengers,aiming at justifying or contradicting judicial review,are based on the relationships among democracy,separation of powers,human rights and judicial review.The theoretical disagreements,or even the conflicts,originated from the fact that the legitimacy of judiciary is not the legitimacy of judiciary in common sense,but turns into the political legitimacy in that judicial review embraces the amending the constitution.Democracy,separation of powers and human rights just respectively correspond with the basis,the manner and the aim of judicial review,and hence,serve as the elements that both the justification and the contradiction of judicial review concern with.However,the comprehensions and judgments on democracy,separation of powers and human rights differ,bringing about theoretical disagreements.Nevertheless,logical requirements are unequal when justifying and contradicting judicial review.Consequently,judicial review faces with severe theoretical challenges,but still prevails in practice.This could be deemed as "the separation between knowing and doing".
