Abstract:AbstractThe aim of the paper is to discuss legal language systems as culturally constituted sign-systems that are continuously evolving in time and space. To understand messages formulated in legal languages, one needs to realize that law is culture-bound, which in turn means that law reflects society’s mentality, tolerance, knowledge, social perceptions, etc. At the same time, law is a living reality impacted by various global phenomena and other legal systems. Therefore, this legal reality has “divergent potentialities” (Hasegawa, Ko. 2016. “A glance at the dynamics of ‘confluence’ in a legal system – notes on H. Patrick Glenn’s insights concerningLegal Traditions of the World”. InTransnational Legal Theory. Vol. 7/1: 1–8, 3), which enable it to develop in various directions depending on wider social, political and technological contexts. Additionally, when communicating law interlingually and intralingually, one needs to take into account the knowledge of senders and recipients since the degree of commensurability of law depends on the uniformity of interpretation on meanings. When discussing the issues of sign meaning interpretation, the authors will focus on non-decomposable units and fuzzy units. The meaning of such terms is subject to interpretation through the prism of tacit knowledge. Therefore, the interpretation of any culturally constituted sign-system is burdened with some loss of information and meaning deficiency.

Abstract:The most comprehensive efforts to develop a new evolutionary approach to law are found in the work of Nonet and Selznick in the United States and Habermas and Luhmann in Germany. While these theorists are concerned with a common problem—the crisis of formal rationality of law—they differ drastically in their accounts of the problem and their vision of the future. This paper tries to resolve these differences by first decomposing and then restructuring the diverse neo-evolutionary models. Using a more comprehensive model of socio-legal covariation, the author identifies an emerging kind of legal structure which he calls “reflexive law.” Reflexive law is characterized by a new kind of legal self-restraint. Instead of taking over regulatory responsibility for the outcome of social processes, reflexive law restricts itself to the installation, correction, and redefinition of democratic self-regulatory mechanisms. The author identifies areas of private law in which reflexive solutions are arguably emerging, and he spells out the consequences which a concern for reflexivity has for a renewed sociological jurisprudence.

Abstract:In view of the quite considerable international research into the sociology of the family, family law and the sociology of law, albeit on separated disciplinary lines of theory and methodology, the authors consider the strenghtening of comprehensive approaches to the study of family and law necessary. One of these is the formulation of a theoretical guide line for the conduct of interdisciplinary empirical research in the field. The authors suggest that sociological attention should be divided equally between the functions and structures of the family on the one hand and the law on the other so as to be able to construct a theoretical frame for empirical research on family law of scientific value for both the lawyer and the sociologist. This article scans the contributions of the sociology of the family and the sociology of law in the field of marriage, family and the state and tries to link them up to form a comprehensive theoretical perspective on family dynamics and legal change as these can be subjected to meaningful empirical research. An example for such a study is provided by the authors’ research into the social impact of the family courts/divorce procedures in West Germany, Denmark, and Australia.

Abstract:This paper offers an overview of the development of Legal Translation Studies as a major interdiscipline within Translation Studies. It reviews key elements that shape its specificity and constitute the shared ground of its research community: object of study, place within academia, denomination, historical milestones and key approaches. This review elicits the different stages of evolution leading to the field’s current position and its particular interaction with Law. The focus is placed on commonalities as a means to identify distinctive reference points and avenues for further development. A comprehensive categorization of legal texts and the systematic scrutiny of contextual variables are highlighted as pivotal in defining the scope of the discipline and in proposing overarching conceptual and methodological models. Analyzing the applicability of these models and their impact on legal translation quality is considered a priority in order to reinforce interdisciplinary specificity in line with professional needs.

Abstract:Wilhelm Bölsche (1861-1939) is the author of a poetic history of the evolution of love entitled Das Liebesleben in der Natur (1898-1903). This work, inspired by the writings of biologist Ernst Haeckel, was greatly successful in Germany at the beginning of the 20th century. Freud kept a copy of the three volumes in his London library and cites the text in his lectures on an Introduction to psychoanalysis. Bölsche develops an Entwicklungsgeschichte (history of evolution) of the distinguishing sexuality of several types of love (oral, anal and urinary). In addition, he describes the "zoological reactionary" homosexual and ties this sexual behaviour to the history of the development of anal sexuality. This paper will address an excerpt on this topic from Bölsche's text that has been translated for the occasion. The task at hand is to prepare the ground for a study of German evolutionism, both popular and scientific, and its ties to psychoanalysis.

