Abstract:Intellectual property strategy of one country should vary with the importance of intellectual property domain and the creativity of intellectual property. According to the current creativity capacity of intellectual property in China, the whole intellectual property domain can be divided four parts: strong-important domain, weak-important domain, weak-common domain and strong-common domain. Accordingly, there are four strategy: offensive strategy, break-through strategy, defensive strategy and development strategy.

Abstract:The national strategy of constructing China to become a great power in the field of IPRs has been brought forth recently which raises the development of copyright industries on the agenda.Under such circumstances,the method of issuing typical cases of copyright protection must rise to the challenge of the development of copyright industries.However,we found that there exist a lack of access between the cases and the practice of the industry in the copyright legal profession currently.So we proposed a logical pathway to explain the actual dynamic system of how cases make impact on industries:reinforce copyright protection to motivate copyright owners to register their work.To prove this perspective,we did empirical researches using related data over the past 10 years which led to quantitative analysis results and suggestions on further development of both copyright law and copyright industries.

Abstract:The recent popularity of video websites has transformed video copyright into one of the most critical issues in regulating the online video industry, especially in countries where video websites have started to thrive because of loose copyright regulations and low public consciousness of copyrights. This study explores copyright regulations in the emerging video website market in China, their objectives and measures, and their effects on the industrial outlook of China. Copyright has been used as political and economic leverage in regulating and shaping the video website market, thereby transforming this industry from an unrestrained Internet medium into a politically obedient and profit-driven business. The consequences of this transformation are analyzed and discussed.

Abstract:The paper employs the legislation basis、the legislation mode and the system of laws and regulations of copyright protection for computer software in China,reviews the legislation history,emphasizes the influence of external expressure on the legislation of interllectual property in China,especially introduces the two rounds of controversies in China over the legal liability of using unauthorized software by end-users,elaborates the views on legislation of intellectual property protection for computer software in the near future,stresses that the "lnhibition Theory",rather than "Replication Theory",should be the basis of the solutions to the issue of software end-users,suggests that abolish the present legislation mode which makes administrative regulations separatly from Copyright Law to regulate the protection for computer software,and add certain provisions directly into the Copyright Law to protect computer software.

This paper discuses the current development of cultural and creative industries in China and points out its weaknesses related to the system,innovation,marketing,competitiveness,intellectual property rights and talent- training. It finally proposes some solutions to the problems such as correct policy- guidance,better financing for innovation and good laws,and more innovation for competitiveness,which helps lay a theoretical foundation for the future development of cultural and creative industries in China.

Abstract:We build on the well-established critique, primarily in the US literature, of the following assumptions: (1) copyright protections serve to incentivise creativity; (2) copyright is designed with such incentivisation as its primary purpose; and (3) a standardized set of copyright protections should ideally be applicable to all forms of cultural production, across all situations in all countries. These assumptions lead to two fundamental conceptual flaws in much current copyright policy discourse: (1) it conflates concepts such as incentive, reward, and recognition; (2) it is nomothetic in character insofar as the existing structural and procedural diversity of the different cultural industries that it governs is inadequately acknowledged. Our critique in this article is not, therefore, a general one, but is limited to a specific theory of copyright, which pretends that copyright is an incentive to creativity while the evidence indicates that it is not. We highlight the importance of taking account of the whole ‘creativity value chain’ in the different industries with their various components – the creator, the copyright holder, the distributor, and the market. Drawing on case studies of three creative industries: literary writing, film, and fashion, we demonstrate that not only is there currently considerable heterogeneity among these industries, but that there has also been heterogeneity within each industry at different periods and in different contexts. We argue that this flexibility is a beneficial characteristic of the current functioning of copyright that should be defended against pressures in favour of harmonization.

Abstract:Low-carbon economic development,the stipulations in the Outline of the National Intellectual Property Strategy,the nature of copyright and the objectives of the whole intellectual property legal system require revising the legislative purposes of the current Copyright Law of China.Taking provisions on legislative purposes of the copyright laws of developed countries as references,analyzing the similar provisions of the related laws of China,focusing on promoting the application of copyrighted works and considering the institutional civilization adopted in the Constitution of China,the legislative purposes of the copyright law shall be revised as the following:This Law is enacted,in accordance with the Constitution,for the purposes of encouraging the creation and dissemination of works conducive to the building of a socialist society that is advanced ethically,materially and institutionally,promoting the progress and flourishing of socialist culture sciences and their related industry,and protecting the copyright of authors in their literary,artistic and scientific works and the rights and interests related to copyright.

