Abstract:The text highlights a key aspect of preventing abuses in civil procedure, namely, the establishment of clear and transparent rules of civil procedure. These rules serve as the foundation for a fair and efficient system of justice, defining the rights and obligations of all participants in the judicial process and serving as the basis for fair and effective justice. The importance of judicial oversight is also emphasized as a tool that guarantees compliance with these rules and safeguards the integrity of the process. Abuse of procedural rights can hinder the realization of legal protection and may manifest in various ways, including the postponement of court hearings and the submission or provision of incorrect evidence. Furthermore, the article discusses measures to counteract the abuse of procedural rights and optimize the course of the judicial process. The final point of the article underscores the relevance of this right at the international level, falling under the jurisdiction of the European Court of Human Rights and other international bodies. It calls on all states to adhere to the requirements for a reasonable timeframe for case consideration in accordance with European standards. In summary, the article provides a thorough overview and analysis of the rules of civil procedure and their impact on ensuring fairness and efficiency within the judicial system. The main trends in preventing the prolongation of civil proceedings in foreign countries have been explored. These trends include the definition of simplified procedures based on the value of the claim, the application of a streamlined model for handling uncontested claims, the use of alternative dispute resolution methods, improvements in the process of filing lawsuits for timely case resolution, provisions for the hearing of cases in absentia of one of the parties, the introduction of electronic litigation systems, and the utilization of preventive mechanisms to expedite judicial proceedings.
