Abstract:This paper provides a historical analysis of the peak and demise of the international view on cultural heritage. In the 1980s, cultural internationalism emerged as a conservative reaction against the adoption of the 1970 UNESCO Convention, which organises the restitution and return of stolen cultural properties. Internationalist and cosmopolitan scholars who have claimed that cultural heritage 'belongs to humanity', generally condemned restitution, and pushed back against the ratification of the Convention. The international view on cultural property became traditionally dominant in milieus such as universal museums, antiquity markets and some academic disciplines. However, over the past half-decade, the growing importance of research on provenance has challenged cultural internationalism in two areas. Firstly, research on provenance focused on art and archaeological crime has shown that artefacts allegedly excavated in the past are often the proceeds of recent looting, especially in conflict zones. Secondly, recent studies on historical provenance have revealed that many objects were collected using colonial violence. As a result, developments in criminology, postcolonial history, and indigenous peoples' rights have generally led to the retreat of cosmopolitan narratives on cultural property. Ultimately, this paper highlights that cosmopolitanism in cultural heritage has historically hinged on the imperialist past.

Restitution of stolen cultural properties: Lessons and challenges from recent Korean cases

Abstract:The Republic of Korea adopted the 1970 Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property on 14 February, 1983. The Convention has some disadvantages in that its scope does not cover the cultural properties stolen from Korean territory during the Japanese colonial era, which lasted from 1910 to 1945, and the Korean War from 1950 to 1953 because it cannot be retroactively applied to cultural properties stolen during these years, and it falls within the field of public international law. Hence, in order for the Korean government and the legal community to seek more effective methods of restitution of cultural properties stolen during these periods, alternative legal tools need to be discussed. Some good examples include the donation or purchase of stolen cultural property, arbitration of disputes over the restitution of cultural property, bilateral international instruments concerning the restitution of cultural property, and the restitution of stolen cultural property though the application of foreign domestic public law or private international law. In particular, the main focus of this article is on the restitution of stolen cultural property though foreign domestic public law or private international law. At the beginning of the article, it is illustrated where overseas Korean cultural properties are located. The article then delves into why the focus is on the restitution of stolen cultural property though the application of foreign domestic public law or private international law. Three examples are discussed based on these scenarios. The article concludes by looking at the lessons learned from these cases and the challenges that the Korean government and legal community are likely to face.

Abstract:Despite an abundance of international instruments devoted to the restitution of illegally exported cultural artifacts, they usually exhaust their usefulness regarding artifacts looted during the Colonial Era. These requests are indeed confronted with various obstacles, whether it is the limited scope of the conventions, their non-retroactive nature, or the expiration of periods of limitation. In the absence of applicable international standards, plaintiffs must then refer to national laws and courts of justice in the States concerned in the dispute. However, due to the complexity of situations and the diversity of legal systems, legal proceedings are often unpredictable and unsatisfactory. In these circumstances, many restitutions today are the result of alternative processes (voluntary restitution, mediation, or arbitration) which allow the participants to invoke moral, ethical, or deontological principles and lead to equitable solutions adapted to each situation.

Abstract:Over the past decades illicit trafficking in cultural property has, unfortunately, grown into a problem of epidemic proportions, comparable with the international trade in drugs, with which it shares certain characteristics. Whether or not we succeed in protecting cultural property better in the future depends on wide‐reaching changes in attitudes. A palpable expression of this gradual but certain change in attitude is the adoption of professional codes of ethics by many museums and fine art dealers that reflect a heightened awareness of the implications and problems connected with this illicit traffic. Illicit trafficking in cultural property is an international affair, and only international cooperation, particularly through the adoption of and adherence to international conventions, will allow a higher measure of control in this area. To curb illicit traffic in cultural property more countries must ratify the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, as well as the UNIDROIT Convention of 1995 and other relevant multilateral and bilateral agreements. However, unless these conventions are supported by adequate national legislation and a comprehensive programme for the protection and preservation of cultural heritage, international conventions can have only limited effect. Following the period of decolonization in the 1970s, UNESCO member states recognized that the lack of retrospective application of existing international instruments resulted in many ‘victim’ states that had no legal recourse to claim the return or restitution of illicitly appropriated cultural property.

