Abstract:Abstract On 5 December 2017, the United Nations declared a ‘Decade of Ocean Science for Sustainable Development’ to be observed from 2021 to 2030. Beyond the rhetoric of sustainability, the absence of a rights-based approach that places human beings at the core of ocean policy and governance is striking. The ocean indeed remains the scene of major human rights violations. From seafarers to ship breaking sites or fisheries, the ocean is not only the place where 90% of trade in goods happens, but also the territory where grave human rights violations, often related to the labour recruited for ocean trade and investments, occur. In this context and based on a series of case studies involving seafarers, ship breaking and fisheries, in various countries, this article interrogates the silence of international economic law instruments and dispute settlement mechanisms and suggests pathways for reform in better integrating the International Labour Organization approach.

Abstract:Some forty years ago, the UN Convention on the Law of the Sea 1982 (UNCLOS) created an unusual regime for states to collectively manage common natural resources on the international seabed beyond national jurisdiction (known as "the Area") through the International Seabed Authority (ISA). In the intervening years, scientists have increasingly been warning about the serious environmental risks of mining seabed minerals. At this pivotal point in time, when states are negotiating whether or not to allow seabed mining, this essay explores the risk of undermining by mining, that is, contravening international marine environmental law and the obligations and responsibilities of states thereunder by allowing commercial mining activities to commence. We argue that allowing seabed mining in the Area at this juncture, when so much about the deep ocean remains unknown, would risk frustrating a host of measures, achievements, and progress to enhance marine environmental protection, particularly in areas beyond national jurisdiction. We begin with an overview of the ISA and its work to date, before discussing potential interactions between seabed mining and marine environmental law and policies, with a particular focus on the new ocean biodiversity agreement. We conclude by urging states to take cognizance of their overarching duty to protect and preserve the marine environment and ensure that all decisions taken with respect to seabed mining are consistent with their obligations and responsibilities under international law.

Abstract:The UN Law of the Sea Convention (LOSC) was negotiated during the greatest upwelling of enlightened environmental thought in the 1970s. The critical backdrop to the negotiations that led to significant environment-focused provisions to protect the world's oceans was a period encapsulated by the 'tragedy of the commons' debate and emerging sustainability concerns, rights of statehood for newly independent countries, and recognition of the need to support the development aspirations of lesser-developed States. There were high hopes among commentators at the time that the LOSC would contribute to the orderly development of the world's ocean-related activities and the protection of the marine environment. LOSC drafters tackled head-on pollution as one of the most pressing marine environmental challenges. LOSC also paved the way for the development of more specific international instruments to address various marine environmental challenges. The 40-year mark of the text being concluded and LOSC open for signature is an appropriate time to reflect on the contribution of the LOSC to marine environmental protection.

Abstract:Industrial-scale global fishing, driven by technology, market demands, and fuel subsidies, have threatened the sustainability of fish stocks. Poor fisheries data and government fuel subsidies, especially for external fishing fleets, enables wealthy nations to exploit the waters of coastal countries with less stringent fisheries management. Relations between the European Union (EU) and West Africa exemplify imbalances, in which EU interests overshadow local sustainability, leading to long-term declines in local fish stocks. At present, poor data and opaque agreements will make positive change difficult. However, the WTO’s 2022 Agreement on Fisheries Subsidies can be used to leverage positive change.

Abstract:Recent decades have seen a rapid increase in the diversity of ocean uses and threats, leading to the Anthropocene ocean: a place fraught with challenges for governance such as resource collapse, pollution, and changing sea levels and ocean chemistry. Here we review shifts in ocean governance regimes from the United Nations Convention on the Law of the Sea, the first legal regime for the global ocean, to Sustainable Development Goal 14 and beyond. This second period represents a merging of growing international interest in the ocean as part of the global sustainable development agenda—characterized by a focus on knowledge, collaboration, and the formation of alliances between diverse actors and institutions of environmental governance. To conduct this review, we analyzed literature on changing actors, regimes, and institutional arrangements for ocean governance over time. We conclude with a summary of challenges and opportunities for future ocean governance.

Abstract:Commercial seabed mining seems imminent, highlighting the urgent need for coherent, effective policy to safeguard the marine environment. Reconciling seabed mining with the United Nations Sustainable Development Goals will be difficult because minerals extraction will have irreversible consequences that could lead to the loss of habitats, species and ecosystems services. A dialog needs to take place around social, cultural, environmental and economic costs and benefits. Governance of human interactions with the seabed is fragmented and lacks transparency, with a heavy focus on facilitating exploitation rather than ensuring protection. In the light of high uncertainties and high stakes, we present a critical review of proposed policy options for the regulation of seabed mining activities, recommend actions to improve seabed governance and outline the alternatives to mining fragile deep-sea ecosystems.

