Abstract:The Kid's Online Safety Act was recently introduced as a bipartisan proposal to decrease the potential of harm to children while online. This act places the responsibility on tech companies to implement controls on the content that is available to children aged 16 and under. Specific targets of the legislation are content that promotes harmful behaviors such as restricted eating, substance use, or promotion of self‐harm; any sharing of a minor's personal information; marketing that targets a minor's information; and algorithms that promote specific content for children. Further, it would limit a company's ability to extend rewards for increased use of a platform or time spent online. It would also allow creation of a program that would give researchers access to data from companies, enabling additional research on children's technology use and effects on well‐being. And lastly, companies would be required to conduct yearly audits on the risk of their platforms to minors (Washington Post, tech policy, 2022). In short, the legislature mandates a “duty to care” ( Npr.org , 2022)
A critical review of the Online Safety Bill

Abstract:The UK Parliament has tabled the Online Safety Bill to make the internet safer for users by requiring providers to regulate legal but harmful content on their platform. This paper critically assesses the draft legislation, surveying its rationale; its scope in terms of lawful and unlawful harms it intends to regulate; and the mechanisms through which it will be enforced. We argue that it requires further refinement if it is to protect free speech and innovation in the digital sphere. We propose four conclusions: further evidence is required to substantiate the necessity and proportionality of the Bill's interventions; the Bill risks a democratic deficit by limiting the opportunity for parliamentary scrutiny; the duties of the bill may be too wide (in terms of burdening providers); and that enforcement of a Code of Practice will likely be insufficient.
Media freedom and journalist safety in the UK Online Safety Act

Abstract:In the digital era, journalists are targeted with online abuse including serious threats of violence. These censorship tactics are a direct threat to media freedom. Although the UK Government intended to tackle online abuse of journalists in the Online Safety Act 2023, provisions fit for that purpose never materialised. This paper reveals why that was the case and what can be done about it. It finds that there is ongoing tension in the press industry about press regulation, with implications for journalist safety; that the Government carved out special privileges for the press' online content but did not similarly protect journalist digital safety; that journalist safety was largely ignored in Parliament; and that repeated Government disintegration and shifting policies stripped away provisions that could have been improved to better protect journalists. This paper concludes with suggestions for how journalist safety can be better protected in the OSA regime.

Abstract:Abstract This article applies the concept of profilicity to the emergence of online harms legislation. Grounded in social systems theory, profilicity designates a mode of self‐presentation prevalent in social media environments, though discernible in the growing number of situations where personal identity is mediated via a profile intended to be publicly observed. Profilicity is distinctly different to ‘sincere’ and ‘authentic’ modes of self‐presentation, though they survive alongside it. The concept productively reframes what is at stake in the regulation of ‘harmful’ content on platform‐based communications, exemplified in the Online Safety Act 2023, which is subject to extensive criticism for invading privacy and mandating the censorship of lawful speech – values that evolved in relation to authenticity and autonomy. Profilicity engages law first via the identity techniques that law presupposes and second via the design decisions that it now regulates.

The Myth of Children’s Online Privacy Protection

Abstract:Digital technology has changed the landscape young people face as they come of age. It has changed how children interact with their parents, schools, community organizations, and the state. Despite many benefits, digital technologies that employ data collection, algorithms, and artificial intelligence pose significant risks for the next generation. Private businesses can collect, use, and sell a child’s data in ways never imagined by their families. Information collected by third parties with good intentions can be stolen through data breaches. Through faulty algorithms, websites can make inaccurate assumptions about young people’s interests, teachers can make inaccurate assumptions about a student’s potential achievement, and the state can make inaccurate assumptions about a child’s risk to engage in criminal activity. It can also feed young people information that is harmful to their physical or psychological well-being. Meanwhile, current efforts in the United States that promise to protect children online threaten to undermine their right to privacy. United States federal and state laws are ill-equipped to truly offer children online privacy protections. There are few legal remedies available to young people whose data is used in malicious ways. The remedies that do exist are insufficient to simultaneously safeguard children while respecting privacy as young people mature. To that end, this Article seeks to explore how current laws centered on children’s online protection are inadequate, and why the obsession with keeping young people safe online often curtails their need for agency and autonomy. It offers a cogent path forward to guide federal and state policymakers as they update children’s online privacy protection law.