Abstract:Movements have gained momentum within the restitution debate with the aim of taking cultural objects back to Africa. The discussions are vivid. For instance, the Savoy Report stated that Europe's museums keep an overwhelmingly large share of Africa's collections, leaving the countries of origin with almost nothing (Sarr and Savoy <a class="link link-ref link-reveal xref-bibr" href="">2018</a>). Indeed, most—if not all—large museums in Europe and North America bear African collections with colonial legacies. Either their specimens originated directly from former colonies or they were obtained in the context of questionable international procedures put in place at the time. As a consequence, the content, interpretation, and representation of indigenous cultural entities in museums are contentious issues of discussion (Ashley <a class="link link-ref link-reveal xref-bibr" href="">2009</a>). Undoubtedly, Africa has become a prime region for discussing colonial legacies. It is a debate about moral and power pressure (Shyllon <a class="link link-ref link-reveal xref-bibr" href="">2017</a>).

NAGPRA and Commodification of Cultural Property: A Legal Mechanism to Prevent Its Transfer to Europe and Return to the Native Nations

Abstract:The movement for restoration of Native American cultural property began with the enactment of the American Indian Religious Freedom Act 1978 followed by the Native American Graves Protection and Repatriation Act 1990 (NAGPRA). However, the federal legislation has been restricted because the desecrations of graves and funeral artifacts have continued to be appropriated and transferred from the reservations to their destinations in museums and auctions houses abroad. They have mostly ended up in Europe and are displayed against the will of the Native tribes from whose lands they have been moved. The domestic legal umbrella of NAGPRA does not provides protection when cultural property is resident abroad and the framework of ‘soft’ international law such as the United Nations Educational, Scientific and Cultural Organisation Convention (UNESCO) Convention and UNIDROIT Convention are not sufficient to facilitate their repatriation. The preventative extraterritorial legal regime has not been successful in transferring cultural property and there needs to be an improved mechanism devised to apprehend and to repatriate them to the original owners. This article argues for a framework that is international and which imposes sanctions when the iconographic property that is stolen is moved and is stored or sold for monetary gain and for its return to the rightful owners.

Abstract:The debate on the return and restitution of cultural property is by no means a new one. In recent years, however, the debate – stimulated by French President Emmanuel Macron’s speech in 2017 – extended to include the question of how to deal with collections from colonial contexts. Whereas international law provides a legal framework for how to deal with war-time looting (the 1954 Hague Convention) and the present-day trafficking in cultural property (the 1970 UNESCO Convention), no such legal regime exists for cultural objects removed during colonial times. Nevertheless, as this article illustrates – with a focus on recent examples in Germany – current developments indicate a movement towards new political and ethical schemes on how to deal with collections from colonial contexts and, in a broader sense, how to come to terms with the colonial past. In Germany, this includes the return of cultural objects and human remains to Namibia as well as the transfer of ownership of all Benin Bronzes held by German institutions to Nigeria.

Abstract:In the late nineteenth century, Western Powers launched military campaigns in sub-Saharan Africa resulting in the colonization of vast territories and the spoliation of cultural property. To justify the conquest, they asserted the supremacy of Western culture and disregarded principles of international law in their dealings with African states, communities, and individuals. This article examines colonialist legal justifications such as the denial of statehood of pre-colonial sub-Saharan African societies, the notion that conquest and spoliation were justifiable, and the belief that African legal systems lacked concepts of property. The article details why these arguments contradict well-established nineteenth-century legal principles, particularly state sovereignty and private property, which together form the conceptual basis for the prohibition of spoliation. The universal nature of those principles allows for the nondiscriminatory application and interpretation of historical law and consequently the protection of African pre-colonial states and private as well as public cultural property.

