Abstract:This paper makes an analysis of the advantages,disadvantages,opportunities and dilemmas of the three authorization models of direct authorization,copyright agent and copyright offer by taking periodical copyright mass licensing models as the research object,the reports take Internet as the research material sources,and the SWOT as the analysis method.The writer of this paper holds that the model of copyright agent is a comparatively good.The work concerning the knowledge copyright of the libraries is also briefly discussed in this paper.

Abstract:The object of copyright is a kind of quasipublic goods which is non-excludable and non-rival in consumption. For the purpose of making the best use of everything, qualified people and organizations are entitled to obtain statutory licenses to retransmit owners' works or distribute copies under the conditions specified by the law. The statutory licensing system in the American law is based on three principles: anti-monopolism, fair market price in negotiated terms, and maximizing the availability of creative works to the public. It affords the copyright owners fair protection to make owners' identification clear, obtain licensing fee distribution, and prohibit willful altering of the content of particular works or any commercial advertising or station announcement transmitted by the primary transmitter during, or immediately before or after, the transmission of such program. It endows copyright users with the right of secondary transmission and fair incomes under the existing economic conditions. Both sides have the obligation to cooperate with each other for their exertion of right and acquisition of evidence in substantial law and procedural law. Neglect violation is actionable as acts of infringement and fully subject to remedies provided by the law. Notwithstanding any provision of the antitrust laws, in negotiating statutory licenses in accordance with copyright law, any copyright owners and users may negotiate and agree upon the royalty rates and license terms and conditions for the performance. In the absence of negotiated license agreement, and upon the filing of a petition, a copyright arbitration royalty panel is to determine and establish such rates and terms, considering these for comparable types of performance and circumstances under the voluntary license negotiated under market conditions. Any decision of the agency should be under judicial reviews when it is appealed by aggrieved party who would be bound by it. In the absence of the systematization of statutory licensing proceedings in the American law, China has much to do to absorb all the forenamed theories and practices. Acquiescence licensing is characteristic of the Chinese system and shows its strongpoints, which may be reserved under particular conditions.

Abstract:In the digital age, the ever-growing development of communication technologies and their efficiency pose new challenges to the copyright registration system. Whether it is the registration demand for opuscules in the era of explosive works or the need to add the validity of registration under zero-cost dissemination, it signals a new turning point for the copyright registration system and calls for new changes. The inherent logic behind a voluntary copyright registration system lies in legal incentives and the fundamental reason for the malfunction of China’s copyright registration system in the digital age is the imperfection of intrinsic incentive mechanisms. In order to address this problem, based on the Cost-Benefit theory, the paper proposes the construction of a legal incentive mechanism for copyright registration from two aspects: reducing registration costs and increasing registration validity through intensive management, differentiated examination and an auxiliary registration system. It is expected to lower the threshold of copyright registration and meanwhile to provide practical operational standards to increase registration validity.

Abstract:Copyright licensing is one of the main forms of copyright.In the Cyber-Space,there are lots of obstacles to copyright licensing.It is difficult to get mass copyright licensing.Therefore it is an inevitable task to discuss the mass copyright licensing mode,in order that copyright law can adapt itself to technological developments.Copyright is a private right.The protection and limit of copyright manifest the interests balance doctrine of copyright law.As far as copyright protection is concerned,use of copyrighted works should be authorized beforehand.It is the theoretical precondition to discuss the mass copyright licensing mode.There are several copyright licensing forms in the West,such as collective copyright management,levy,creative commons,etc. They are helpful in perfecting China's copyright law.The existing copyright licensing forms in China have some defects.According to the fundamental spirit of copyright laws,a copyright licensing mode which is accommodated to the Cyber-Space should be proposed.Such a copyright licensing mode should take copyright collective management as the basic copyright licensing form. Meanwhile,this mode should also include diverse copyright licensing forms,such as creative commons,levy,License-Offer,Chaoxing Mode,and so on.These copyright licensing forms should make full use of digital technology and Internet technology to reduce exchange costs.

As the development of social economy,copyright increasingly industrializing,the recognition of copy deformation,the increasing types of functional works and the property rights in copyright advanced have already set the proper reasons to introducing a compulsory licensing system in copyright law. The implementation of the compulsory licensing system in copyright law can prevent copyright monopoly,promoting copyright trade and at the same time avoiding copyright uncertainty caused by the defects of network environment. When designing concretely the compulsory licensing system,we should respect the author's spirits,establishing the reasonable applicable scope,suitable condition and applicable procedures.

Abstract:Intellectual property rights are fundamental to how economies organize innovation and steer the diffusion of knowledge. Copyright law, in particular, has developed constantly to keep up with emerging technologies and the interests of creators, consumers, and intermediaries of the different creative industries. We provide a synthesis of the literature on the law and economics of copyright in the digital age, with a particular focus on the available empirical evidence. First, we discuss the legal foundations of the copyright system and developments of length and scope throughout the era of digitization. Second, we review the literature on technological change with its opportunities and challenges for the stakeholders involved. We give special attention to empirical evidence on online copyright enforcement, changes in the supply of works due to digital technology, and the importance of creative re‐use and new licensing and business models. We then set out avenues for further research identifying critical gaps in the literature regarding the scope of empirical copyright research, the effects of technology that enables algorithmic licensing, and copyright issues related to software, data and artificial intelligence.

