Abstract:In this paper, legal translation and its role in the interpretation of international law documents have been taken into consideration, both from a theoretical and a practical perspective. As far as theoretical aspects are concerned, legal translation in the light of civil law (Roman law) and common law systems, the status of legal translation in international law, the principles of plain language, and the equivalence of legal words are discussed. Accordingly, the interconnection between legal translation and interpretation of international law documents has been examined. As regards the practical perspective, the practice of the International Court of Justice, as well as applicable rules of the World Trade Organization and the European Union in respect of legal translation, has been discussed. The study carried out shows that due to the nature of international law and different foundations, goals, structures, sources and concepts of international legal order on the one hand, and divergent legal and cultural characteristics, as well as non-equivalent technical terms of various legal systems on the other, legal translators, who are inevitably influenced by their own national laws, are confronted with many profound difficulties.

Abstract:Abstract This article traces the influence of the German Historical School of Law around Friedrich Carl von Savigny has had on various fundamental concepts of international law during the 19th and into the beginning of the 20th century in a detailed manner. During this time, the Historical School’s radical reformulation of the notion of law as a peoples’ spiritual essence unfolding through its habitual social action allowed 19th century scholars to redefine international law as customary law and, together with notably Hegelian teleological thought, laid conceptual groundwork for the integration of themes of European cultural superiority into the doctrines and philosophy of international law. Its conceptual legacy can further be traced in the later German positivism à la Jellinek or Oppenheim with its theories on ‘common civilised consent’ as foundation of international law.

Abstract:Many diverse and heterogeneous activities regularly performed by the professionals working in the “multifaceted and dynamically changing profession” are analyzed by scholars of legal translation, or Legal Translation Studies. Legal language might be used by parties pursuing different communicative goals – for instance, regulatory, informative or argumentative – in a wide range of genres and contexts, and in multifarious interactions with other agents who may have similar or diverging degrees of expertise. Research informed by comparative law and legal hermeneutics, including jurilinguistics, has similarly encouraged a rethinking and revision of legal translation practices. The analytic method of comparative law involves “comparing and contrasting the legal and linguistic content of legal concepts”. Legal translation involves a complex process of decision-making which requires a high level of specialization and the development of a diverse, interdependent range of competences with important linguistic, legal, sociocultural, institutional, political and ethical implications.

Abstract:In this research, we established a small scale corpus with abstracts in English and Chinese from the law reviews of Taiwan. We identified problems found in these abstracts and classified them into several categories. After analyzing the problems, we found that translators are faced with numerous problems when translating legal texts: the influence of ordinary language, lack of reliable reference tools, insufficiency of legal knowledge, deficiency in the target language or source language, and the peculiar characteristics of legal language. These problems simply render the task of translating even more intricate. Strategies will be proposed to enhance the ability of legal translators and to help them to overcome these obstacles.

Abstract:AbstractThe aim of the paper is to discuss legal language systems as culturally constituted sign-systems that are continuously evolving in time and space. To understand messages formulated in legal languages, one needs to realize that law is culture-bound, which in turn means that law reflects society’s mentality, tolerance, knowledge, social perceptions, etc. At the same time, law is a living reality impacted by various global phenomena and other legal systems. Therefore, this legal reality has “divergent potentialities” (Hasegawa, Ko. 2016. “A glance at the dynamics of ‘confluence’ in a legal system – notes on H. Patrick Glenn’s insights concerningLegal Traditions of the World”. InTransnational Legal Theory. Vol. 7/1: 1–8, 3), which enable it to develop in various directions depending on wider social, political and technological contexts. Additionally, when communicating law interlingually and intralingually, one needs to take into account the knowledge of senders and recipients since the degree of commensurability of law depends on the uniformity of interpretation on meanings. When discussing the issues of sign meaning interpretation, the authors will focus on non-decomposable units and fuzzy units. The meaning of such terms is subject to interpretation through the prism of tacit knowledge. Therefore, the interpretation of any culturally constituted sign-system is burdened with some loss of information and meaning deficiency.
The case study of legal English translation in the view of functional translation theory

Abstract:Ever since the functional translation theory was put forward by the Germany translation theorist Reiss,it had been studied and developed by many scholars,such as Vermeer,Manttari and Nord.Nowadays,the functional translation theory is rather systematic and it plays an important role in guiding the practice of translation.This paper studies the translation of legal English based on the functional translation theory.In the view of functional translation theory and teleology,the paper first introduces the basic content of the theory and ideology of its representatives,then explores typical translation texts and analyzes practical issues of legal English translation.

