Abstract:The plaintiffs,the United States enterprises that consume of magnesite-based products,assert the overall prices charged for Chinese magnesite were artificially inflated.Plaintiffs claim that defendants' actions(illegal horizontal agreements to collude the flooring export price) violated section 1 of the Sherman Act.The defendants challenge the complaint asserting that the American court has no jurisdiction on this case.The district court held that:(1) consumers' allegations failed to establish court's jurisdiction to hear claims under Foreign Trade Antitrust Improvements Act(FTAIA);(2) consumers' allegations failed to establish that sellers were importers under FTAIA;(3) abstention due to operation of act of state doctrine was not warranted;and(4) Chinese Chamber of Commerce of Metals,Minerals,& Chemicals Importers and Exporters(CCCMC) was government entity for purposes of doctrine of government compulsion.The author comments on the doctrine of government compulsion using in the defence of the extraterritorial application of U.S.anti-trust law in China.
