Abstract:Multilateral investment guarantee agency offers long-term political risk insurance to eligible investors for qualified investments in developing members countries. Beyond insurance protection, MIGA’s participation in a project enhances confidence that the investor’s rights will be respected due to the voluntary association of developing and developed countries in the Agency. Since commencing operations in late 1989 through December 1993 MIGA has issued approximately US$978.8 million in guarantees of direct investments into developing member countries. One very important aspect associated with MIG’s developmental needs of the host country guarantee program is the necessity for investment projects to conform with that.

Implicit Government Guarantee and Corporate Investment: Evidence from China’s Belt and Road Initiative

Abstract:Implicit government guarantee results in financing convenience and distorting corporate investment. The effects on MCB's credit spread and corporate investment are studied in this paper based on China's bond market from 2010 to 2020. The implicit government guarantee lies in MCBs whose financing costs are significantly lower than those of POEs. The inefficiency of corporate investment also exists in MCBs with investment reductions. But this inefficiency has been corrected by China's recent major national strategy, the Belt and Road Initiative. We provide direct evidence from three perspectives, provinces along BRI routes, city-level features of China-Europe Railway Express and bond-level funding purposes. This paper reveals that implicit government guarantee could only reduce the funding cost, while major national strategy is helpful to promote corporate investment.

Abstract:Purpose The purpose of this paper is to investigate the compliance of foreign investment projects with local environmental standards in Ethiopia. It examines the cause and impact of the environmental problems created by such projects as well as the necessary policy response, especially by examining the role of the applicable bilateral investment treaties (BITs) in enforcing local standards. Design/methodology/approach The research approach is fundamentally an empirical study with some doctrinal analysis. The empirical data (qualitative) was collected through interviews, focus group discussions and observation tools. Findings The investment projects selected for the case studies were not complying with the local environmental standards, which resulted in several environmental problems. The major cause for the overall environmental problems was not a legal gap in the local standards, but the failure of enforcing such standards by the government bodies and foreign investors. The applicable BITs also played no role in environmental protection as they do not impose environmental obligations along with enforcement mechanisms. Non-compliance with local standards can be mitigated if the applicable BITs impose environmental obligations along with workable enforcement mechanisms – as a treaty obligation has more binding force. The author argues that, in general, foreign investments are not environmental-friendly unless otherwise strictly regulated by combining local environmental standards and a BIT that imposes environmental obligations (along with enforcement mechanisms) on the foreign investors, host state and home state. Originality/value The existing literature does not deal with the environmental problems, the enforcement constraints and the role of the applicable BITs together in a single publication. They separately address these issues, which do not give a comprehensive understanding of the cause-and-effect relationship. This paper fills this gap by presenting comprehensive findings that combine the environmental problems and the associated enforcement constraints as well as the role of the applicable BITs in this regard. It also contributes to the ongoing debate concerning whether foreign direct investment is good or bad for the environment by producing empirical evidence from Ethiopia, the African continent.

Observing the development of MIGA in the last few years,it presents a new feature which is the expanding interpretation of the word for"expropriation". Even if the host country did not issue the expropriation act expressly,however,it has taken some imposed measures that have the same effect with expropriation will also be considered to be implemented for expropriation. This passage analyses "expropriation"in the practice of international investment uses the expanding interpretation of treaty and customary principles of international law and put forward own ideas on the basis of investment cases.

Abstract:This research explores the interplay between innovation, economic systems, governance structures, and law, and how they interact with one another in the context of China and Ethiopia’s investments in the Digital Silk Road. The way cutting-edge methods related to governance and economic systems might help lower the risks involved in major infrastructure projects, like the Digital Silk Road, particularly in light of law and 5G developments, is investigated. China–Africa connections are to be strengthened, sustainable development is to be encouraged, and healthy economic progress is the goal of the partnership between Ethiopia and the Hainan Free Trade Port. The impact of these transnational investments on fair growth and sustainable development is assessed, while exploring the evolving agendas and procedures governing investments. This research draws attention to how the law and legal cooperation between Ethiopia and China may promote mutually advantageous outcomes, promote transparency and governance mechanisms, and lessen the likelihood of disputes. This research on the factors influencing the future of the Digital Silk Road and its consequences for long-term, sustainable economic growth, and business in the area, aims to provide valuable insights for policymakers, development professionals, and academics, and for the copromotion of China and Ethiopia in terms of digital investment. This research relates to the promotion of the African Continental Free Trade Area (AfCFTA), in terms of construction and economic development. It also examines how the DSR raises concerns about data security and privacy, cross-border transactions, technology transfer, and cyberterrorism, as well as encourages digital investment, such as through enhancing digital governance regulations, modernizing international investment agreements (IIAs), and bolstering global health, coordination, and cooperation; the article concludes by analyzing the implications for Africa. The findings show that such cooperation would support Africa’s digital transformation and sustainable development, while strengthening China–Africa cooperation.