Abstract:In recent years, the pace of Internet regulation around the world has quickened, with states increasingly confident that they can and should hold major platform companies to account. New laws have been developed to address the risks of digital technologies and law‐makers have drawn on familiar regulatory principles and legacy frameworks in addressing them. But the nature of the technologies and the business models supporting them bring new challenges which make it less clear that old approaches will work. To succeed, legislative frameworks must evolve and adapt. Against this backdrop we assess the UK's Online Safety Act 2023 (OSA), which was expected to provide an innovative and broad‐reaching 'systems‐based' approach to reducing user risks and harms, particularly in relation to child safety. We argue that although the Act does incorporate measures to regulate platform design, it fails to fully embrace this and faces some challenges in ensuring proportionality and accountability. Annual research review: Harms experienced by child users of online and mobile technologies: the nature, prevalence and management of sexual and aggressive risks in the digital age

Abstract:Aims and scope: The usage of mobile phones and the internet by young people has increased rapidly in the past decade, approaching saturation by middle childhood in developed countries. Besides many benefits, online content, contact or conduct can be associated with risk of harm; most research has examined whether aggressive or sexual harms result from this. We examine the nature and prevalence of such risks, and evaluate the evidence regarding the factors that increase or protect against harm resulting from such risks, so as to inform the academic and practitioner knowledge base. We also identify the conceptual and methodological challenges encountered in this relatively new body of research, and highlight the pressing research gaps. Methods: Given the pace of change in the market for communication technologies, we review research published since 2008. Following a thorough bibliographic search of literature from the key disciplines (psychology, sociology, education, media studies and computing sciences), the review concentrates on recent, high quality empirical studies, contextualizing these within an overview of the field. Findings: Risks of cyberbullying, contact with strangers, sexual messaging ('sexting') and pornography generally affect fewer than one in five adolescents. Prevalence estimates vary according to definition and measurement, but do not appear to be rising substantially with increasing access to mobile and online technologies, possibly because these technologies pose no additional risk to offline behaviour, or because any risks are offset by a commensurate growth in safety awareness and initiatives. While not all online risks result in self-reported harm, a range of adverse emotional and psychosocial consequences is revealed by longitudinal studies. Useful for identifying which children are more vulnerable than others, evidence reveals several risk factors: personality factors (sensation-seeking, low self-esteem, psychological difficulties), social factors (lack of parental support, peer norms) and digital factors (online practices, digital skills, specific online sites). Conclusions: Mobile and online risks are increasingly intertwined with pre-existing (offline) risks in children's lives. Research gaps, as well as implications for practitioners, are identified. The challenge is now to examine the relations among different risks, and to build on the risk and protective factors identified to design effective interventions.

Abstract:This study analyzes the previous literature on the online safety of children and youth under “the 4Cs risk framework” concerning contact, content, conduct, and contract risks. It then conducts a comparative study of Australia, Canada, and the UK, comparing their institutions, governance, and government-led programs. Relevant research in Childhood Education Studies is insufficient both in quantity and quality. To minimize the four major online risks for children and youth in cyberspace, it is necessary to maintain a regulatory approach to the online exposure of children under the age of 13. Moreover, the global society should respond together to these online risks with “multi-level” policymaking under a “multi-stakeholder approach”. At the international level, multilateral discussion within the OECD and under UN subsidiaries should continue to lead international cooperation. At the domestic level, a special agency in charge of online safety for children and youth should be established in each country, encompassing all relevant stakeholders, including educators and digital firms. At the school and family levels, both parents and teachers need to work together in facilitating digital literacy education, providing proper guidelines for the online activities of children and youth, and helping them to become more satisfied and productive users in the digital era.

Abstract:The study indicates actions taken to ensure the safety of minor network users. Prophylactic activity and methods of reacting in the case of identification of perpetrators of prohibited acts are described. It was assumed that in the area of cybersecurity, avoiding threats concerns the educational space, hence information, education and social campaigns play an important role in contemporary social functioning. The study presents the formal and legal framework for the protection of cyberspace users, the functioning of which is determined, among others, by the Convention on the Rights of the Child, the Penal Code, the International Convention on Cybercrime, the Act on Counteracting Drug Addiction, Internet Management Forum, Safer Internet Centers, Scientific and Academic Computer Network. (NASK), Empowering Children Foundation and others. Examples of assumptions of selected social programs building a safe environment for the exchange of information on the Internet are presented.