Abstract:Copyrights Collective Administration Organization(CCAO)is a kind of copyrights protection institution,which existed in many developed countries.From the perspective of TCE(Transaction Costs Theory),this paper tries to answer what is the economics nature of CCAO.As the paper points,CCAO is just a kind of indirect way to price and transact the copyrights,which can low the transaction costs between copyrights owner and user under some constraints.Constraints determinate the optimal contractual arrangements of copyrights transaction.Based on the empirical study on the CCAO system in music industry of USA,authors test theory proposition and give some suggestions on how to build an efficient CCAO system in China.

Abstract:As the difference from traditional commodity trade, copyright trade not only transmits economic value with real products as carriers, but also transmits cultural value with subject consciousness as form, which often occupies an important position in trade friction. This paper summarizes the position of copyright trade in Sino–US trade friction from the perspective of Sino–US trade history, and considers it is not only one of the key incentives for Sino–US trade friction in the current stage, a game chip between the two sides in the upgrading stage, but also one of the key points of China's reform in the calming stage. Based on this, this paper analyzes the reason why copyright trade occupies an important position in Sino–US trade friction, and regards that China should draw lessons from history and continuously deepen the reform of copyright trade in the legal system, market cultivation, internationalization of enterprises, so as to promote the sound development of copyright trade.

Abstract:Today’s digital copyright protection system is completely centralized and the confirmation and transaction of copyright depend entirely on a third party, which suffers from time-consumption, high cost and data isolation. In this paper, we propose a secure and efficient digital copyright protection system based on blockchain technology and IPFS that provides a whole process of copyright protection services including confirmation, registration, subscription, buying, tracing and querying. A series of encryption algorithms are adopted to ensure the security of the system and smart contracts are utilized to achieve automatic confirmation and transaction of copyright. Moreover, we present key aspects related to architectural design and interactions details between system components. In order to validate the proposed system, we evaluated the whole system in terms of function, performance and security aspects. Our test and analysis suggest that the proposed system can help to solve the problem caused by the current copyright protection system.

Abstract:We build on the well-established critique, primarily in the US literature, of the following assumptions: (1) copyright protections serve to incentivise creativity; (2) copyright is designed with such incentivisation as its primary purpose; and (3) a standardized set of copyright protections should ideally be applicable to all forms of cultural production, across all situations in all countries. These assumptions lead to two fundamental conceptual flaws in much current copyright policy discourse: (1) it conflates concepts such as incentive, reward, and recognition; (2) it is nomothetic in character insofar as the existing structural and procedural diversity of the different cultural industries that it governs is inadequately acknowledged. Our critique in this article is not, therefore, a general one, but is limited to a specific theory of copyright, which pretends that copyright is an incentive to creativity while the evidence indicates that it is not. We highlight the importance of taking account of the whole ‘creativity value chain’ in the different industries with their various components – the creator, the copyright holder, the distributor, and the market. Drawing on case studies of three creative industries: literary writing, film, and fashion, we demonstrate that not only is there currently considerable heterogeneity among these industries, but that there has also been heterogeneity within each industry at different periods and in different contexts. We argue that this flexibility is a beneficial characteristic of the current functioning of copyright that should be defended against pressures in favour of harmonization.

Abstract:There is now a voluminous international literature on copyright law, policy and theory. Yet despite its apparent diversity, much of this commentary (particularly the very large proportion that emanates from authors based in the United States) is underpinned by the same unquestioned assumption: that some version of economic efficiency – the achievement of which involves balancing the social costs of activities (such as creating cultural artefacts and controlling how these are used) against the benefits of those activities – is the crucial, if not the only, criterion for evaluating both the copyright system and the field that it regulates. Commentators may have different understandings of how costs and benefits should be measured, and of how private costs and benefits can be made to match up with social costs and benefits, but the idea that a cost–benefit equation is the acid test of defensible analysis and policy in this area is rarely challenged. Among the more overtly committed of law-and-economics (L&E) scholars, this general idea tends to be invoked in relation to a cluster of rather more technical categories of economic analysis, and some of these – notably the concepts of public good and externality – are particularly relevant to the project of explaining, and prescribing for, copyright law in economic terms. Very briefly, the premise of this project is that information ‘goods’ are often difficult and expensive to create; yet once produced, they tend towards the condition of public goods – they are non-rivalrous in consumption, and relatively non-excludable.

Abstract:The traditional copyright system set up prior to new media technology is characterized by scarcity,law professionalism and state sovereignty while the new media contains the features of mass media,multiple roles of consumers and non-boundary of information transmission.The difference inevitably leads to some inconsistency between the two and yields serious tension among the copyright holder,new media and consumers.So far,three ways have been attempted to ease the tension: to reform the new media,i.e.,to have its features overshadowed or even lost with technological means;to amend copyright law to make it adaptive to new media environment;and to establish new business models,especially the compulsory license model.Unfortunately,up to now no attempt has showed entirely satisfactory.As such,further study and observation is needed to resolve the contradiction between the copyright law system and the new media.