Abstract:Cultural relics are indispensable in preserving the unity and identity of nations due to their significant historical, literary, and artistic value. The challenge of recovering lost cultural relics has been a persistent issue not only for China but also for other civilizations with rich heritages. Despite the widespread attention this issue has garnered within the international community, the field of international economic law still lacks a definitive legal instrument that outlines clear measures for the repatriation of cultural objects. This absence of a legal framework has prevented international organizations from reaching a consensus on the conditions under which cultural artifacts should be returned. This paper focuses on the 1995 Rome Convention as the study object to apply comparative and normative research methods in examining the influences of nationalism and internationalism on the restitution of cultural relics. It analyzes the impacts of these two advocates on international law legislation and judiciary process. Based on this, the paper aims to offer recommendations on the stance that international law should adopt concerning the recovery of cultural heritage, thereby contributing to the development of a more coherent and effective legal framework in this domain.

Abstract:Many current disputes over cultural property resulted from war confiscations during the nineteenth-century international warfare. India demands the return of the Kohinoor diamond from the United Kingdom while China attempts to recover copper animal heads seized by the British and French armies. Do these states have legal rights under customary international law (CIL) to recover looted artifacts today when current conventions are not applied? Scholars often argue that such claims have no basis in CIL. However, this article questions their conclusions because they retroactively apply the current CIL-making approach to determine whether any CIL rules existed in the nineteenth century. Instead, this article uses the intertemporal law approach to first identify the contemporaneous CIL-making criteria in the seventeenth through twentieth centuries, and then apply these tests to trace the evolution of the CIL rules against wartime looting of cultural property. I argue that CIL has prohibited such practices and provided restitution as the primary remedy in circumstances of violations since the nineteenth century. This right to restitution has been established as a general rule that should be applied to all states rather than only Western “civilized nations.” Moreover, the passage of over 150 years since the time of removal will not inhibit claims for restitution, so long as the plundered artifacts still exist and are identifiable. This article provides an original interpretation of CIL-making in the law of war in respect of cultural property and convincingly paves the legal grounds for claiming historically looted cultural property today.

Abstract:Recent global interest in preserving cultural identity and heritage for the future of previously colonized Indigenous groups has prompted the resuscitation of local and Indigenous cultures from the brink of extinction. The pertinence of protecting and managing cultural heritage as an endowment that transcends generations of people and serves as a ligature between their past, present, and future cannot be overstated. In this respect, the repatriation or restitution of sacred ceremonial objects (SCOs) and cultural artifacts constitutes an integral aspect of reviving Indigenous people's cultural and living heritage, which has been eroded by colonialism and other forms of occupation. In Alberta, Canada, the First Nations Sacred Ceremonial Objects Repatriation Act is the foremost legislation that provides a formal mechanism for the return of SCOs to the First Nations. Thus far, it has successfully facilitated the repatriation of several hundred repatriated several SCOs. In contrast, South Africa's primary heritage legislation, the National Heritage Resources Act, lacks direction and detail on the restitution of SCOs, specifically to cultural communities. With the aid of a comparative approach, this article critically examines one successful approach to the repatriation of specific sets of heritage objects in Canada and analyzes South Africa's legal frameworks that consider SCOs as a component of its national estate within its framework for restitution and the promotion of cultural revival in cultural communities.

Abstract:Restitution of cultural property by the People’s Republic of China on the example of the recovery of the brown heads of animals from Yuanming Yuan Restitution of cultural goods is a very complicated issue in practice, encountering many problems on its way. Most international conventions, including the 1970 UNESCO Convention and the 1995 UNIDROIT Convention, provide for non-retroactivity of their provisions and a limited time to bring claims for reimbursement. Another problem is the still low number of ratifications of both conventions, especially the one from 1995. Also, the national legislation of many countries still does not contain regulations in this area and appropriate restitution instruments. Once the Chinese government realized the value of its cultural heritage treasures as a source of national and political identity, it began the process of restoring looted cultural assets. This is not an easy task, because a large part of the objects was stolen a long time ago, which directly prevents the application of international legal regimes resulting from conventions on the return of stolen or illegally exported goods. The case of bronze statues from the Yuanming Yuan shows another way to recover looted cultural goods. It is based primarily on the national identity of Chinese society, which treats looted artifacts as an important element of their history and culture. Thanks to private collectors and entrepreneurs who had bought such objects and then donated them to Chinese museums and institutions, it was possible to regain many of the lost cultural goods. The aim of article is to provide a general overview of the People’s Republic of China’s restitution policy, its methods and effects, using the example of the recovery of Chinese bronze heads stolen from Yuanming Yuan.

