Abstract:The subject. The article is devoted to analysis of the role of the judicial precedent in the system of sources of tax law.Aim. The aim of this paper is to analyze the essence of national and international judicial precedents in the area of tax law.Methodology. The author uses methods of theoretical analysis, particularly the theory of integrative legal consciousness, as well as legal methods, including formal legal method and methods of comparative law.Results, scope. The role of judicial precedent in the system of sources of modern tax law is con-sidered in the article. Although the precedent in the Russian Federation as a source of law is not formally recognized, but actually used, its role in tax law is very high. The judicial precedent can be confidently recognized as the source of the tax law of Russia. In this case, courts often take on not only the role of interpreters of law, but their decisions act as a legal doctrine.Conclusions. The author comes to the conclusion that the role of decisions of courts, especially the highest courts, is growing, up to giving them signs of a precedent interpretation.

Abstract:Abstract Courts may reason using precedents in various ways, but not all of them satisfy the rule of law. This article provides two ways that are compatible with this ideal and one which is not. In doing so, the article aims to explain the practice of following precedent in law and to offer criteria for evaluating its value. Two claims are defended. First, courts always have a reason to decide precedent-governed disputes by following precedent. This reason is a minimum requirement of the rule of law, and in some cases this reason may be reinforced in the form of an obligation. Secondly, depending on whether courts have a reason or an obligation to follow precedent, two modes of precedential reasoning may be identified. The article explains them in detail. The modes, together with the considerations that are reasons in favour of them or against them, provide a valuable philosophical foundation of precedent-following in law.

What About the Precedent: An Information-Theoretic Analysis of Common Law

Abstract:In common law, the outcome of a new case is determined mostly by precedent cases, rather than by existing statutes. However, how exactly does the precedent influence the outcome of a new case? Answering this question is crucial for guaranteeing fair and consistent judicial decision-making. We are the first to approach this question computationally by comparing two longstanding jurisprudential views; Halsbury's, who believes that the arguments of the precedent are the main determinant of the outcome, and Goodhart's, who believes that what matters most is the precedent's facts. We base our study on the corpus of legal cases from the European Court of Human Rights (ECtHR), which allows us to access not only the case itself, but also cases cited in the judges' arguments (i.e. the precedent cases). Taking an information-theoretic view, and modelling the question as a case outcome classification task, we find that the precedent's arguments share 0.38 nats of information with the case's outcome, whereas precedent's facts only share 0.18 nats of information (i.e., 58% less); suggesting Halsbury's view may be more accurate in this specific court. We found however in a qualitative analysis that there are specific statues where Goodhart's view dominates, and present some evidence these are the ones where the legal concept at hand is less straightforward.

A thorough knowledge of principles in these areas is essential for taxation advisers. In general, a transaction must be valid in terms of property law for it to be valid in taxation law. Abstract:Judicial decisions are explicitly mentioned in Article 38 of the Statute of the International Court of Justice (ICJ) as ‘a subsidiary means for the determination of rules of law’. Doctrine and judicial decisions are then usually categorised as subsidiary or material sources. Despite the absence of any rule on binding precedent in international law generally, references to previous cases of both the Permanent Court of International Justice and the ICJ, and increasingly also case-law from other courts and tribunals, in the decisions of the ICJ and the International Tribunal for the Law of the Sea (ITLOS) are a widespread phenomenon. This article aims at mapping and critically evaluating the practice of the both the ICJ and ITLOS in using and relying on their own previous case-law or external case-law of other international courts and tribunals. I will first identify the conventional principles applicable to judicial and arbitral decisions as ‘sources’ of international law. I will next map the practice of the ICJ by investigating the ways in which the ICJ has used its previous decisions, as well as those of its predecessor, and that of other international courts and tribunals. Finally, I will discuss and analyse the practice of the ITLOS.

