Abstract:In 2015, the Government of China enacted Environmental Public-Interest Litigation (EPiL) as an amendment to its revised Environmental Protection Law. This policy granted civil organizations standing in court to represent public interests applied to environmental values. Based on a review of EPiL developments since 2015 and a case study focused on soil pollution litigation pursued by a leading environmental non-governmental organization (NGO), this paper analyzes the contemporary dynamics of Chinese environmental governance and strategies through which NGOs are leveraging EPiL to advance policy change. Through critical engagement with the concepts of experimentalist governance, this paper highlights the complex pathways through which empowerment of civil society organizations produced policy shifts. Rather than focusing on information and learning derived from purposive experimentation, this study highlights how entrance of new actors introduced practical knowledge and new values that catalyzed an array of changes in governance arrangements. While the metaphor of experimentation suggests a system that is well understood and subject to controls, we identify substantial indeterminacy and openness in governance.

Abstract:China's research of environmental litigation of public good should step out of the American-centered pattern and carries out a comparative analysis with a broader perspective.As the origin of environmental litigation of public good,the qualifications of the plaintiff takes the criterion of injury in fact while India takes the criterion of sufficient interest.Although the EU's system came out late,it develops quickly and has established the mode of a pure litigation of public good,i.e.,imposing the qualifications of the plaintiff on environmental protection groups which conforms to certain criteria and get no benefits from the case.Our legislation should be centered on environmental administration litigation of public good and confine the qualifications of the plaintiff to environmental NGOs.

Abstract:For decades, the discipline of law and economics in the U.S. has offered a broader perspective to the analysis of legislation and jurisdiction compared to the European countries. While this is due to number of reasons, this article emphasizes the importance of the different legal cultures, offering analyses of the British, French, German and European legal framework. Although these differences seem to be rooted in structural differences and thus may persist for some time, there are areas of overlapping interests and similar approaches of applying methods of law and economics. The article focuses on these tendencies and offers a deeper analysis in the area of environmental protection.

Abstract:Environmental public interest litigation starts from the failed application of administrative enforcement of environmental law and traditional civil procedure system to get sufficient and effective remedies of environmental public welfare.Based on the public trust theory,national interests are usu-ally included in the broad sense of public interest,and hence environmental public welfare litigation protects not only narrowed social public interest but also national interest.However,since national en-vironmental welfare litigation differs from the public case in configuration principle of the litigation im-plementation right,they should be dealt with differently from both theoretical and institutional lev-el.Only if the relationship among national,public and individual interest be handled properly can rea-sonable and effective environmental public welfare litigation system be constructed in line with the basic principles and the use of existing legal norms from the interpretation theory.

Abstract:This article examines the judicial procedure for protecting the rights of citizens and public interests in the field of environmental protection in the People's Republic of China. The author analyzed the regulatory legal acts of China that regulate the activities of specialized courts for environmental protection. In the course of the research, the features of the creation of such courts are revealed, as well as the analysis of judicial practice on the consideration of disputes in the field of environmental protection is presented. Besides, it is established that only public organizations and prosecutor's offices are authorized to file lawsuits in the specialized courts for environmental protection in defense of public interests in the field of environmental protection. At the same time, the current legislation does not provide for citizens to apply to them, since everyone's environmental rights are generally protected by applying to the people's courts of the People's Republic of China. As a result of the research, the author came to the conclusion that the reform of environmental justice in China continues in the direction of legal regulation of the activities of specialized courts for environmental protection. At the same time, the chinese experience of protecting public interests in the field of environmental protection by public organizations or prosecutor's offices in environmental courts allows us to note an improvement in the quality of justice and progress in the consideration of this category of cases, since decisions are made by judges with special knowledge in this area. While the current legislation of China does not establish the specifics of protecting environmental rights by citizens in a General manner by applying to the people's courts of the People's Republic of China.

Abstract:Three decades have passed since the enactment in 1979 of the first piece of environmental protection legislation in China, entitled “The Trial Environmental Protection Law of the People’s Republic of China”. In that time, august development of various academic theories concerning environmental protection has guided legal practice. These include the Theory of Environmental Rights, the Theory of Public Participation in Environmental Protection, the Scheme of Compensation for Environmental Harm, and the Theory of Ecological Damages. Together, these have played a significant role in the development of environmental protection in China across the legislative, judicial and law-enforcement planes. Taking as a starting point the ‘Five-Year Plan’, this article introduces first the establishment and development of the Rule of law as it to the environment (hereinafter ‘environmental rule of law’, or ERL). This is done to enable a better understanding of topical issues, both theoretically and practically. Then, a brief survey will be undertaken of the above-mentioned theories attempting to trace their development. Finally, the author presents their conclusions.

