Abstract:This paper is included in the First Monday Special Issue: Music and the Internet, published in July 2005. Special Issue editor David Beer asked authors to submit additional comments regarding their articles. Since this paper was first published in 2002 there has been a constant stream of litigation surrounding P2P in the US and in other jurisdictions. In the United States, the District Court and the Court of Appeals controversially held that Grokster was not liable for contributory and vicarious copyright infringement. Justice Thomas of the Federal Circuit observed: "We live in a quicksilver technological environment with courts ill-suited to fix the flow of internet innovation." The United States Supreme Court is due to hear an appeal by copyright owners against the Grokster decision in 2005. In Australia, litigation was initiated against Sharman License Holdings, LEF Interactive and Brilliant Digital Entertainment, as the controllers of the peer to peer network Kazaa. Again, media owners have emphasized that the network is a pirate bazaar. Global legal forum shopping is one of the intriguing aspects of P2P. We see the arguments of both sides, originally developed specifically for US deliberation manifest across the globe. The Media naively ask whether there is any point in the Australian court considering these issues, given the litigation ongoing in the US. Here the US is seen as the world leader for legal ideas surrounding P2P, with the currency in ideas about technology, innovation and growing the global information economy clouding appreciation of national sovereignty and the distinctiveness of local jurisprudence. This context makes an appreciation of the cultural uniqueness of the US views all the more important. The paper evaluates the Napster, DeCSS, Felten and Sklyarov litigation in terms of the new social, legal, economic and cultural relations being produced. This involves a deep discussion of law's economic relations, and the implications of this for litigation strategy. The paper concludes with a critique of recent attempts to define copyright law in terms of first amendment rights and communicative freedom.

Abstract:This essay, a companion piece to “Discipline and Punish: despatches from the citation manual wars and other (literally) unspeakable stories” [Law's cultural mediations, special edition. 2001. Griffith Law Review 10(2)], undertakes a situated and critical cultural analysis of US law, with particular attention to the law school's insistent “training for hierarchy” and the interrelationship of that training with the bodies and texts that are constitutive of judge-made law in the United States. And who promptly told the student. And who promptly told the student. This essay revisits the early orientation of cultural studies work towards interrogating subject-formation and critically positioning and problematizing the scholarly subject and the various institutions, discourses and practices that produce both her subject position and her critical practice. At the same time it also stages an anti-racist, anti-sexist, and anti-classist engagement with the congeries of mechanisms by which hegemony is inscribed, reproduced, and accorded value by a range of practices to do with disciplinary texts and their production within US legal institutions. Both “semiotic”/“textualist” and “culturalist”, then, in orientation, this essay finds little space for celebration or play, although it alludes in its title, inter alia, to Inventing the Abbots, an artifact of popular US cinema that was at once both a reinscription of the family romance and an exploration of the mutually reinforcing and corrosive effects of class, sexism and secrets/silence. Finally, the essay seeks to explore questions raised by Meaghan Morris and Gayatri Spivak about the possibility or radical transformation through such critical cultural practice and the risks of iteration that is complicity, of submission to and collaboration with disciplinary violence, and of the complex politics of negotiation.

Abstract:Under a regime of limited economic incentive for creativity and confined commodification of information, humanity produced the greatest portion of human knowledge. To mention some, the Bible, the Qur'an, the Mahābhārata, the Iliad and Odyssey, the Aeneid, the Scandinavian Sagas, the German Lay of the Nibelungs, the Celtic legends of Arthur, the Romances and Chanson De Geste all came to life well before strong economic rights were attached to creativity. Later, Petrarch declaimed the Dolce Stil Novo, Dante wrote the Divina Commedia, Chaucer fathered English literature, Ludovico Ariosto chanted Orlando Furioso, Cervantes unleashed his Don Quixote de la Mancha against windmills and earlier epic literature, and Shakespeare gave immortal life to the love of Romeo and Juliet. Emulation, imitation, plagiarism, borrowing, remixing and recombination had a constant demiurgic power in the history of creativity. However, modern policies have largely forgotten the cumulative and collaborative nature of creativity. In this article, I highlight shortcomings of the copyright principle of exclusivity by rereading the history of aesthetics at the dawn of the networked age.