Abstract:This article analyses the recent decision handed down by the Brazilian High Court of Appeals whereby the single tax principle and the abuse of law principle were applied in order to ultimately deny treaty benefits in the context of double tax conventions that provided for neither the entitlement to benefits clause nor the updated terminology of the title and preamble. Accordingly, since both principles could be deemed as general principles of law (therefore, part of the international law) comparable to double taxation conventions (DTC) provisions, lower level courts were allowed to condition treaty benefits to the demonstration that the taxpayer had complied with those principles. Therefore, in the case of potential hybrid mismatches, the absence of double non taxation for treaty benefits entitlement should be demonstrated. This article contends that this precedent must be reviewed. Firstly, the precedent disregards how international rules are created and how DTCs are interpreted. Secondly, it creates legal uncertainty in the context of DTCs. Ultimately, the precedent shall cause hermeneutic override whereby a state overrides a treaty with the pretext of interpreting treaty provisions. Roles and the Moral Practice of Precedent

Abstract:Some recent work in legal theory argues that legal questions boil down to moral questions. On this view, lawyers and judges are ultimately interested in the moral effect of things done by legal institutions. This view has been called the 'new legal anti-positivism'. So far, it has not given a convincing account of precedent. That is, it has not explained how moral reasons can account for what judges do in practice when they follow past decisions. Any successful account must explain the central features of this practice: why lower courts follow higher courts, and not the other way around; the difference between ratio and obiter; and the situations in which judges distinguish or overrule past decisions. This article gives a non-positivist account that meets this challenge, by giving a prominent place to the moral importance of roles. The account avoids some problems faced by existing non-positivist accounts of precedent.

Abstract:This article examines the significance of court decisions, paying particular attention to the concepts of both ratio decidendi (rationale) and obiter dictum in relation to legal precedents. It looks into how laws are made and where legal notions come from, including laws, conventions, and precedents. Civil law principles are compared and contrasted with cases from the English common law system. Article 141 of the Indian Constitution, highlights the significance of decisions made by the different Courts being binding in the Indian context and the applicability of precedents in this regard. Furthermore, the difference between ratio decidendi and obiter dicta is elucidated, underscoring the importance of the former as the legal principle that guides subsequent instances. Both descriptive and prescriptive ratios are considered, as well as the application of obiter dictum to court rulings. The essay highlights the need for precedents to be clear and logical for courts to correctly recognize them as legal precedents. The paper concludes with recommendations for improving and simplifying the precedent system to support the consistent and uniform administration of justice. To improve the precedents' utility and accessibility for legal scholars and practitioners, judges should write succinctly and clearly. In the end, the statement emphasizes how important it is for interested parties to keep debating and discussing ways to settle conflicts and enhance the way precedents are applied in the legal profession.

Abstract:International tax law has not been discussed much by the lawyers involved in public international law. Due to this, there exists a gap, as presently, developments in international law do not correspond to the constant developments in international tax law. This article seeks to highlight the challenges that would arise from the normative expansion of taxation law. Scholars have highlighted the need for a multilateral tax treaty. However, such attempts made by the UN and OECD have failed due to difficulties in ensuring the distribution of taxation power between the source and residence states. This issue becomes more prominent for digital economy taxation, as the digital firms may trade and operate without any physical presence in a state. The present set of proposals suggests introducing new rules for fair allocation of taxing rights and duty on the part of states to tax at a minimum rate. To this end, OECD has introduced the BEPS Inclusive Framework that would include even non-OECD members in decision making. This article underlines the impact of international tax law on different areas of international law and further points out the best practices in trade, investment, and international law so as to bring them in line with the developments in international tax law.