Abstract:In the mid-1700s, the relationship between the British Empire and Imperial China began to collapse over a series of cultural, economic, and ethical conflicts which would result in the First (1839-1842) and Second (1856–1860) Opium Wars—tumultuous events that would have a devastating and humiliating impact on Chinese history. The looting of the Yuanmingyuan Summer Palaces during the Second Opium War was a tragedy that would be as destructive to Chinese culture as the wars’ resulting treaties were to its territorial borders. Today, the Chinese continue to dispute the morality of both the wars and the subsequent looting of their Summer Palaces. It is thus unsurprising, then, that modern China has undertaken great effort to recover the artifacts from the Summer Palaces. While some of these attempts have been largely unsuccessful, it is clear that China will continue to pursue repatriation of lost relics. This struggle provides an excellent opportunity for examining both China's modern approach to cultural heritage preservation and the potential problems existing in international laws hindering the protection of cultural resources throughout the world.

Abstract:African art though dynamic has changed in form, function, and meaning over time. However, the concept of Indigenous African art has remained static. This paper aims at examining the complex relationship between African art and colonial encounter while interrogating the commodification and restitution of African artifacts which has become a topical issue. This is because pre-colonial sacred objects have an aura of untainted timeless past reflecting the way of life of the African people. The colonial encounter with Africa witnessed a rush for African traditional religious artifacts and antiquities which left indelible marks of hostilities and cultural clashes among the African people. Many African artifacts looted from their countries of origin during colonialism and are now housed in museums and private collections around the world. While most studies on Linus Asong’s the Crown of Thorns focus on feminist analysis, the paper is read from the perspective of New Historicists’ exegesis that interrogates the commodification and restitution of African sacred objects stolen from Africa during colonialism. The findings show that, although the issue of the commodification and restitution of African artifacts is a complex and controversial one, there is a growing recognition of the importance of acknowledging and rectifying the historical injustices associated with their commodification.
The Swinging Pendulum of Cultural Heritage Crimes in International Criminal Law

Abstract:Contemporary prosecutions in international criminal tribunals have exposed a long-standing debate over the role of cultural heritage-based crimes in international criminal law. This chapter presents an historical analysis that reveals that the pendulum has swung back and forth with regard to support for including offenses that expressly refer to the destruction or seizure of artistic, historic, and scientific property and of ‘historic monuments’. While cultural heritage destruction was proposed as an offense after the First World War, a pervasive reluctance to include it largely prevailed from the postwar Nuremberg trials until the late 1980s. This chapter attributes this reluctance in part to coinciding developments in cultural property protection that were occurring outside international criminal law, such as the 1954 Hague Convention and the early drafts of the 1948 Genocide Convention. Before the end of the century, though, the pendulum swung back in favor of including the deliberate and unnecessary destruction of certain cultural heritage as a discrete and separate war crime. Both ad hoc international criminal codes and the Rome Statute of the International Criminal Court reflect lasting recognition of the role that cultural heritage destruction can play in the larger narrative of oppressing, persecuting, and even eradicating targeted collective groups.