Abstract:Once the domain of elitist practitioners and scholars, international cultural law has emerged as the new frontier of international law. The rise of international cultural law as a distinct field of study reflects the Zeitgeist characterised by increased globalisation and the vitality of international law in governing global phenomena. International cultural law has made headlines and attracted the varied interests of academics and policy-makers, museum curators and collectors, human rights activists and investment lawyers, and artists and economists just to mention a few. International cultural law includes extremely diverse components and constitutes a good example of multilevel governance and legal pluralism. The return of cultural artefacts to their legitimate owners, the recovery of underwater cultural heritage, and the protection and promotion of artistic expressions are just some of the issues regulated by such a field of study.The book focusses on the particular area of the restitution of cultural property and dispute settlement mechanisms used in international disputes relating to cultural objects within the larger field of international cultural law. This is an area in which public law aspects (e.g., state succession, international conventions etc.) intermingle with procedural and private law aspects (private property rights, statute of limitations, forum non conveniens to mention but a few). This book addresses the question of ‘who owns culture?’ by examining recent cases and conflicting interests. The approach is mainly legal, but interdisciplinary approaches have been adopted as well.

Abstract:Economic efficiency has been the dominant justification for copyright protection in the United States. Challenging that narrow perspective, this study argues that cultural democracy provides a broader, more encompassing framework for reforming copyright laws in support of users’ access to and use of creative works. The study demonstrates how the normative values promoted by cultural democracy are synonymous with the socially beneficial effects of the first sale doctrine. Additionally, the study contextualizes and further elaborates the notion of cultural democracy by providing more concrete examples of how cultural democracy plays out in practice. In doing so, this study focuses on individuals’ use of ebooks and the role of public libraries in the digital age.

Sharing and Caring: Creating a Culture of Constructive Criticism in Computational Legal Studies

Abstract:We introduce seven foundational principles for creating a culture of constructive criticism in computational legal studies. Beginning by challenging the current perception of papers as the primary scholarly output, we call for a more comprehensive interpretation of publications. We then suggest to make these publications computationally reproducible, releasing all of the data and all of the code all of the time, on time, and in the most functioning form possible. Subsequently, we invite constructive criticism in all phases of the publication life cycle. We posit that our proposals will help form our field, and float the idea of marking this maturity by the creation of a modern flagship publication outlet for computational legal studies.

Abstract:The rapid recent expansion of copyright law worldwide has sparked efforts to defend the 'public domain' of non-propertized information, often on the ground that an expansive public domain is a condition of a 'free culture'. Yet questions remain about why the public domain is worth defending, what exactly a free culture is, and what role (if any) authors' rights might play in relation to it. From the standard liberal perspective shared by many critics of copyright expansionism, the protection of individual expression by means of marketable property rights in authors' works serves as an engine of progress towards a fully competitive 'marketplace of ideas' – though only if balanced by an extensive public domain from which users may draw in the exercise of their own expressivity. This article shows that a significantly different, and arguably richer, conception of what a free culture is and how authors' rights underpin it emerges from a direct engagement with the philosophy of Immanuel Kant. For Kant, progress towards a fully emancipated (i.e. a 'mature' or 'enlightened') culture can only be achieved through the critical intellectual activity that public communication demands: individual expressive freedom is only a condition, not constitutive, of this 'freedom to make public use of one's reason in all matters'. The main thesis defended in this article is that when Kant's writings on publicity (critical public debate) are read in relation to his writings on the legal organization of publishing, a necessary connection emerges between authors' rights – as distinct from copyrights – and what Jürgen Habermas and others have named the public sphere. I conclude that it is the public sphere, and not the public domain as such, that should serve as the key reference point in any evaluation of copyright law's role in relation to the possibility of a free culture.

Abstract:Over the last two decades, culture has changed irreconcilably. No longer the ideological window dressing of cold war politics, it now finds itself at the core of a growing globalized economy. Politically aligned with local, national and international regeneration policies, culture often finds itself being used as a bridging mechanism between different and often conflicting social, political and economic interests. According to the theorist George Yudice (2003), culture is now expedient—there is no way of funding or producing small, medium or large scale art projects that do not bring into alignment a collection of inchoate and seemingly incompatible interests. Map on to this the digitally driven emergence of “convergence culture”—where, as Henry Jenkins (2006) argues, “old and new media collide,” “grassroots and corporate media intersect” and media producers and media consumers “interact in unpredictable ways,”—and you have the most sophisticated, complex and volatile cultural arena in human history. Within this capricious and frequently arbitrary milieu, art has long since lost its own self-asserted right to set itself apart as some form of omnipotent commentator on the ills of mass culture. The shock tactics of the avant-garde are now the stock in trade of advertising agencies and music producers the world over, and art, as we knew it, now has to fight for the oxygen of publicity with sport, daytime television, online social networking and game consoles. It is a losing battle.
Studying American Legal Culture: An Assessment of Survey Evidence

Abstract:This paper argues that American legal culture, specifically the complex of public attitudes toward our major legal institutions and values, is truly democratic. The most persistent, although often unexplained, theme in that complex of attitudes is the demand for equal treatment. Americans endorse the ideals of equal treatment and believe that the most glaring defect of the present legal system is its failure to provide such treatment. Yet, as de Tocqueville noted, our ideas of equality are often incomplete; the demand for equal treatment appears to be a demand for equality between oneself and those now accorded preferential treatment rather than a demand that those less favored be treated as well as oneself. Evidence in support of the argument is gathered from survey studies of public attitudes toward the police, lawyers, and courts as well as of their attitudes toward crime, punishment, and civil liberties.

