On the Improvement of China’s Antidumping Judicial Review System

Abstract:Judicial review mainly refers to the fact that the court reviews the governmental acts, including those of legislative branch and executive branch, to determine whether or not they are within the scope of constitutional power. The basic idea of such reviews lies in the protection of individual rights so that individual freedom may not be impinged by administrative power. Trade protectionism all over the world makes antidumping a frequently-used trade remedy. To supervise as well as control the misuse of antidumping power by the executive branch, WTO Antidumping Agreement stipulates that all WTO members must establish the antidumping judicial review system. This paper makes a comparative analysis of the antidumping judicial review systems in developed countries on the basis of the judicial system stipulated by WTO Antidumping Agreement. To perfect China’s antidumping judicial review system is not only an important approach to prevent misuse of power, and safeguard legal interest of party of interest, but an international obligation for China as a member of WTO. As long as we make good use of the experience of foreign advanced legislations and practice, and combine them with Chinese antidumping practice, we, I believe, could establish a set of reasonable and effective antidumping judicial review system in China in the near future.