Abstract:This chapter provides a new perspective on the subject of maritime security. It argues that piracy and armed robbery at sea are in reality land-based problems, the root causes of which still remain to be addressed by the international community. However, this chapter also maintains that, instead of focussing on short-term security measures, the stress factors that lead to instability, insecurity, and uncontrolled mass migration should also be addressed. The aim should be to improve economic development, supported by maritime development and underpinned by maritime security. Furthermore, the chapter examines not only the issue of piracy and terrorism at sea but also International Maritime Organization (IMO) measures aimed at improving security of international movements of containers, which has a wider implication than just prevention of terrorism and the protection of customs revenues.

Abstract:This essay adopts an interdisciplinary approach to consider the meaning of "eco-crime" in the aquatic environment and draws on marine science, the study of criminal law and environmental law, and the criminology of environmental harms. It reviews examples of actions and behaviors of concern, such as offences committed by transnational organized crime and the legal and illegal over-exploitation of marine resources, and it discusses responses related to protection, prosecution and punishment, including proposals for an internationally accepted and enforced law of ecocide. One key element of the policy and practice of ending ecocide is the call to prioritize the adoption of technologies that are benign and renewable. Our essay concludes with a description of the "Almadraba" method of fishing to illustrate that there are ways in which the principles of sustainability and restoration can be applied in an ethical and just way in the context of modern fisheries.

Abstract:In a globalized world, the world trade fleet plays a pivotal role in limiting transport costs. But, the management of obsolete ships is an acute problem, with most Ship Recycling Facilities (SRF) situated in developing countries. They are renowned for their controversial work and safety conditions and their environmental impact. Paradoxically, dismantlement is paid for by the shipowners in accordance with international conventions therefore it is more profitable for them to sell off ships destined for scrapping. Scuttling, the alternative to scrapping, is assessed in the present review to compare the cost/benefit ratios of the two approaches. Although scrapping provides employment and raw materials – but with environmental, health and safety costs – scuttling provides fisheries and diving tourism opportunities but needs appropriate management to avoid organic and metal pollution, introduction of invasive species and exacerbation of coastal erosion. It is also limited by appropriate bottom depth, ship type and number. The present review inventories the environmental, health, safety, economic, and forensic aspects of each alternative.

Abstract:Abstract The 1972 United Nations Conference on the Human Environment (Stockholm Conference) was a milestone as the first global meeting of governments to address threats to the environment, including the ocean and seas. Over the fifty years since the adoption of the Stockholm Declaration, new pressing threats to the marine environment have emerged, such as loss of marine biodiversity, including in the high seas, marine plastic pollution, climate change, and illegal, unregulated, and unreported fishing. This article will review the developments that have taken place at the International Maritime Organization and other bodies of the United Nations to address these new threats to the marine environment, reflecting how international law continues to play a vital role in promotion of ocean governance.

Abstract:Recent years have seen a sharp uptick in efforts to expedite resource extraction in, and expand biodiversity conservation to, Areas Beyond National Jurisdiction (ABNJ), the ~70% of oceans outside state space. In this symposium piece, we explore the co‐constitution of the parallel acceleration of biodiversity conservation and economic exploitation that is unfolding in ways unique to the high seas, but consistent with global patterns wherein this coupling encloses space for capitalist value extraction. These coupled tendencies are part of expanded ocean regulation and, in ABNJ, they form part of state‐capital advancement into one of the remaining world frontiers. We explore this extraction‐conservation nexus in two contemporary ABNJ negotiations: 1) the Implementing Agreement under the United Nations Convention on the Law of the Sea (UNCLOS) on the Conservation and Sustainable Use of Marine Biological Diversity of Areas Beyond National Jurisdiction and 2) the International Seabed Authority's development of an exploitation regime for deep‐seabed mining in the Area. Our findings build on insights from agrarian political economy and political ecology that establish the co‐constitution – rather than incommensurability – of conservation and extractive activities in terrestrial spaces and draw out the arenas of this nexus in the ecologically complex, political‐economic grey zone that is the uninhabited (by humans), non‐state space of the planet. This work contributes to placing the high seas and the emergent blue economy within the critical scholarship that describes and explores the conservation‐extraction nexus and its consequences.