Abstract:Over the past few decades, a few thousand international investment agreements have been concluded. One cornerstone of those treaties has been a straightforward model of foreign investment: an investor based in a home State that has made an investment located in the territory of a host State. Under that model, treaty protections operate reciprocally, protecting the investments of each treaty party’s nationals made in the territory of another treaty party.The foreign investment model on which investment treaties have been based — and which, in turn, supports the reciprocal structure of the treaties — often does not capture current economic reality. Foreign investments by multinational enterprises today routinely involve multiple jurisdictions in which inputs are traded (as part of international production networks known as global or regional value chains) and through which capital is channeled (as transit investment).The reliance by multinational enterprises on international production networks and transit investment has challenged the reciprocal foundation of investment treaties. This article responds to that risk by developing strategies for policymakers and decision-makers to preserve the reciprocal foundation of investment treaties in a 21st century global economy.

Abstract:Industrial policy is back on the African policy agenda, with a number of countries following new strategies for rapid industrialization. None have done so more eagerly than Ethiopia. The present paper draws on Justin Yifu Lin's framework of New Structural Economics to assess Ethiopia's industrial policies and engagement in the leather industry. Making use of two rounds of semi-structured interviews (2012 and 2015) with all of the foreign firms and more than a dozen local firms in the leather sector, as well as other key stakeholders, it examines seven steps the government took to build the industrial policy: Create a high-level focus on the sector; make strategic use of international development partners; attract a “lead goose” (Chinese) in the footwear sector; build government capacity to support the sector; strengthen business associations; “shock-to-shape” upgrading; improve input supply. Ultimately, while government interventions have led to improvements across several steps of the value chain, the paper identifies a number of factors that have prevented the country from fully realizing a latent comparative advantage in the leather sector.

Abstract:In this "GCC States' Land Investments Abroad: The Case of Ethiopia" CIRS Summary Report, Benjamin Shepherd uses data generated from fieldwork in Ethiopia to evaluate the country as a potential long-term source of agricultural staples for Gulf Cooperation Council (GCC) member states as part of their national food security strategies. Part of the larger CIRS research initiative on "Food Security and Food Sovereignty in the Middle East," the report identifies the risks and well as the opportunities of investing in the agricultural sector of Ethiopia. There are sound opportunities for GCC countries to use investment in developing country agriculture as part of their long-term food security policy mix, as long as those investments are approached in a careful, constructive, and regulated way. To this end, some recommendations are made in this report for further research and for GCC state policymakers to re-think national food security policies.