Abstract:Adolescents in the age of technology face a variety of security issues, but one of the most significant ones, that needs to be addressed by legislators, is privacy and data protection. Research has shown that children's rights, especially children's privacy, are regulated by a large number of international regulations. At the European level, both the European Union and the Council of Europe guarantee the rights to privacy and data protection. The Children's Online Privacy Protection Act is the relevant act in the US. The most common violations of children's data and privacy have been found to be online data sharing and mobile application data collection practices. Children's privacy on the Internet can be improved by better communication between parents and children regarding Internet use, educating children about cyber security and online threats, using parental control software, installing antivirus programs on devices used by children and the like.

Abstract:It is commonly recognised that the publication of false information can be harmful to the public sphere. The Online Safety Act 2023 places statutory responsibilities on regulated services to prevent the publication of certain false information. This article interrogates the regime's compatibility with established free speech law and theory. I argue that there is a disconnect between the legislation and the legal and theoretical principles underpinning free speech, which could have insidious and long-lasting implications for the right and the public sphere.
Teaching privacy: A flawed strategy for children's online safety

Abstract:Teaching young people about "privacy" has serious defects if the goal is to promote children's online safety. This commentary points out some the key problems to programs and educational modules with this privacy orientation. Privacy is an abstract and complicated concept, whose norms are in flux, making it difficult to impart clear, relevant, consensus-based messages. We also know very little about how privacy concepts develop in childhood and at what age and in what sequence, making it hard to know what to teach and when. Privacy skills are not necessarily the most important ones for preventing most online harms, including the most serious ones, casting doubt on whether they should receive priority over other prevention skills. Research has also not clearly established connections between many privacy practices and reductions in harm. Most privacy messaging has not been evaluated for how well it is learned, applied and what forms of safety it enhances. As an alternative, the promotion of online safety is best organized, not around privacy, but around the specific harms that educators and children themselves are trying to prevent. The highest priority of these are sexual exploitation, peer bullying and harassment. Such educational safety programs are best built from the foundation of evidence-based programs related to parallel offline dangers.

Abstract:This paper considers options for the UK Government’s intended White Paper on online harms and safety. The report, which was funded by Sky, suggests that legislation should establish a framework for oversight and accountability of online platforms’ handling of harmful and illegal content. Bunting identifies three goals of regulation: to clarify what consumers should expect from online platforms; ensure platforms’ handling of content is proportionate, accountable, fair and responsible; verify that particular platforms act proportionately to evidence of harm. Most ‘content regulation’ should be done by platforms themselves, as it is today, but the paper proposes that an oversight body – either industry-led or statutory - be established to assess their effectiveness and identify where more action is needed.

Abstract:The UK's Online Safety Act 2023 regulates pornography in a range of new ways which could radically alter both how pornography is accessed and the nature of the content available. However, while the Act ostensibly represents a new form of regulation focusing on the systems and processes of online platforms, in practice it is content-based. Our analysis reveals that the Act generates eight new classifications of pornography, each associated with a distinct legal framework, thereby creating a confusing and unnecessarily complex regulatory regime. Accordingly, we recommend further reforms to fortify and clarify the regulatory regime, as well as a more comprehensive review of pornography regulation in general, with the overall aim of reducing the harms of pornography.

Abstract:Many ethical questions have been raised regarding the use of social media and the internet, mainly related to the protection of young people in the digital environment. In order to critically address the research question “who is responsible for ethically protecting minors in the digital environment?”, this paper will review the main literature available to understand the role of parents, the government, and companies in protecting young people within the digital environment. We employed a holistic process that covers a state-of-the-art review and desk research. The article is divided into four sessions; (1) Government Policies from the European Union (EU) Perspective; (2) Parental Control; (3) An Overview of Companies and the Private and Self-Regulation Sectors; and (4) the Ethical Dilemma. Throughout, we reviewed specific topics regarding the potentially harmful content for young people within the digital environment, questioned how ethical concerns shape content and interactions online and discussed how internet parenting styles impact risks and opportunities for young people in the digital world. Finally, we analysed the research question contrasting it with the main findings in this review and offered recommendations.