The Notion of ‘Persuasive Value’ of External Precedent in International Criminal Law

Abstract:This article examines the notion of ‘persuasive value’ of external precedent in the context of international criminal law. It finds that, in a number of cases, individual judges have appeared to assess the relevance and persuasive value of the same judicial decision differently and suggests that an assessment of this notion may be contingent on the specific circumstances of the case, including the individual approaches of judges. The article proceeds to flesh out some extrinsic and intrinsic elements of this notion. With respect to the former, these include: (1) the specific attitudes of individual judges; (2) the authority of the forum, including the generalist or specialist character of the court and the potential role of judicial networks; (3) the effect of successive citations; and (4) the potentially uneven playing field of citations. With respect to the latter, these may include: (1) the nature of the law being applied and the consonance of the findings with the applicable law; and (2) the quality of the reasoning. While there potentially may be a link between the quality of reasoning of a given decision and an assessment of its persuasive value, this may depend on the circumstances of the case and, in particular, on the approaches of the individual judges, who may accord differing weight to the elements involved in the equation. Thus, the article concludes that, ultimately, any assessment of the notion of persuasive value may have to remain contingent and incomplete.

Abstract:In adjudicating on matters relating to fundamental constitutional or human rights, courts make important statements about the principles which apply. The principles articulated will have a profound impact on the outcomes of such cases, and on the development of case-law in the relevant field. In the fields of medical law and mental health law, various courts have moved away from deference to medical decision-making and paternalism to a person-centred rights-based approach. However, courts in Ireland have continued to interpret mental health law in a paternalistic fashion, praising paternalism as if it is particularly suitable for mental health law. This raises profound questions about judicial attitudes to people with mental health conditions and judicial reluctance to confer full personhood on people with disabilities. This article outlines case-law in Ireland regarding paternalism in mental health law and discusses the consequences for constitutional rights in Ireland.

Abstract:Although the general principles of law at first sight do not bring about numerous associations with the sphere of taxation where the processes of compliance with legal rules or applying them must end with a precise numerical result, both the relevance and the significance of these principles in the sphere of tax law are more and more noticeable. The principle of proportionality has been invoked in probably every second VAT judgment of the Court of Justice for years. The principle of legal certainty has made its way to the case law of the said court as well as the Constitutional Tribunal in Poland. The importance of other principles is definitely on the rise.
The Doctrine of Double Effect and Potential Criminal Liability of Medical Practitioners in Australia

Abstract:Recent parliamentary inquiries into end-of-life choices identify the need to provide legal certainty for health practitioners working in end-of-life care. A concern identified is the lack of clarity surrounding the operation, status and application of the doctrine of double effect. This discussion clarifies these concerns. Although the doctrine is judicially recognised in several overseas jurisdictions, in Australia the doctrine of precedent means that it does not form part of the common law. In most jurisdictions, the fault element for murder includes recklessness, and application of the doctrine does not avoid criminal liability being established against orthodox criminal law principles. Although the prosecution of a medical practitioner who incidentally causes death in the proper course of medical treatment is a rare event, it remains a live issue. Legislative protection of medical practitioners, as has occurred in Queensland, South Australia and Western Australia, is the means to achieve the certainty sought.
The Discriminatory Legal Barrier of Partner Consent in Victorian ART Law: EHT18 v Melbourne IVF

Abstract:In September 2018, the Federal Court of Australia found that a Victorian woman did not need her estranged husband's consent to undergo in vitro fertilisation treatment (IVF) using donor sperm. The woman, who was 45 years of age, made an urgent application to the Court for permission to undergo IVF using donor sperm. In a single judge ruling, Griffiths J held that the requirement in the Assisted Reproductive Treatment Act 2008 (Vic) ('ART Act') for a married woman to obtain the consent of her husband discriminated against the woman in question on the basis of her marital status in contravention of the Commonwealth Sex Discrimination Act 1984 (Cth) ('SD Act'). His Honour declared the Victorian law in this instance 'invalid and inoperable' by operation of section 109 of the Commonwealth Constitution to the extent it was inconsistent with the Commonwealth law. Although the declarations by the Federal Court were limited in their terms to the circumstances of the case, the judgment raises broader issues about equity of access to assisted reproductive treatment (ART) in Victoria. The issue of partner consent as a barrier to access to ART was specifically raised by an independent review of the ART Act in Victoria. The Victorian Government released an interim report late last year as a first stage of the review, which canvasses some options for reform. This raises a broader question as to whether prescriptive legislation imposing detailed access requirements for ART is necessary or even helpful.