Why Liberalism Persists: The Neglected Life of the Law in the Story of Liberalism's Decline

Abstract:The liberal consensus surrounding individual rights, rule of law, and tolerance for diversity that once characterized the American legal and political order is in peril. According to an ascendant, “post-fusionist” conservative critique, liberalism’s demise is the inevitable result of a failed philosophical system that fundamentally misunderstands the communal and teleological nature of meaning-making and identity formation. Sharing blame for liberalism’s downfall, according to post-fusionists, are both the right’s liberalism of individualism and the left’s liberalism of diversity. American society currently faces a double-sided dilemma, according to post-fusionists: (1) liberalism’s conception of the person has undermined meaning-making in traditional, natural (private) loci while (2) also leaving little, if any, space for considerations of the common good or meaning-making in the public sphere. As a result, liberal citizens are alienated, and liberal societies are listless. This Essay — Why Liberalism Persists: The Neglected Life of the Law in the Story of Liberalism’s Decline — demonstrates that the practices of liberalism — law especially — are much less vulnerable to the post-fusionist critique than the theories of liberalism that post-fusionists target. Drawing examples from America’s constitutional structure, recent legislative and constitutional developments, and contemporary corporate law, I show that law supports meaning-making, virtue, and the common good by securing the conditions for the exercise of individual conscience and associational autonomy in private sphere and by supporting norms and adopting policies that guarantee equal citizenship in the public realm. Recognizing the meaning-making capacities and functions of law, I argue, better enables those invested in the future of the liberal order — whether students, law teachers, legal professionals, or simply citizens — to defend the institutions that order our world.

Abstract:In these edited remarks originally given at ROFLCon in May 2012, Jonathan Zittrain muses on the nature of memes and their relationships to their creators as well as to broader culture and to politics. The distributed environment of the internet allows memes to morph and become distanced from their original intentions. As meme culture becomes more and more assimilated into popular culture, subcultures like those of Reddit or 4chan have begun to re-conceptualize their own role from just meme propagators to cultural producers. Memes can gain commercial appeal, much to the chagrin of their creators. More strangely, memes can gain political traction and affiliation, like American conservative commentator Bill O’Reilly’s ‘You can‘t explain that’ or Anonymous’ ‘Low Orbit Ion Cannon’. Can meme culture survive becoming not just the property of geeks and nerds, but part of the commercial and political world?

Abstract:Commemorating Professor Tony Angelo's tireless efforts and multiple achievements in translating legal rules, principles and cultures from abroad, including many from Japan, this article focuses on an ongoing project to translate selected works of a leading Japanese legal sociologist, Professor Takao Tanase. Part 2 locates Tanase's critical "hermeneutical" understanding of law and society, or of facts and norms, within various paradigms in the English-language world of "Japanese Law". These include a first wave of culturalist approaches; a model instead emphasising the institutional barriers to invoking the law in Japan; another model emphasising "elite management"; and a very different "economic analysis" of Japanese law-related behaviour. Tanase's work instead joins an emerging "hybrid paradigm" that takes more seriously new understandings and measures of culture `project. As Tony taught us only too well, interpreting foreign legalese can be hard enough. But the most difficult task often lies in conveying the way it is embedded in a broader socio-legal praxis and discourse abroad. These challenges will not go away even in our globalised world, thereby securing the future for comparative socio-legal scholarship.
Between Copyright and Computer Science: The Law and Ethics of Generative AI

Abstract:Copyright and computer science continue to intersect and clash, but they can coexist. The advent of new technologies such as digitization of visual and aural creations, sharing technologies, search engines, social media offerings, and more challenge copyright-based industries and reopen questions about the reach of copyright law. Breakthroughs in artificial intelligence research, especially Large Language Models that leverage copyrighted material as part of training models, are the latest examples of the ongoing tension between copyright and computer science. The exuberance, rush-to-market, and edge problem cases created by a few misguided companies now raises challenges to core legal doctrines and may shift Open Internet practices for the worse. That result does not have to be, and should not be, the outcome. This Article shows that, contrary to some scholars' views, fair use law does not bless all ways that someone can gain access to copyrighted material even when the purpose is fair use. Nonetheless, the scientific need for more data to advance AI research means access to large book corpora and the Open Internet is vital for the future of that research. The copyright industry claims, however, that almost all uses of copyrighted material must be compensated, even for non-expressive uses. The Article's solution accepts that both sides need to change. It is one that forces the computer science world to discipline its behaviors and, in some cases, pay for copyrighted material. It also requires the copyright industry to abandon its belief that all uses must be compensated or restricted to uses sanctioned by the copyright industry. As part of this re-balancing, the Article addresses a problem that has grown out of this clash and under theorized.