Abstract:Pollution deteriorates as economy grows.As the direct victims of pollution, citizens around the world have struggled for their environmental rights through all kinds of legal and political means.The concept of environmental justice emerged as a result of such struggle.Access to Environmental Justice Movement originated from the United States,at the same time,Japanese citizens drew government's attention to environmental problems by a series of environmental cases.In developing countries such as Indonesia and Vietnam,access to Environmental Justice Movement encountered several setbacks,the mechanical reasons behind this deserves consideration.In recent years,Chinese government has vowed to improve environmental situation.Presently,Chinese citizens are able to access to environmental justice through litigation,administrative means and mediation.In practice,some obstacles exist in these pathways,including high cost of litigation,shortage of administrative resources,etc.By analyzing the experience of Access to Environmental Justice in other countries,it can be concluded that access to Environmental Justice is a systematic project.The only way to facilitate citizens' access to Environmental Justice is the joint effort of courts,administrative agencies and governments of both central and local levels.

Abstract:There have been important changes in the enforcement of European Union environmental law over the last 25 years. Environmental law has traditionally been reliant on the European Commission, but the Commission has started to withdraw from enforcement. Instead, it is undertaking efforts to ‘outsource’ enforcement to environmental non-governmental organisations (NGOs) by systematically promoting access for such groups to national courts. While the Commission has indicated that it sees centralised and private enforcement as substitutes, the advantages and drawbacks of each mechanism are evaluated and it is concluded that both mechanisms have an important role to play. In particular, the private enforcement of EU environmental law is dependent on national opportunity structures that are unlikely to ever be fully liberalised and harmonised by EU procedural law. Private enforcement is therefore not a panacea for compliance problems, and the growing absence of a central enforcing authority is a cause for concern.

Abstract:China and Germany differ significantly in their economic, social, and political contexts, each embracing distinct political systems for forest-related nature conservation. We ask whether the differences and competition in policy forces also scientific research to separate or whether there exists a common ground for joint policy research in both countries. The expectation is that if the comparison can identify specific scientific explanations for the policy process, which works in both countries, these similarities would provide a solid basis for common research despite competitive policies. The comparison focuses on middle-range theories in the analysis and empirical evidence of six cases of forest-related nature conservation policy in China and Germany. The results reveal a plethora of identical political processes in the forest-related nature conservation policies in both countries. These processes range from the identical formulation of stronger ecological goals and informal dominance of interest-driven actors in implementation to the same elements of political power driving the solutions on the ground in the forest. The comparison indicates a sufficient common ground for joint research in forest-related nature conservation policy in China and Germany. Our conclusion demonstrates, based on the R(esearch) - I(ntegration) - U(tilization) model, how such cooperation is possible despite competitive and conflicting political systems. Such a cooperation would be fruitful for addressing science-based the overarching challenges posed by climate change and biodiversity loss for resilient forest ecosystems.

Abstract:Abstract “Protection of the environment“ and “sustainability“ are more significant than ever. The legal system contributes an important share to the protection of the environment. However, an overview of the German private environmental liability law shows that conventional tort law is not a suitable basis for civil liability for the environmental consequences of officially approved emissions of greenhouse gases. In general, one of the main problems of private environmental liability law lies in proving the individual causality of the conduct of an emitter, as the lawsuit of a Peruvian homeowner against a German energy company pending before the Higher Regional Court of Hamm illustratively demonstrates. The outcome of this lawsuit, which may have an outstanding significance for the status and development of private environmental liability law in Germany, is awaited with great anticipation. The article also briefly examines recent developments in private environmental liability law outside Germany and the question to what extent insurance can be an instrument to protect the environment.

Abstract:Since “ecological civilization” was written into the constitution, China has continuously strengthened ecological and environmental protection and innovatively established an environmental public interest litigation system. However, China’s current environmental public interest litigation system is not sound, especially since the types and scope of environmental public interest litigation are unclear, which is the core problem we aim to solve. To explore the types of environmental public interest litigation in China and the possibility of expanding new fields, we first used the normative analysis method to review the legislation of environmental public interest litigation in China and then conducted an empirical analysis of 215 judgment documents of environmental public interest litigation in China, and we concluded that the legal types and scope of application of environmental public interest litigation in China are constantly expanding. To reduce environmental pollution and ecological damage as much as possible, we argue that China should further expand the application of environmental administrative public interest litigation to improve the environmental civil public interest litigation system and adhere to the criteria of “behavior standards first, result standards second” and “prevention first, recovery second”. At the same time, through the internal connection mechanism between procuratorial suggestions and environmental administrative public interest litigation, the external cooperation between environmental organizations, procuratorates, and environmental administrative departments should be strengthened, and a new mechanism for environmental public interest litigation should be established and improved to accumulate useful experience in the judicial protection of China’s ecological environment.