Abstract:The rechtsgüt theory,originated from Germany,is a theory concerning the nature of crimes.This theory has been introduced into China for the purpose of strengthening the contents of the traditional social harm theory.However,the rechtsgüt theory shares the same drawbacks with the social harm theory.The interpretive criminal legal theory confines itself to the interpretation of criminal laws in an attempt to describe the rechtsgüeter,and is therefore incapable of uncovering the substance of social harm or rechtsgüeter and unable to provide theoretical guidance for criminal legislation.A substantial rechtsgüt theory is advocated from the pre-legislation perspective and the paradigms of primary group and secondary group in sociology, the economic theory of division of labor and the theory of stratified interests shall be applied to enrich and perfect the social harm theory and the rechtsgüt theory.The interests of the primary groups are the subsisting interests with human life as the core,divided in two categories,natural subsisting interests consisting of physical subsisting interests and property subsisting interests as well as security interests.Security is the highest abstraction and comprehension of various orders violated by crimes.The substance of social harm is harm to primary groups,and the substance of rechtsgüeter is subsisting interest.

Abstract:Abstract This article traces the influence of the German Historical School of Law around Friedrich Carl von Savigny has had on various fundamental concepts of international law during the 19th and into the beginning of the 20th century in a detailed manner. During this time, the Historical School’s radical reformulation of the notion of law as a peoples’ spiritual essence unfolding through its habitual social action allowed 19th century scholars to redefine international law as customary law and, together with notably Hegelian teleological thought, laid conceptual groundwork for the integration of themes of European cultural superiority into the doctrines and philosophy of international law. Its conceptual legacy can further be traced in the later German positivism à la Jellinek or Oppenheim with its theories on ‘common civilised consent’ as foundation of international law.

Abstract:The Law in social theory is the study of law from the perspective of social theory. It comes from the absorption and study of social theory by a group of historic jurists in China after the reform and opening up. It has the characteristics of macroscopic investigation of law phenomena from two dimensions of space and time. The law in social theory, combined with the Chinese context, has gradually formed the awareness of five core issues. They are the modernity of law, the globalization of law, the cross-civilization comparison and dialogue of law, the function and significance of law and the freedom and liberation of human beings.

Legal research as a collective enterprise: an examination of data availability in empirical legal scholarship

Abstract:Abstract While most social sciences confronted data sharing, transparency, and reproducibility sometime in the last two decades, the legal academy has largely been absent from these discussions. In this study, we examine the degree to which the information underlying empirical studies is available. Using an original dataset of every empirical study published in top law journals from 2010 to 2022, we find that 15% have a dataset that is readily available. We compare these low rates with a dataset of every empirical article published in the top economics, political science, and interdisciplinary journals from 2018 to 2022. The vast majority of these articles (99%) make their data available. Additional analysis demonstrates that disciplinary norms enforced by journals drive when authors make their data available. Given the discrepancy between law and other social sciences, we advocate for a disciplinary and cultural shift in law that embraces data accessibility and identify concrete steps to improve data availability. Abstract:This edited volume explores the question of how anti-discrimination law fits into civil law jurisdictions of Europe. Anti-discrimination law, as well as much of academic literature on this topic, has originated in common law countries. This book breaks new ground with offering, for the first time, a sustained, critical, legal, and socio-legal, comparative look at jurisdictions beyond the common law. It tests the thesis that anti-discrimination law has been perceived as an import for which continental European jurisdictions have found little use. Through a set of single chapters, each written by a continental civil law legal scholar, this book demonstrates that, while to some extent the claim that anti-discrimination constituted a legal irritant remains true, today nevertheless a much more nuanced picture emerges. The situation depends on the country and varies also by specific area of law, the actors involved, as well as the ground or concept of anti-discrimination law one focuses on.

