Abstract:The Constitution, as a formal legal document, reflects a commitment to secure to all citizens, Equality, Justice, and Liberty, as a non-negotiable duty of the State. The nature and context of present society, however, is embedded in its socio-cultural development through civilisations. This study aims to engage with such a manifestation of state power as revealed in the text Manavdharmashastra, that marked the origin of codified social laws to derive legitimacy and establish a ‘divine’ authority to rule. Subsequently, the pioneers to critique the dysfunctions of Manu’s social laws became a subject of interrogation by social reformers like Jyotirao Phule and Dr. Bhimrao Ambedkar. Methodologically, our effort will be to weave together an intertextual analysis based on scientific observation of the case of caste subaltern, through three widely acknowledged texts—Manusmriti, Phule’s Slavery (Gulamgiri), and Ambedkar’s Annihilation of Caste, on ideals of society and governance, in order to present a historical legacy into the origins of social hierarchy as an institutional mechanism to perpetuate inequality among subjects. The aim is to develop an approach to evaluate the ancient political thought of Manusmriti, and probe contradictions and realism in actions, with explicit excerpts of relevant texts, to authenticate the credibility of facts and its alignment with the central thought. The article eventually attempts to suggest alternatives to secure the vision of an ideal Indian society that aims to disintegrate the institution of caste.

Abstract:admirable that they don’t use the book’s pages as a teleological promotion of PB as the answer to society’s problems. In fact, the authors make a significant and transparent effort to hold themselves at arm’s length from their object of analysis. Participation is not necessarily evidence of democracy. What matters for democracy is what happens after the participation has occurred. It is fundamentally a pragmatist challenge to the literature (and one can sense the presence of John Dewey and others behind the writing): What appreciable difference does participation make in the lives (and actions) of participants, or of anyone else, for that matter? In some cases, the authors tell us, the answer is ‘‘not very much.’’ So, for those who care about democracy, there is still significant work to be done in research and in practice. This leads me to a minor disappointment with the book. In short, I wanted more details on how to connect participation to governance. What should we do? What should we be on the lookout for? How can we do it? This is a compliment, as I found myself convinced in the writing that the authors really know their stuff. Who better to muse on this (and at least spend a page or two more than they allotted in the conclusion) envisioning a real utopia or two? Perhaps this will be their next project. I certainly hope so. This is a unique and important piece of scholarship. The book certainly left me feeling invigorated and motivated to think differently about my own work on deliberation and democracy. I plan to use this book in my courses on Political Sociology and Democracy at the undergraduate level, and I will ask all of my graduate students working in this area to read it. It will become a ‘‘must-read’’ in the field. I imagine the book will be of interest to sociologists, political scientists, and communication scholars, as well as anyone who wants to understand how democracy works. Abstract:This article endeavours critically to analyse and evaluate the life experiences of Dr. B.R. Ambedkar in his autobiography, Waiting for a Visa. A literary autobiography is truly a full and actual portrayal of the truthful incidents, pains, pleasures, actions, achievements, successes and failures of a protagonist's life. It is genuinely a life story of a great person authored by himself or herself. Ambedkar's autobiography entitled Waiting for a Visa presents justifiably a true story of the experiences, observations, sufferings and struggles of the character hero’s life and gives authentically a deep insight into the inner-outer personality and public life of Ambedkar and his contemporaries. Apart from introducing a detailed description of his life the autobiographer, Ambedkar, reveals actually an abridged account of his life- experiences and observations that are much more significant and relevant to the modern world than merely introducing dates and events of his life. Ambedkar is popularly known as the father of Indian constitution and is immensely honored as one of the most intellectual personalities ever born in Indian society. This study evaluates objectively that Ambedkar's autobiography, Waiting for a Visa contains continuously historical, cultural and intellectual significance in the moral evolution of several communities of Indian life. It reveals dispassionately the literary relevance of the major issues that the autobiographer raised fearlessly through his bitters experiences of evil practice of untouchability in Indian national life. The narrated conflict in the autobiography is wholly a literary device that stands for a struggle between the two conflicting forces. One represents moral language, conduct and dignity while the other represents immoral language, conduct and evil practice of untouchability. The conflict plays a vital role of struggle that creates crucial hardships in this life story of Ambedkar and is used to move the autobiography forward. In Waiting for a Visa Ambedkar tirelessly struggles for his education, water, food, shelter and safety. It is exceptionally appreciable and inspirational. With the help of moral and humanitarian values like meekness, kindness, courage and patience Ambedkar endeavors powerfully to overcome the immoral thinking, attitude of the Hundus who were responsible for this injustice. He fought bravely against conservative tradition, custom, false belief, superstitions, social discrimination and immoral people who made Dalit people deprived of their basic and existential rights and due dignity on the ground of the hierarchical system in Indian national life. He uses technically the first person pronoun such as I, me, my, we, us, our.