Oliphant's picture of a golden age of stare decisis when precedents were precise because of the formality of procedure overlooks the historical fact that the great development of our theory of precedent occurred after considerable progress had been made in relaxing procedural technicalities. Abstract:Abstract The development of international law of the sea by international courts and tribunals is generally acknowledged among international lawyers. In retrospect, the creative jurisprudence of international judicial bodies was incorporated into the mainstream of international law-making process in many cases, while the experience of failure cannot be ignored. In the past decade, the strengthening of marine environmental protection has become a tendency in international adjudication. Accordingly, the content and scope of due diligence obligation has been discovered, consolidated and extended. In light of the evolution of due diligence obligation, the methodology of law-making by international judicial bodies includes: inter alia , interpretation, cross-reference of precedents, analogy, and assertion. However, from the perspective of legitimacy, law-making should not become the normal function of international judicial bodies. Bearing in mind international rule of law and good administration of justice, the lawmaking activities of international courts and tribunals should be curtailed in certain degree.
Reasoning with previous decisions: beyond the doctrine of precedent

Abstract:'[A] relative absence of skills in case analysis’ is said to be 'the Achilles heel of civil-law methods'. This article takes issue with this view and shows that the continental European tradition has its own ways of dealing with cases. These techniques can appear different from the common law ‘case law method’, but are no less rational and intellectually sophisticated. The reason for the rather conceited attitude of some comparatists lies in the dominance of the common law paradigm of precedent and the accompanying ‘case law method’. If we want to understand how courts and lawyers in different jurisdictions use previous judicial decisions in their argument, we need to move beyond precedent to a wider notion, which would embrace practices and theories existing in legal systems outside the Common law tradition. This article presents the concept of ‘reasoning with previous decisions’ as such an alternative and develops its basic models.

Abstract:Many jurisdictions face the question of whether to legislate to introduce a whistle-blower protection regime for disclosures of information regarding breaches of tax laws or misconduct relating to an entity’s tax affairs. To this extent, Australia is no exception and is in the process of passing legislation through Parliament to insert a comprehensive regime into the Taxation Administration Act 1953 for the protection of individuals who report breaches of the tax laws or misconduct. Like all regulatory reform, the introduction of the legislation has been a lengthy and controversial process which began with an announcement by the Government as part of their Federal Budget in May 2016. This article discusses Australia’s historical and recent approach to whistle-blower protection, provides an analysis of the processes which resulted in legislation being proposed and analyses some of the fundamental elements of the proposed whistle-blower protection regime for tax matters.

Abstract:The traditional way of describing the history of Chinese law, i.e., fitting Chinese historical materials into the basic framework of the Western conceptual system needs to be thoroughly reconsidered. "Precedent" or "(SIC)" (panli), which has attracted academic attention both in China and abroad, can serve as an example in this regard. The concept "(SIC)" which may have originated from Japanese kanji in the nineteenth century, was used to translate its Western counterpart. A review of the historical and modern practice of the Western European countries of England and France shows that precedent has always played an important role in achieving consensus in the legal community and guiding future rulings by means of case law. This function, which has something in common with the relevant portions of ancient Chinese legal institutions, can serve as a foundation for constructing a universal theoretical system. At the same time, the relevant Chinese institutions had specific institutional contexts and functions. By combining universal and specific functional analysis, " two-way functionalism" may be able to avoid the Western-centric approach and futile conceptual discrimination and turn towards the exploration and elucidation of functional issues, so as to eventually establish a new framework for the narrative of Chinese legal history.