Abstract:This paper surveys the legal and regulatory environment surrounding copyright protection technologies, focusing on China in particular. The paper begins with a discussion of some of the interactions between law and technology in copyright protection, which has led to the creation of international treaties to protect the technologies that protect copyrights. A comparison of the various national responses to these conventions is presented, followed by a discussion of the structure and development of the relatively advanced Chinese system for copyright protection technology. The last section outlines some of the unique challenges that have arisen in China for copyright protection technologies and the businesses that depend upon them.

Abstract:This article analyzes the advantages and disadvantages of this emerging cultural and creative industry by studying the development of China's cultural IP industry, to make recommendations for the development of China's cultural IP industry in the future. At present, the hot concept of IP operation emphasizes the mining, incubation, and sustainable creation of IP value. IP has gradually become the core of the pan-entertainment ecosystem. IP attracts the first fans through high-quality original content, and extends to other areas through recreation, achieving exponential growth in the number of fans and horizontal expansion of the fan base. In this process, the influence of original IP diverges, promotes the interaction and integration between different industries, constitutes a good industrial ecology, and releases and monetizes the value of IP. The article analyzes the development of China's IP industry in detail in the past two years, through the redefinition, policy combing, analysis of industrial structure, development trends, and cross-industry integration. At the same time, this article also discusses the advantages of China's IP industry development, current problems, and solutions, which found the direction suitable for the future development of China's cultural IP industry.

Abstract:As the difference from traditional commodity trade, copyright trade not only transmits economic value with real products as carriers, but also transmits cultural value with subject consciousness as form, which often occupies an important position in trade friction. This paper summarizes the position of copyright trade in Sino–US trade friction from the perspective of Sino–US trade history, and considers it is not only one of the key incentives for Sino–US trade friction in the current stage, a game chip between the two sides in the upgrading stage, but also one of the key points of China's reform in the calming stage. Based on this, this paper analyzes the reason why copyright trade occupies an important position in Sino–US trade friction, and regards that China should draw lessons from history and continuously deepen the reform of copyright trade in the legal system, market cultivation, internationalization of enterprises, so as to promote the sound development of copyright trade.

Abstract:Following the third copyright law amendment in China, this paper offers a timely contribution to the debates on the shifting policy, governance and industry landscape of the Chinese music industry. This paper conducts a historical and socio-legal analysis of the development of Chinese copyright law with regards to the music industry and argues that the Chinese digital music industry has developed to a stage where three business models collide, namely the cultural adaptation model, the renegade model and the platform ecosystem model. This paper draws on interdisciplinary literature and discourses from legal studies, business studies and cultural studies and provides new evidence of the much neglected autonomous development of Chinese copyright law on top of foreign pressure and the desired reforms to further integrate into the global market economy.

Abstract:Protection of copyrights by modern copyright law develops into active protection of promotion and encouragement of transaction of copyrights from defensive protection of restriction and prohibition of infringement of rights,which origins in the realities that it is hardly to restrict or prohibit infringement of rights in the time of intellectual economy and internet.Modern copyright law promotes and encourages copyright owner to make use of copyrights to the utmost extent to realize rights and benefits.Limitation of protection period of copyrights,creation of concepts of neighboring rights of copy,systems of reasonable utilization,legal permission and compulsory permission of limitation of copyrights and investment forms of capitalization of copyrights,which lies in dynamical equilibrium between rights and benefits of copyright owners and public benefits.

Abstract:The delineation of copyright subsistence is a focus area of the Third Amendment to the Chinese Copyright Law. This paper addresses the proposed reforms to the concept of 'works' in the Chinese Copyright Act in response to the challenges of the digital era and the international complaints regarding inadequate intellectual property protection in China. The amendment proposes a new definition of 'works' and introduces new types of work such as audiovisual works, computer programs and works of applied art. The paper further discusses the conundrum of the copyright protection of 'illegal works' in the aftermath of the US-China TRIPS dispute, as well as the controversial topic of orphan works. The findings of this research indicate that Chinese lawmakers intend to include a potentially wide range of subjects under copyright protection following the paradigm that innovation and creation flourish with strong intellectual property protection. However, this is realizable only via an appropriate copyright enforcement mechanism, which is most essential for the current copyright law reform in China.