Abstract:Since the discovery of the first rolls of parchment in 1947, the Dead Sea Scrolls have been the subject of various disputes not only of a theological and archaeological nature, but also of a cultural, political, and legal one. Currently held by Israel for the most part, these manuscripts are now at the heart of competing claims insofar as both Israel, Jordan and the Palestinian Authority claim ownership. In 2009, the exhibition of the manuscripts at the Royal Ontario Museum (Canada) was an opportunity to relaunch this decade-long and thorny debate, but failed to find a satisfactory solution. In this perspective, the present article aims at exploring the numerous legal issues raised by the question of the ownership of the Dead Sea Scrolls, more specifically with regard to the norms of international law. It also aims at highlighting how cultural heritage has become a highly political stake due to the involvement of States in their protection, and at exploring the role Canadian diplomacy and extra-judicial mechanisms could play in resolving complex restitution claims.
The promises of the bureaucratisation of intangible cultural heritage safeguarding in post-conflict regions: lessons from anthropological fieldwork in four Western Balkan states

Abstract:Anthropology and critical heritage studies share a rather negative view of the role of bureaucracy in heritage management as utilised by the international community in post-conflict regions. However, fieldwork findings among ethnologists working as expert bureaucrats in four Western Balkan states (Serbia, Croatia, Montenegro, Bosnia and Herzegovina) suggest that the ongoing process of the 'bureaucratisation' of collective identities, based on UNESCO principles, holds more promise for successful conflict management than relying solely on day-to-day politics or a purely academic critique. The safeguarding of intangible cultural heritage has emerged as a powerful tool for redirecting identity-based conflicts towards abstract concepts such as 'elements', 'lists', and 'registers'. These abstractions are less susceptible to suffering than real individuals. Consequently, this approach offers a greater chance of success in mitigating conflicts. Anthropology's most significant contribution to the global implementation of the heritage-for-peace paradigm could be to reconcile with ethnology, despite any disciplinary incongruity that may arise.

Abstract:How is it possible in this moment of museum decolonization, critical examination of museum ethics and practice, calls for repatriations and reparations, and restorative justice, that a brand new museum is embroiled in controversy over the acquisition, study, and display of archaeological artifacts? Museum aversion to addressing complex issues of provenance, documentation, fakes, and archaeological site destruction caused by looting results in distorted displays and inaccurate interpretations of the material record and injustice and bias in the contact zone (sensu Bennett, Boast, Clifford, and Pratt). The exhibition of archaeological artifacts from the 'Holy Land', specifically the Dead Sea Scrolls on display at the Museum of the Bible, offers a compelling case study. The Dead Sea Scrolls as contact zone (writ small) allow for the consideration of curatorial decision-making, visitor engagement, honesty, untold stories, and the potential for redemption at the Museum of the Bible.

Abstract:Historical memory in the form of public art acts as a pedagogical tool, both revealing the artist’s interpretation of history and serving as a historical device for the viewer. In Cambodia, new generations are developing an understanding of the Khmer Rouge regime (1975–1979) and its effect on their country’s history. Young peoples’ understanding of history is constructed through institutional, living, and public memory pedagogies. These pedagogical channels do not always work in unison, leaving gaps in historical education. In Cambodia, institutional and living memory pedagogies on the Khmer Rouge genocide often fail to transmit this important national history to those who did not live through it. Publicly accessible memorial art has the potential to supplement the historical understanding of young, rural Cambodians. Three murals sites in rural Cambodia act as landscapes of public pedagogy by depicting scenes of Khmer Rouge atrocities. This paper aims to understand the significance of the impact and implications of public memorial art as an educational supplement, and how public art can be utilized as public pedagogy in Cambodia and beyond.

Abstract:With the rapid development of the economy, people’s awareness of the protection of cultural relics gradually increased. As a result, the issue of recursive overseas cultural relics is worthy of our attention. The urgency of recapturing overseas cultural relics has been greatly increased in order to avert the onset of a new era of cultural relics crisis. Faced with the difficulties of recourse, a low success rate, complicated recourse processes, and an immature international situation, what type of effort should we make? The overseas loss of cultural relics as the subject of study, a brief analysis of its research value, and the state of our recourse process, in the process of the challenges faced, and put forward the appropriate measures to address the situation are all covered in this paper. Furthermore, the subject of international private law is discussed.