Abstract:The article raises the question of the need to expand interdisciplinary links of legal science and its output beyond the socio-cultural context, in which the state-legal phenomena are most often studied. On the example of the data of evolutionary biology, cognitive and evolutionary psychology, as well as a number of other directions of modern scientific knowledge, the issues that can and should become a subject of reflection for legal scientists are outlined. At the same time, attention is drawn to the relevance of the principle of transdisciplinarity in the knowledge of the world around, including the study of law and state. Some perspective directions of interdisciplinary research of human legal behavior and state-legal regulation are defined. In particular, the influence of the system of intuitive inferences is developed in the course of biological evolution and is not controlled by consciousness on the process of selection and perception of meaningful information (including predisposition to learning morality), on the ability of a person to form various associations and innate mechanisms of recognizing social alliances (coalitions) and control over loyalty to them, on the built-in in the mind patterns of exchange and sense of justice are outlined.
Legal Translation Versus Legal Interpretation. A Legal-Theoretical Perspective

Abstract:Abstract In this article we investigate the relationship between legal translation and legal interpretation. The common wisdom is that these activities are closely related, but the nature of that relationship remains disputable. We adopt the perspective of legal theory—as opposed to the perspective of translation studies—which seems to be underrepresented in the literature of the subject. We start with distinguishing between the two notions of legal interpretation: the wide sense (interpretation as understanding) and the narrow sense (interpretation as problem solving). We argue that the relationship between legal translation and legal interpretation changes significantly depending on the notion of legal interpretation that is assumed. The wide sense is often assumed by translation scholars and it renders legal interpretation as a necessary prerequisite for legal translation. Jurists, on the other hand, usually assume the narrow sense which renders legal interpretation and legal translation as two distinct activities with some shared features. We then focus on four issues of legal interpretation in the narrow sense: the types of legal interpretive problems, the creation of legal interpretive problems, the methods of legal interpretation, the resolution of legal interpretive problems. We conclude with a detailed comparison of legal translation and legal interpretation in the context of those four issues.

Abstract:1. For many talented scholars, international law in the last decades has been mainly an intellectual exercise in abstract logic. They indulged in the construction of theoretical systems in which international law operated in a logical way. Others, mainly in English speaking countries, restricted the treatment of international law to the discussion of cases. Both approaches failed to build a solid structure with the realities of international life in which international law is applied. Charles De Visscher does not belong to either group but his approach is a return to sound traditions of earlier periods. International law as a legal discipline is only three or four centuries old, although some of its rules have existed throughout history. Modern international law developed after the collapse of the hierarchic order of the Middle Ages, when the sovereign independent state became the basic unit in international relations. Since the seventeenth century many of the great international lawyers have been practicing diplomats as well. Their writings reflected and influenced the intellectual climate of their age and remained in harmony with the realities of international politics. At the same time, the Christian tradition of natural law played an important role in their thinking. This tradition set up barriers against the omnipotence of the state and made possible imaginative approaches in new situations. It is not by chance that Hugo Grotius' fundamental work, On the Law of War and Peace (1625), and Emmerich Vattel's Law of Nations (1758) became the first best sellers in international relations. While subsequently legal positivism greatly hindered the growth and creative function of international law, numerous authors in the period between the world wars have fallen into the other extreme. Abstract:Abstract Expanding the existing framework of a Franco-German axis of dissemination of print culture, this essay discusses a pan-European geography of the book trade to account for the dissemination of foreign-language editions circulating from the nineteenth-century Leipzig book industry and connecting publishers all over the European continent. More specifically, it reconsiders the history of the Brockhaus firm by highlighting its transnational links and the shared practices of the European publishers prior to copyright legislation and the rise of nationalism.

Abstract:The article is devoted to the legal doctrine of the famous New Zealand jurist John William Salmond - one of the most remarkable representatives of Anglo-American legal positivism, who made a significant contribution to its development. The aim is to reconstruct the views of a lawyer about the nature of law and the subject area of jurisprudence. The relevance lies in the fact that the evolution of Anglo-American legal positivism from J. Austin to the teachings of H.L.A. Hart is poorly studied in Russian jurisprudence while prevailing in Anglo-American legal thought. The methodological basis comprises historical approach along with the elements of a biographical approach, techniques and procedures of legal hermeneutics, rules and techniques of formal logic allowing to reconstruct the key ideas of J. Salmond's legal theory and place it in the context of the common law tradition. The main ideological line of the work is the connection between the legal teachings of J. Austin, J. Salmond and H.L.A. Hart. The work reveals features that allow to assert the typological belonging of Salmond's doctrine to the classical legal positivism in England. Particular attention in the article is paid to the study of significant differences between the legal teachings of J. Austin and J. Salmond, as well as the substantial similarities between legal theories of J. Salmond and H.L.A. Hart. The author came to the conclusion that Salmond's legal doctrine was the first in the history of English legal positivism, where the basis for the validity of law lies not in the order of the sovereign, but within the practice of the courts recognizing the rules as legal.