Abstract:Abstract There has been a turn to fundamental rights in environmental and climate cases before national and international courts in recent years. We know very little whether there has been such a turn in relation to European Union (EU) law before the Court of Justice of the European Union (CJEU). The CJEU occupies an increasingly relevant position in this nexus between environmental law and human rights because of strong and effective EU enforcement mechanisms, the abundance of specific EU secondary environmental law, the growing role of fundamental rights since 2009 and the self-standing provision on the environment in Article 37 of the Charter. An analysis of the case law, nonetheless, shows that Charter rights that can be used as ‘swords’ in the interest of environmental protection have so far played only a limited role. After explaining the absence of a rights turn, we argue that such a turn is warranted before the CJEU as well, also from a legal perspective. This article examines two potential avenues. The CJEU can derive positive obligations from relevant Charter provisions, including Articles 2 (right to life) and 7 (right to respect for private life and the home) of the Charter, or it can rely more extensively on Article 37 as a tool for interpreting primary and secondary EU law in an environmentally friendly way.

Abstract:Cases of marine environmental pollution (MEP), such as condensate leakage in the Sanchi case, not only directly infringe on private personal health and property rights, but also cause serious damage to the marine ecological environment. This paper analyzes dozens of MEP cases and summarizes the typical rights, interests, and remedies under Chinese law. Traditional tort liability legislation remedies the problem of infringement of private interests by environmental torts through compensation and punitive damages but it cannot reverse the damage to the marine ecological environment. Traditional civil legislation is built on the basis of rights and interests regarding damages and relief. MEP infringes on a wide range of citizens' environmental rights and should be addressed by the environmental public interest litigation (EPIL), which is an important way to protect citizens' environmental rights. This paper analyzes the legal interests, relief measures, and limitations of the existing EPIL legislation that is applicable to MEP cases under Chinese law, so as to make corresponding legislative suggestions.

Abstract:Protection of the environment is regulated by numerous laws and bylaws, within legal areas. As regards regulations of an imperative nature, there is no doubt that these provisions represent the public interest and responsibility of the state to preserve and improve the environment. The paper examines the potential of private law rights to contribute to environmental protection and improvement, because the action of entities depends on the choice of whether to act or not in certain circumstances. To illustrate a possible contribution of private law in environmental protection matters, patent and indications of geographical origin have attracted attention. While trying to determine a particular connection between rights and environmental matters, it has become clear that significant improvement of environmental protection can be provided in a circular flow through different areas of law. Protecting and supporting private law rights is not detached from guarding the public interest. An examination of patent law potential should demonstrate that cooperation between scientific research institutions and industry is of primary concern in modern society. In practice, a number of issues obstruct successful cooperation; however, this is an opportunity for the state to encourage collaboration. A similar approach should be suggested in relation to indications of geographical origin. State and local governments should encourage recognition of indicators of geographical origin, attracted to localities of high environmental quality.

Abstract:With the increasingly severer environmental problems, the government plays a more and more important role in the field of environmental supervision. Environmental Protection Law of the People′s Republic of China ( 2014 Revision) has explicitly stipulated that the local governments at all levels shall be responsible for the environmental quality within their respective administrative regions. But Article 58 in the law has not set up corresponding external supervision system on circumstances of governments indolent in carrying out environmental supervision duties, which objectively leads to the unbalanced development of environmental public interest litigation practice. Reference are learned from the environmental public interest litigation legislation and juridical practice in western countries, of which the major is the environmental administrative public litigation instituted by the civil and environmental groups that filed adminis?trative lawsuits. So as to prove that the key to consummate Chinese environmental public interest litigation system should be the con?struction of the environmental administrative public interest litigation system, in order to regulate the phenomenon of government failure in the environmental protection field and classify the relationship between the administrative power and judicial power in the field of public affairs.

Abstract:The law of environmental liability has already been the object of several comparative endeavours. This article seeks to bring a different perspective to the debate, by examining selected developments in the field through the lens of the emerging global environmental law scholarship. It brings the comparative method of analysis into a multi-level context with a view to identifying the emergence of common legal responses to the problem of liability and reparation for environmental harm across different jurisdictions and regulatory levels. The analysis will focus on a ‘novel’ set of environmental liability regimes, which specifically address damage to the environment and to natural resources, as distinct from more traditional categories of damage to property and other individual rights arising as a consequence of environmental pollution. These include: the United States Comprehensive Environmental Response, Compensation, and Liability Act, and the Oil Pollution Act, which constitute a pioneering attempt to envisage a public law-oriented system of liability and restoration for damage to natural resources; the European Union Environmental Liability Directive; and selected, recent international treaty developments. The article argues that, while adopted within different legal orders and regulatory contexts, these environmental liability regimes share common features, which correspond to the ontological aspects of environmental damage and ultimately reflect a common understanding of the environment as a global public good.