REFLECTIONS ON CHINA-AFRICA BITS By Won Kidane ([dagger]) BACKGROUND The rise in the last decade of Chinese investment in Africa (1) continues to be a subject of curiosity. (2) Traditionally, the bulk of foreign investment flew North-South but rarely SouthSouth. (3) This is changing as China becomes an important player as a sender of foreign direct investment (FDI). In the 21st century, international investment agreements (IIAs), particularly bilateral investment treaties (BITs), have become the principal means of protection of foreign investment. (4) These investment treaties themselves lie along a spectrum representing the balance of power of their own era. Much like U.S. BITs, China's BITs are said to have gone through at least three generational modifications. (5) China has employed all three generations to protect its investment in Africa. Do China's BITs tell a story of a nation's rapid transformation from a recipient of FDI to a sender of FDI? Or do they paint a more complicated picture? China's approach to investment in Africa appears to be different from the approaches that Africa's traditional partners from Europe and North America have taken over the years. A 2010 UNCTAD report describes such difference in the following terms: [I]n contrast to Africa's relationship with traditional partners, the new partnerships ... often have established forums and dialogue platforms and are generally supported by frequent high-level official visits. Furthermore, they are based on the principle of noninterference in the internal affairs of partner countries. Consequently, they are not associated with policy conditionality as has been the case in relations with traditional partners. (6) The report states further that "[the] big Southern partners [mainly China] generally use official flows to promote trade and investment activities in Africa. Furthermore, Southern partners do not consider their financial contributions to other developing countries as aid. Rather they describe them as 'expressions of solidarity and cooperation borne out of shared experiences and sympathies.'" (7) Although the role of China's involvement in Africa remains a subject of great controversy and heated debate, (8) it is clear that Africa's recent and unprecedented growth is not entirely unrelated to Chinese investment and trade. (9) Be that as it may, China's economic interest in Africa is not all that different from Africa's traditional partners. Its means of pursuing the economic goals are also similar--although as Ambassador David Shinn puts it--China employs different tactics that might make it more acceptable to Africa. In his own words: [T]he United States and China use essentially the same political economic, military and cultural tools for implementing their relations with Africa. The emphasis the two sides place on these tactics, however, and the way they implement policy varies considerably. China presents itself more humbly in its interaction with Africa. Having served as the leader of the Western world since the end of the Second World War and the only superpower since the end of the Cold War, the United States often comes across in Africa as insensitive ... Abstract:This article aims to conduct a more in-depth study of Indonesia's challenges and opportunities after the ratification of the 2020 Indonesia-Australia Comprehensive Economic Partnership Agreement, hereinafter referred to as IA-CEPA. IA-CEPA offers opportunities for investment, trade in goods and services, and human resource capacity building for both countries. The Indonesian government needs to accelerate the harmonization of national laws related to the substance of IA-CEPA so that no legal conflicts harm Indonesia's national and economic interests. This research applied normative or doctrinal research methods, collecting legal materials with literature studies, which were then analysed with descriptive analysis techniques to find solutions to the problems raised. The results show that IA-CEPA brings great opportunities for economic growth in both countries. With greater access to each other's markets and cuts in trade tariffs, this agreement can stimulate greater trade and investment. IA-CEPA provides incentives for both countries to diversify their investment sources. This can help reduce dependence on one particular country or region and increase economic resilience.

Abstract:Significance The announcement provoked panic among some bondholders but their concerns appear unfounded given Ethiopia's overall debt sustainability and the government's ability to engage with Chinese lenders on favourable terms. Impacts Other African governments will follow Ethiopia's progress before requesting debt restructuring. Ratings agencies may need to tweak their methodologies to account for such relief, lest they needlessly downgrade proactive sovereigns. Pressure on Chinese lenders may rekindle Beijing's calls for the IMF to issue new Special Drawing Rights to boost international liquidity.
Chinese Manufacturing Investments and Knowledge Transfer: A Report from Ethiopia

Abstract:This study aims to shed light on the knowledge transfer effects of Chinese investment in Africa’s manufacturing sector with a concrete case study of Ethiopia. As of January 2015, 117 firms were registered with the Chinese Ministry of Commerce (MOFCOM) as investing in Ethiopia, reporting to have manufacturing activities. Since 2010 the Ethiopian government has put great emphasis on boosting the manufacturing sector and developing local technological and marketing capabilities, consciously guiding FDI from China and other Asian countries to the manufacturing sector. Such efforts offer a remarkable case to explore how African agents play an active role in shaping the dynamics and outcomes of engagements with China, which thus far has been seriously under-investigated. This study finds that the effectiveness of knowledge transfer by foreign investors is largely decided by industrial conditions in the host country and forming manufacturing clusters is a helpful approach to improve learning. This paper examines knowledge transfer mechanisms between Chinese investments and Ethiopian firms, institutions, and individuals at four different levels in the manufacturing sector. The lessons learned from this case may provide insights into China-African cooperation and Africa’s development process in general.

Abstract:Africa has achieved the fastest growth rate of inward foreign direct investment (FDI) recently. Yet heightened political hazards present substantial challenges to foreign firms in Africa. This study examines the entry strategies that firms may take to mitigate such hazards by exploring the relationship between political hazards and entry mode choices in Africa. We further consider how an investing firm's host country experience and foreign aid provided by its home country government to host countries in Africa can influence this relationship. In a sample of listed Chinese firms' investments in Africa from 2000 to 2014, we find that Chinese firms tend to use the joint venture mode when political hazards are high in an African country. This relationship is weakened when they accumulate host country experience and when the Chinese government's foreign aid to an African country increases. Our findings point to firm-level strategies to mitigate political hazards as well as instruments available to home country governments to help their multinational firms operating in host countries characterized by unstable political environments.