Abstract:In our investigation into the persistence of caste, we attempt to build a preliminary framework of analysis to set the stage for a reading of Ambedkar’s posthumously published, unfinished manuscript, Buddha or Karl Marx. We see an uncanny resemblance between Ambedkar’s mid-twentieth century context in the newly independent democratic society of post-colonial India and that of French philosopher Maurice Merleau-Ponty’s post-Second World War Western European context and his intriguing attempt to justify communist violence. Ultimately, we argue that although one cannot use one context to understand the other on how to realise a communist revolution within a democratic, industrial capitalist society, there are lessons to be learned from both with regard to problems in the philosophy of history, historical time, and epochal shifts. The ultimate question is whether a new society that has no precedent in either the West or the East and everything in between is imaginable. Ultimately this article sets up the possibility to read Ambedkar’s text while returning to Marx’s (1990) Capital Vol. 1 itself, particularly on the ‘primitive accumulation’. Then we can be in a position to philosophise in the margins and beyond where Ambedkar leaves off on his brief but brilliant essay, Buddha or Karl Marx.

Abstract:It is commonly believed that, given its tradition of the sovereignty of parliament, there is no constitutional review in Great Britain. However, according to the author, if constitutional review is considered as a means to minimize the effects of the implementation of “bad law” passed by parliament, Britain has formed its own de facto constitutional review. Such review includes covert resistance against parliamentary legislation by the court disguised under the common law, the right of judicial review of the court granted by parliamentary legislation, and constitutional review that is constitutionalized by re-interpreting the unwritten constitutions. The British experience contains special lessons for China in building up its constitutional review under the People's Congress system.

Abstract:Dr. B.R. Ambedkar is a great thinker, academician, philosopher, lawyer, and renowned intellectual who took up leadership for the upliftment of the depressed, underprivileged and marginalized classes in society, securing human rights through various movements in social, educational, economic, and political realms. Dr. Ambedkar’s comprehensive efforts spanned social, economic, political, educational, intellectual, women’s rights, religious, and labor movements, highlighting his dedication to addressing the challenges faced by these communities. It also underscores his role as a scholar, activist, and architect of the Indian Constitution, emphasizing his principles of liberty, equality, fraternity, and social justice. Furthermore, it discusses the root cause of inequalities in India as caste-based, with Dr. Ambedkar identifying Brahmanism and Capitalism as enemies of humanity. His significant contributions to economic thought, including land reforms, industrialization, and the role of the state in economic planning and development, are highlighted. Additionally, the paper emphasizes his emphasis on the importance of education in empowering marginalized communities and his efforts to secure equal status for women in Indian society. Furthermore, it outlines his legal activism, proposals for legal reforms, and his memorandum to the Constituent Assembly, which aimed at establishing social democracy and state socialism. His unwavering commitment to advocating for the rights of Dalits and other marginalized communities through legal means is also highlighted, along with his struggle for separate electorate and the Hindu Code Bill for the protection and development of Hindu women. The paper concludes with a call for further research into the economic conditions of these communities, their political ideologies, and the governmental and organizational efforts to enhance their self-employment opportunities and overall progress. Abstract:Chapter 2 recounts the developments around adjudication of fundamental rights and directive principles that climaxed with the inclusion of Article 21A in the constitutional text. By examining the historical background of the Eighty-Ninth Constitutional Amendment, the chapter then tries to find some answers concerning its doctrinal and practical significance.Surprisingly, the chapter concludes, there was very little of a ‘vision’ of what the purpose of Article 21A would be. Still, the fundamental right to elementary education is now part of the constitutional text, and the fact that there is one explicitly justiciable socio-economic right might have a significance that goes beyond mere symbolism. Whatever the motivation for including Article 21A in the constitutional text may have been (even if the intention was only to symbolically declare that the State takes the matter of elementary education seriously, or to appease groups calling for State action), the provision is now part of the constitutional text, and the judiciary is called upon to adjudicate on it when it is approached.

Abstract:In this article, I engage with Manav Ratti’s book The Postsecular Imagination: Postcolonialism, Religion, and Literature (2013) through three frameworks. First, I consider the book within two historical phases, 1989–2014 and post-2014. I argue that reading Ratti’s book through the latter phase has implications for the problem of enchantment in populism. Second, although postsecularism is the central concept in his book, I draw attention to how Ratti, subtly, provides a capacious and emancipatory conception of secularism itself that is particularly productive for the post-2014 phase we inhabit. Third, I turn to Dalit literature as a site where rationalism is evoked in a way that is not reductive and bureaucratic in the Weberian sense. Might Ambedkar-inspired Dalit texts help us rethink rationality more capaciously?
