Abstract:According to Article 127of the Constitutional Law,the supervisory organs handling duty violations cases and crimes by taking advantage of duty shall cooperate with the judicial organs,procuratorial organs,and law enforcement agencies and with mutual restriction.This article tries to discuss the implication of the above-mentioned cooperation and restriction, and focus on the restriction of procuratorial organs on the investigation of crime by taking advantage of duty of supervisory organs. Although the investigative power of supervisory organs is not investigation on the Criminal Procedure Law,the Supervision Law of the People's Republic of China(hereinafter referred to as the"Supervision Law")assigns the investigative power of crimes by taking advantage of duty to supervisory organs,the investigation of crimes by taking advantage of duty in the Criminal Procedure Law has been replaced by that in the Law on Supervision.Therefore,the investigation of crimes by taking advantage of duty by the supervisory organs which belongs to the initiation of criminal proceedings has the legal effect of the criminal investigation in the criminal procedure law.And this constitutes the legal basis and foundation of the restriction of People' s Procuratorate to Supervisory Committee.The procuratorial organ restrict the investigation of crimes by taking advantage of duty of the supervisory organs by examination before prosecution,which is specifically reflected in the review of the existence of criminal facts,the review of the sufficiency,conclusiveness and legality of the evidence,and the review of accurateness of the nature of the crime and the accusation.The restriction of the procuratorial organs to the supervisory organs has to be in accordance with certain limits,it must be fully coordinated with the supervisory organs and request the approval of the higher level of People's Procuratorate when making decisions of non-prosecution.In addition to the application of Criminal Procedure Law,procuratorial organs should procedurally abide by the Supervisory Law,in the process of examination before prosecution. It is not possible to conduct supervision and review during the investigation stage of the supervisory organs