Abstract:Quite different from translation for general purposes, transplanted legal discourse is often unmatchable to the target discourse community. In reality, exact equivalence could not be found in terms of translation in legal transplant, which means the major task of translation in legal transplant is to solve lacunae, discursive gaps between the source text and the target text. In legal translation, a lacuna seems to constitute a factor of untranslatability. This paper, based on a study of four cases, argues that equivalence can be achieved within the proposed Translational Triangle. The sociosemiotic approach is adopted in this study to explore the complexity in legal translation, and provide insights into legal translation, both theoretically and practically.

Abstract:The scholarly study of culture and translation in legal settings and institutions can be said to embody different stances on culture. If culture is involved in defining the epistemic nature of legal translation studies, it is also determinant in defining legal translator studies. Several associations have published guidelines on how to become interpreters and translators in legal and institutional settings or how to follow standards for practice. Legal and institutional settings have been traditionally linked to the evolution of interpreting and translation. Legal interpreting and translation studies have an extensive tradition and a long way ahead. Ironically, the most neglected culture may well be the translation culture. The identity between the language of the law and the law itself has led scholars to ascertain that the evolution of legal systems, deeply rooted in history and culture, defies the commensurability of legal Anschauungen. Scholars in comparative law conduct historical, functional, evolutionary, structural, thematic, empirical and statistical comparisons.

Abstract:This paper offers an overview of the development of Legal Translation Studies as a major interdiscipline within Translation Studies. It reviews key elements that shape its specificity and constitute the shared ground of its research community: object of study, place within academia, denomination, historical milestones and key approaches. This review elicits the different stages of evolution leading to the field’s current position and its particular interaction with Law. The focus is placed on commonalities as a means to identify distinctive reference points and avenues for further development. A comprehensive categorization of legal texts and the systematic scrutiny of contextual variables are highlighted as pivotal in defining the scope of the discipline and in proposing overarching conceptual and methodological models. Analyzing the applicability of these models and their impact on legal translation quality is considered a priority in order to reinforce interdisciplinary specificity in line with professional needs.

Abstract:This article deals with the peculiarities of translating legal terminology from German into Albanian and vice versa. Legal texts constitute an important part of translation into both languages. Translations of legal texts in Albania have increased since the latter's attempts to join the EU. European Union translation materials are in large volumes and require a lot of work. Therefore, the request for translation of legal documents, such as provisions or court decisions into other languages of the Union, including German, has increased. Despite institutional efforts to draft a glossary of legislation with the cooperation of professionals led by the OSCE (Organization for Security and Cooperation), as well as some efforts made in compiling Albanian-German legal dictionaries, there are no genuine publications in the Albanian language that handle the problems of translation in this field. Since technical legal language is a practical or institutional language, it is characterized by a high percentage of technical terms as well as a standardized sentence structure. Abstract:Italian code commentaries can be divided externally into super-large, large, medium, and small commentaries, with each type of code commentary playing an important role in theory and practice. Historically, influenced by the culture of German code commentaries, Italian code commentaries shifted from a purely textual exegesis to Pandekten systematic method. In addition to code commentaries, large textbooks and encyclopedias of legal science are also very important forms of legal science documents in Italy. Thus, from the perspective of Rechtsvergleichung, the importance of Italian code commentaries lies somewhere between that of Germany and France in Italian legal culture. On the one hand, the commentaries are considered to be an optimal tool for bridging theory and practice, playing an important role in legal theory, practical judgment and legislation, but on the other hand, they are less original than monographs. With the increasing number of legal science publications, code commentary is increasingly challenged.