Abstract:This chapter shows how the 171 Member States and 3 Associate Members that make up the International Maritime Organization’s (IMO) membership have shown themselves to be focussed on promoting the twin goals of safe, secure, sound, and efficient shipping on clean oceans. This has been achieved in part through the establishment and maintenance of a web of regulations ranging from over 50 fully fledged multinational conventions to a host of other so-called ‘soft law’ instruments. More remarkably, most of the Organization’s main safety and environmental conventions cover over 90 per cent of the tonnage of the world’s commercial fleet. This underscores the significance attributed by the IMO and its membership to the need for global standards and practices. Doubtless, however, much effort still remains to be expended to ensure the global uniform application of these regulations.

Abstract:This chapter examines the key environmental elements of the International Seabed Authority's (ISA) ‘Mining Code’, a regulatory framework for the commercial exploitation of mineral resources. The term ‘Mining Code’ refers to the whole comprehensive set of rules, regulations and procedures issued by the ISA to regulate prospecting, exploration and exploitation of minerals. The set of rules includes the collaboration of the respective responsibilities of deep seabed explorers and of the ISA in order to ensure environmentally sustainable development of deep seabed mineral resources. The chapter first provides an overview of the general regulatory framework for deep seabed mining, which is a contract-based system, before discussing the continuous legal evolution of the Mining Code. It also considers the generic issues that need to be addressed in relation to the future exploitation of minerals and explains why exploitation-related environmental regulations must be an integral component of advancing the Mining Code.

Abstract:Abstract The ocean, which regulates climate and supports vital ecosystem services, is crucial to our Earth system and livelihoods. Yet, it is threatened by anthropogenic pressures and climate change. A healthy ocean that supports a sustainable ocean economy requires adequate financing vehicles that generate, invest, align, and account for financial capital to achieve sustained ocean health and governance. However, the current finance gap is large; we identify key barriers to financing a sustainable ocean economy and suggest how to mitigate them, to incentivize the kind of public and private investments needed for topnotch science and management in support of a sustainable ocean economy.

Abstract:Marine litter is a global and transboundary pollution problem. Recent attention has focused on the impact of this issue on areas beyond national jurisdiction. In many cases, marine litter is traced to a coastal State where debris have been released into the sea. Effective and legally-binding commitments at the global level to tackle land-based sources of marine pollution are rare, in large part because of the sensitive nature of territorial sovereignty. When it comes to addressing the marine plastics crisis, sovereignty is a double-edged sword. On the one hand, the international legal regime traditionally addressing marine litter, the United Nations Convention on the Law of the Sea, does not specifically respond to, and is not able to adequately address, the issue of plastics as a land-based source of marine pollution. While it contributes to social equity by recognizing the special position of developing States in terms of capacity and need for economic development, this deference to domestic decisions is not conducive to the adoption of binding and global standards. Since a large majority of plastics in the oceans originate from land, this weakness is a major concern. On the other hand, sovereignty might contribute to a solution within the regime regulating trade in waste products: unilateral actions taken in application of sovereign powers and aimed at reducing trade in plastic waste led to major multilateral actions with the potential to reduce the issue of marine plastic pollution. In recent times, the Basel Convention on the Control of Transboundary Movements of Hazardous Waste and their Disposal has indeed become an important forum to respond to the plastic waste issue, with the potential to contribute to a solution to the marine dimension of this crisis. This regime is not perfect, especially in that its complexity and reliance on enforcement at the customs level leave ample opportunities for criminal activities to flourish. Areas for improvement include addressing the legal uncertainty regarding bilateral, regional, and multilateral agreements as well as certain key definitions; strengthening the prior informed consent procedure and the Mechanism for Promoting Implementation and Compliance; and heavily investing in capacity building and technology transfer. Nonetheless, this regime provides a widely-ratified framework to decrease trade in plastic waste considered hazardous or requiring special consideration – these two categories cover most hard-to-recycle plastics. In that sense, the Basel Convention regime has the potential to reduce mismanaged plastic waste leaking into the oceans and to contribute to social equity between States–if not domestically–by reducing the practice of wealthy countries using developing States as dumping grounds under the pretense of mutually beneficial trade in waste products.