Thoughts on child safety on commodity platforms

Abstract:The explosion of global social media and online communication platforms has changed how we interact with each other and as a society, bringing with it new security and privacy challenges. Like all technologies, these platforms can be abused and they are routinely used to attempt to cause harm at scale. One of the most significant offence types that is enabled by these platforms is child sexual abuse - both scaling existing abuse and enabling entirely new types of online-only abuse where the impacts on the victim are equally catastrophic. Many platforms invest significantly in combating this crime, referring confirmed evidence of illegality to law enforcement. The introduction of end-to-end encryption and similar technologies breaks many of the mitigations in place today and this has led to a debate around the apparent dichotomy of good child safety and good general user privacy and security. This debate has concentrated on the problem of detecting offenders sharing known abuse imagery using a technique known as client side scanning. We will show that the real problem of online child sexual abuse is much more complex than offender image sharing, providing a new set of 'harm archetypes' to better group harms into categories that have similar technical characteristics and, as far as we are able, bring more clarity to the processes currently used by platforms and law enforcement in relation to child sexual abuse content and the real world impacts. We explore, at a high level, a variety of techniques that could be used as part of any potential solution and examine the benefits and disbenefits that may accrue in various use cases, and use a hypothetical service as an example of how various techniques could be brought together to provide both user privacy and security, while protecting child safety and enabling law enforcement action.

Understanding engagement with platform safety technology for reducing exposure to online harms

Abstract:User facing 'platform safety technology' encompasses an array of tools offered by platforms to help people protect themselves from harm, for example allowing people to report content and unfollow or block other users. These tools are an increasingly important part of online safety: in the UK, legislation has made it a requirement for large platforms to offer them. However, little is known about user engagement with such tools. We present findings from a nationally representative survey of UK adults covering their awareness of and experiences with seven common safety technologies. We show that experience of online harms is widespread, with 67% of people having seen what they perceived as harmful content online; 26% of people have also had at least one piece of content removed by content moderation. Use of safety technologies is also high, with more than 80\% of people having used at least one. Awareness of specific tools is varied, with people more likely to be aware of 'post-hoc' safety tools, such as reporting, than preventative measures. However, satisfaction with safety technologies is generally low. People who have previously seen online harms are more likely to use safety tools, implying a 'learning the hard way' route to engagement. Those higher in digital literacy are also more likely to use some of these tools, raising concerns about the accessibility of these technologies to all users. Additionally, women are more likely to engage in particular types of online 'safety work'. We discuss the implications of our results for those seeking a safer online environment.

Abstract:Ian Levy and Crispin Robinson's position paper "Thoughts on child safety on commodity platforms" is to be welcomed for extending the scope of the debate about the extent to which child safety concerns justify legal limits to online privacy. Their paper's context is the laws proposed in both the UK and the EU to give the authorities the power to undermine end-to-end cryptography in online communications services, with a justification of preventing and detecting of child abuse and terrorist recruitment. Both jurisdictions plan to make it easier to get service firms to take down a range of illegal material from their servers; but they also propose to mandate client-side scanning - not just for known illegal images, but for text messages indicative of sexual grooming or terrorist recruitment. In this initial response, I raise technical issues about the capabilities of the technologies the authorities propose to mandate, and a deeper strategic issue: that we should view the child safety debate from the perspective of children at risk of violence, rather than from that of the security and intelligence agencies and the firms that sell surveillance software. The debate on terrorism similarly needs to be grounded in the context in which young people are radicalised. Both political violence and violence against children tend to be politicised and as a result are often poorly policed. Effective policing, particularly of crimes embedded in wicked social problems, must be locally led and involve multiple stakeholders; the idea of using 'artificial intelligence' to replace police officers, social workers and teachers is just the sort of magical thinking that leads to bad policy. The debate must also be conducted within the boundary conditions set by human rights and privacy law, and to be pragmatic must also consider reasonable police priorities.

Apart from the use of technology, online bullying shares the same attributes as conventional bullying. This includes a power imbalance vis-a-vis the bully and the victim and the victims' feeling of helplessness.
