Abstract:Conflict of jurisdictions over civil and commercial cases with foreign ele- ments falls into conflict of court jurisdiction and conflict of arbitration jurisdiction over ca- ses with foreign elements,both of which are subject to judicial review for resolution of the conflict.The former determines whether a domestic court or a foreign court has jurisdiction over a certain case and is resolved through the application of law as rules of jurisdiction for criteria of judicial review while the latter determines whether a case shall be subject to the jurisdiction of a court or an arbitral tribunal.Arbitration and litigation are two main chan- nels of settling civil and commercial disputes with foreign elements.Although an effective arbitration agreement excludes court jurisdiction,the effectiveness of the arbitration agree- ment,the nature of the issue for arbitration and the recognition and execution of arbitral awards are the subject matter of the judicial review from courts.The main objective of ju- dicial review is to resolve the conflict of court and arbitration jurisdictions over cases with foreign elements.In regard to the conflict of court jurisdiction,the author illustrates the principles applicable to judicial review based on the analysis of double lawsuits for the same case at home and abroad respectively and cases involving consent jurisdiction or joint liability.In respect of the conflict of arbitration jurisdiction,this paper presents an analy- sis of the rules applicable to judicial review in coping with the conflict of arbitration juris- diction and court jurisdiction in light of the application of law and adjudicating construction of arbitration agreements,the determination of the incidence of arbitration and the settle- ment of cases involving joint jurisdiction through litigation and arbitration.