Abstract:Abstract Labor abuse on fishing vessels and illegal, unreported and unregulated (IUU) fishing violate human rights, jeopardize food security, and deprive governments of revenues. We applied a multi-method approach, combining new empirical data with satellite information on fishing activities and vessel characteristics to map risks of labor abuse and IUU fishing, understand their relationships, and identify major drivers. Port risks were globally pervasive and often coupled, with 57% of assessed ports associated with labor abuse or IUU fishing. For trips ending in assessed ports, 82% were linked to labor abuse or IUU fishing risks. At-sea risk areas were primarily driven by fishing vessel flags linked to poor control of corruption by the flag state, high ownership by countries other than the flag state, and Chinese-flagged vessels. Transshipment risk areas were related to the gear type of fishing vessels engaged in potential transshipment and carrier vessel flags. Measures at port offer promise for mitigating risks, through the Port State Measures Agreement for IUU fishing, and ensuring sufficient vessel time at port to detect and respond to labor abuse. Our results highlight the need for coordinated action across actors to avoid risk displacement and make progress towards eliminating these socially, environmentally and economically unsustainable practices.

Abstract:This article examines how distant-water fishing by wealthy nations depletes fish stocks and harms food security in developing countries while benefiting richer markets. It explores the impact of practices like bycatch, the use of fish aggregating devices, and illegal fishing on the Global South. The findings show that industrial fleets from wealthier countries use sophisticated technology to exploit poorly regulated fisheries, outcompeting local fishers and causing economic and ecological damage. Fisheries data analysis and algorithmic tracking are not working for developing nations either. The research calls for stronger international cooperation, better fisheries management, and support for small-scale fishers to protect livelihoods and ensure sustainable fish stocks.

Abstract:At the UN Conference on Sustainable Development in Rio in June 2012, world leaders committed to the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction (the high seas). Our analysis of gaps in high seas management indicates that a paradigm shift to a more systematic approach will be needed to safeguard high seas biodiversity from mounting threats. Experience from terrestrial and coastal areas indicates that a systematic approach to conservation planning and management can help to maintain ecosystem health and productivity while enabling sustainable use. Our analysis further demonstrates that the current legal regime on the high seas is insufficient to realize these objectives: management institutions have neither an adequate mandate for integrated planning nor the ability to effectively coordinate across multiple management regimes. We identify key elements for future high seas management and posit that a two‐pronged approach is most promising: the development of an improved global legal regime that incorporates systematic planning as well as the expansion of existing and new regional agreements and mandates. This combined approach is most likely to achieve the required ecosystem‐based, integrated and science‐based management that world leaders at Rio acknowledged should underpin ocean management.

Abstract:Oceans in the colonial Anthropocene are haunted by the brutal racial logics of slavery, indenture, plunder, violence, death, and multispecies extinction. This brutality manifested through uneven burdens of climate extremes, global warming, ocean acidification, sea level rise, pollution, and threats from offshore energy extraction, chokes the “life force” of oceans that sustain planetary belongings and futures. Global agreements on climate change, biodiversity conventions, sustainable goals, and laws of the sea increasingly attempt to transform dystopic planetary futures through openness to Indigenous and local knowledges. But these overlooked Indigenous, Black, Brown, and southern intellectual traditions of belonging and responsibility in settler colonial, postcolonial, and post-apartheid societies have always existed alongside white, western Euro-American ontologies of the ocean. As subaltern southern and Indigenous scholars, our privileging of ontologies of the ocean amid the racial, colonial, and capitalist logics that continues to suffocate people and the planet, seeks to do more than enrich white, western, English-speaking Euro-American institutions. We, therefore, face ethical dilemmas as we assemble and prioritize strands of literature in our decolonial, polyphonic place-based ocean storytelling that seeks to advance new directions in Environmental Geography.

Abstract:The discharge and dumping of plastic debris into the world's oceans has become an increasingly serious form of marine pollution in recent years. To counter such practices, a number of international agreements containing specific prohibitions against dumping plastics into the marine environment have been promulgated. The 1972 London Dumping Convention, Annex V to the MARPOL Convention, and the 1978 MARPOL Protocol cite plastic pollution as unlawful in international waters. Though not yet in force, particular provisions mandating protection and preservation of the marine environment in the 1982 Law of the Sea Convention abo add considerable legal sway. Six special agreements of the UN Regional Seas Programme and three other relevant regional instruments contribute to banning pollution by dumping plastic substances in designated ocean areas. Given the large number of states that have legally committed themselves to being bound by one or more of these international agreements, a firm normative foundation appears to have evolved that prohibits marine plastic pollution. The full normative quality of this rule, however, will depend on the degree to which it is adhered to in state practice.