Abstract:The expression "intersemiotic legal translation" refers to all forms of legal translation that use at least two different semiotic codes, of which at least one is not verbal. The article will analyze four different conceptions of intersemiotic translation by highlighting the different potential applications in the legal field, as well as the limitations related to this form of translation. The concept of "intersemiotic legal translation" will be examined as a species of the genus "legal translation", and will be framed according to a typology consisting of six types of legal translation that will take both its semiotic and its legal dimensions into account.

Abstract:The laws of each country have their own unique concepts, and even if the legal system is so similar as that of China and Germany, there are still many legal concepts that cannot completely overlap in connotation. For example, the Rechtsgeschaeft in the German civil law is inconsistent with the civil legal acts in the general principles of China's civil law, which only includes legal legal acts. In recent years, with the increase of legal and cultural exchanges with foreign countries in China, many problems have arisen in legal translation, such as spelling and grammar errors, and errors in the translation of legal terms. As a legal translator, you should have a correct attitude, be conscientious and responsible, and translate high-quality translations.

Abstract:This paper aims to explore the translation path of Chinese legal texts from the perspective of translation studies, taking into account the cultural, linguistic, and legal contexts. The study begins by introducing the concept of Chinese legal texts and their unique characteristics. It then examines the theoretical underpinnings of translation studies, with a focus on the concept of equivalence and the different translation methods. The paper then analyzes the challenges and strategies involved in translating Chinese legal texts into English, considering factors such as cultural differences, legal terminology, and narrative style. Finally, the paper proposes a translation path for Chinese legal texts that incorporates both fidelity and creativity. This path involves a series of steps, including text analysis, cultural adaptation, legal research, and linguistic refinement. The study concludes by highlighting the significance of the proposed translation path for promoting cross-cultural understanding and legal communication.

Abstract:SUMMARY A comparison of two major German-language monographs on interlinguistics sheds light on the common basis of the discipline and on its two major theoretical orientations, the sociological and the linguistic. Although interlinguistics properly includes the scientific study and systematic improvement of international linguistic communication in general, the creation and use of planned languages (international auxiliary languages) remains its chief object of research. ZUSAMMENFASSUNG Ein Vergleich von zwei großen deutschsprachigen Monographien über Interlinguistik beleuchtet die gemeinsamen Grundlagen der Disziplin und ihre zwei wichtigsten theoretischen Richtungen, die soziologische und die linguistische. Comparative Law for Legal Translation: Through Multiple Perspectives to Multidimensional Knowledge

Abstract:With this paper, I suggest a multiperspectivist approach for assessing conceptual legal knowledge with relevance for the translation of legal terms in translation between two or more different legal systems. The basic quest is to present a set of categories and analytical approaches for legal translators to generate (collect) and classify knowledge necessary for their professional conceptual needs. In this paper, I will focus on the translational, juridical, and cognitive basics of such an approach. In order to cope with the broad range of possible translational purposes in different translational situations and choose relevantly between alternative formulations, translators need methods and strategies in order to construct the necessary conceptual knowledge. This presupposes a broad knowledge structured in ways that enable the translator to recognize relevant characteristics of legal systems and relevant differences between different legal systems. Concerning translational theory, the basis is the functional theory of translation as adapted to legal translation, based upon the idea of translation as choice between alternatives and distinguishing between documentary translation, at one end of a scale, and instrumental translation, at the other. This basis and the distinction presuppose relevant knowledge from comparative law. Hence, existing approaches and fundamental tenets concerning comparative law inside and outside of translation are presented. In order for knowledge to be presented in a manageable way with relevance to translators, I work with the approach of concept frames as basic unit of knowledge gathering and categorization. This way of presenting knowledge is embedded more generally in a knowledge communication approach, focusing on knowledge asymmetry. Within this general framework, the multiperspectivist approach combines insights from cultural studies (especially the study of law-as-culture), law as a disciplinary social system, and communicative interaction generating meanings in legal communication, also across national borders.

In addition to linguistics and translation field, the study of legal English should also make use of relevant legal theories to achieve beneficial interdisciplinary research. This paper focuses on the legal pluralism in the field of legal English and how to make innovative use of the theory.