Abstract:The FDRE Criminal Justice Policy embodies multiple reforms that are meant to address the various problems in the Ethiopian criminal justice system. The reforms include the introduction of plea bargaining which represents an unprecedented and ambitious development in the realm of the criminal justice system in Ethiopia. This article examines plea bargaining as envisaged in the FDRE Criminal Justice Policy and the Draft Criminal Procedure Code, from a principle based approach and argues that it hardly lives up to many of the fundamental principles of criminal law and procedure recognised under Ethiopian law. The most affected principles/rights include: the principle of presumption of innocence, the principle of equality, the principle of equality of arms, the principle of truth discovery, the privilege against self-incrimination and the right to silence, and the right to appeal. Abstract:The Ethiopian Constitution divides the power to enact private laws between the federal government and the states. This entails certain inexorable private international law disputes which are concomitant of state private laws. The federal arrangement confers upon the states an inherent jurisdiction to wield disputes connected with their private laws. Nevertheless, the Federal Courts Proclamation and a precedent set by the Federal Supreme Court's Cassation Division render the Federal High Court the wielder of an inherent jurisdiction over disputes connected with state laws. Superciliously, the federal government has aggrandised its jurisdiction by extending it to disputes connected with state private laws. This paper addresses the question whether the power of the states to enact private laws subsumes a jurisdiction to wield private international law disputes. To this end, it analyses the relevant provisions of the Constitution, statutes and a case law. It also draws on the experiences of other federations. The paper will argue that the Constitution confers upon the states an inherent jurisdiction to wield disputes connected with their private laws. It concludes that the states should have their own private international law rules and courts designated to adjudicate private international law disputes.

Abstract:The purpose of this study is to ascertain the relationship between investment law and state sovereignty, and then to construct national investment law politics in the future in order to advance economic development and retain independence. This research is normative by taking a statutory approach and a conceptual approach. The study's findings indicate that investment is critical for economic growth and job creation. Governments throughout the world are aggressively competing to improve the business climate and so encourage investment activities, but this competition should be controlled and emphasize domestic capital, as it signals to Indonesian state leaders that investment is a priority. While the contribution of foreign funds or foreign aid is not denied in developing Indonesia's declining economy, it must first rely on domestic capabilities as a source of development funds to ensure that the existence of foreign sources of funds does not result in dependence on foreign parties and that foreign heads of funds are used for the benefit of the people's economy.KeywordsPolicy;Economic Law;Welfare;
Does the government credit guarantee promote micro, small, and medium enterprises? Evidence from Indonesia

Abstract:To address the well-known credit rationing problem for the micro, small, and medium enterprises (MSMEs), this article studies the effects of government credit guarantees (GCGs) on the growth of MSMEs in Indonesia. This article utilizes the latest MSMEs survey data over the period 2010–2013 reported by the Indonesian Central Bureau of Statistics and applies the panel fixed effect regression model at both the industry aggregate and enterprise levels. The regression results reveal that GCGs are positively associated with the growth of MSMEs at the industry aggregate level, and such influence becomes stronger in the year following the loan receiving year. Among the different types of enterprises, GCGs are found to be positively and significantly associated with the value addition of the small and medium enterprises in comparison to the micro enterprises that have shown no relationship between GCGs and enterprise value added. Also, GCGs tend to provide significant benefits to the industries that have a higher dependency on external finance, and to the small enterprises, in particular. This article suggests that the GCGs can be considered as an alternative to collateral to unlock the desired level of finance to the small and medium enterprises. Also, it can be a powerful policy instrument to address the credit rationing and underinvestment problem recognized by Stiglitz and Weiss and Myers and Majluf in emerging economies.

Abstract:Among the factors which could explain the failure and success stories of market integration through the WTO law, issues related to democracy ar the most important as they determine the legitimacy or otherwise of such integration process. This work examines questions of democratic legitimacy in WTO accession with a focus on Ethiopia’s accession process. Many are anticipating that Ethiopia will join the WTO in the near future due to the lowered accession standards under the revised accession guidelines issued in 2012. However, the government has not yet shown willingness to give up control over state-owned services. This work investigates the democratic legitimacy of this accession process. Thus, it answers this question: How far the elements of democratic legitimacy are observed in Ethiopia’s accession process to the WTO? Procedural and substantive elements of democracy are employed in analyzing legitimacy of governance at national and multinational level.