Culture: The Creator and the Creation of International Investment Law

Abstract:A civilisation cannot exist without culture. It would sound like a truism if it wasn’t for the legal lack of acknowledgment of this fact. Although military and even economic threats justify emergency exemptions to treaty obligations, culture tends to be perceived as less important, along with environmental concerns or social responsibility. Given the significance of cultural heritage, the questions arise about the extent to which the protection of this heritage constitutes a fundamental duty of a host state and whether vague provisions are used as a veil for the mistreatment of foreign investments. By referring to a range of state intervention (normative, administrative and judicial actions) and cultural goods (tangible and intangible, already protected and aspiring to be enlisted), I analyse cases from Poland and South Africa. I try to find the equilibrium between the perception of culture as an object of international investment law, to be weighed against other considerations, and as a constituent factor crucial to a state’s identity and substance.

Legal evaluation is the practice carrier of the legal culture; while the spirit of rule of law is its spiritual expression. The spirit of rule of law not only consciously mirrors the legal culture demonstrating the law values but also penetrates into the legal culture so as to"achieve self-awareness". The legal culture is characterized by constitutionality, legality and rationality.

Abstract:Vannevar Bush envisioned a machine that would assist humanity in the creative work of writing. Doug Engelbart imagined the collaborative sharing and enhancement of knowledge. Digital media today—text, drawings, photos, audio, and video—surpass the visions of their pioneers. These media may be copied, shared, and modified in ways that challenge the legal system, because unrestricted content sharing without suitable payment to creators runs counter to intellectual property (IP) traditions and laws. Writers, musicians, artists, and inventors have long relied upon IP protection to enable them to control the use of their creations and inventions. Copyright infringement, that is, copying in violation of copyright, threatens the income that they could receive from their creations. The concept of fair use is a critical issue in such discussions, as it allows certain exceptions to copyright. One area that has received a great deal of attention is the digital copying and sharing of music; we shall examine the interplay between conventional behaviour, ethics, technical interventions to limit or block copying, laws and legal battles, and product and pricing innovation. Next, we shall look at similar issues in the domain of motion pictures. There are effective and legal streaming services, yet there are still concerns about copyright infringement. Copyright holders now automatically produce takedown notices to insist that websites remove illegally or improperly sourced material. Such notices include many errors, causing additional complications for video creators. One interesting challenge to the concept and laws of copyright occurs in the creation of mash-ups. Artists use fragments from existing musical or visual performances as well as their own material to create audio-visual works that combine multiple content sources. Artists, lawyers, and businesspeople debate the extent to which such mash-ups violate reasonable copyright protection. Copyright is also significant for academic articles and textbooks. There are two especially interesting cases to discuss. One is the widespread copying of textbooks by students due to the high price of texts. The other is the fair pricing of the publication of research results that have been funded by government grants. This issue has provided one of several stimuli to the creation of open access publications.

Abstract:In wake of globalization, it is of urgent need for the Chinese law culture to transform in the aspects of the corpus of knowledge reasonableness and construction of law culture. In the former there exists a lack of awareness in democratic ideology, rule of law and human rights among average Chinese citizens. The latter is flawed with unsophisticated legal system and culture as well as weak spiritual culture in law and order. With respect hermeneutic theories in law culture, globalization has given rise to creative antinomy between traditions and innovations in domestic law culture and between Chinese and western law cultures alike. Henceforth, it is of vital importance to bring in positive interaction between the different elements mentioned above in transformation of the law culture in China.

Abstract:This essay chronicles four lessons (or puzzles) that James Carey 'left’ to the author. These lessons pertain to Carey's account of communication as culture, the salience of that account with respect to the changing meanings and objectives of the 'liberal arts’ and sciences, Carey's view of the relation between time and space (history and geography), and the suggestiveness of Carey's interest in the relation between communication and transportation. Chronicling these lessons or puzzles (and Carey's story) leads the author to reflect on the history of Communication Studies and Cultural Studies in the US.
