Abstract:In recent years, food safety events occurred frequently, which caused consumers to show a lower level confidence in safety of food. Food safety information disclosure system is one of the important part of food safety supervision system, which is an important link in food safety regulation, and is helpful to transparency and publication of food safety information. The purpose is to improve food security and establish the correct view of consumption. This paper analyzed the main problems and difficulties of disclosing information in China and revealed the difference between China and USA. Meanwhile, it analyzed the subject, content, mode, platform, laws and regulations of food safety information disclosure system of USA. The comparison revealed difference of food safety information disclosure between China and America. Then some suggestions to improve China’s food safety information disclosure system were explained in order to provide certain theoretical reference for improving food safety information disclosure mechanism.

Abstract:During the last 10-15 years the question about food safety has increasingly been a topic of great concern nationally and internationally. Traditionally there has been a conflict of interest between the developed countries with higher food safety standards and the developing countries with lower food safety rules. As long as adequate international rules persist the view of standards as barriers should be replaced by the view of standards as catalysts for increased food quality. This article looks at the food safety issue in China, the largest developing country. The Chinese exports of food products have been confronted with trade restrictions because the products did not comply with the high food standards in the USA, the EU and Japan. These difficulties have contributed to a greater concern in China about the quality of the food products. In the last ten years a series of changes in the rules and in the administration have taken place. It is a complicated task because it touches the whole food chain. The article tries to cast light on these important questions. What have been the consequences of inadequate food safety regulations in China? What have been done until now to improve the food quality standards in China? What further initiatives should be taken to improve the situation in the future?
Food Safety Regulatory Enforcement in China: A Data-Driven Approach

Abstract:Government regulations have a substantial impact on food safety, both within China and elsewhere in the world. But regulatory research is hampered by a lack of systematic data. Much of the extant regulatory research is based on interpretations of government policy and regulatory announcements. At best, qualitative analysis indicates policy and regulatory intent, not enforcement, and it lacks precision and specificity. Using natural language processing (NLP), this study creates quantitative indicators of food regulatory enforcement by the Chinese government based on the conversion of 28,000 free-form criminal-court case texts. We focus on two main Chinese regulatory agencies, the China Food and Drug Administration (CFDA) and the Ministry of Agriculture (MOA). Our quantitative analysis reveals substantial differences in the regulatory functions of these two agencies. The CFDA has been far more proactive than the MOA in uncovering food-safety problems — a function we call a “lead function” — whereas the MOA has been mainly involved in providing evidence and data — a function we call a “supporting function.” To our knowledge, this article is the first to quantitatively map the Chinese government’s regulatory functions in the food industry at such a granular level. The policy implications of our findings are drawn from two contextual factors. First, a large number of China’s food-safety problems occur in the upstream sector — the sector over which the MOA exercises regulatory authority. Second, the Chinese government’s regulatory regime has mainly focused on the CFDA rather than the MOA. These findings suggest a pressing need for the MOA to undertake more lead functions.

Setting up effective legal liability investigation mechanisms for food safety government supervision has an important significance to solving food safety problem.In China's existing laws,there are series of regulations on the legal liability for food safety government supervision,and they can provide a legal basis for the legal liability investigation.However,there are some problems in the legal liability investigation mechanisms for food safety government supervision, which cause the mechanisms can't play its effective role.It is needed to improve the legal liability investigation mechanisms for food safety government supervision step by step according to these problems so as to reduce the occurrence of food safety incidents.
Widespread Usage of Infant Formula in China: a Major Public Health Problem.

Abstract:BACKGROUND:The potential health risks of infant formula feeding are well established. This study investigated the opinions and perceptions of mothers and recommendations by hospital staff with respect to infant formula usage in China.METHODS:A cross-sectional survey of 726 mothers within 6 months postpartum and 241 hospital staff, using structured questionnaires, was conducted in Hangzhou and Shenzhen, China.RESULTS:Overall, 474 of 726 (65.3%) infants aged within 6 months had consumed some infant formula. About 40.0 percent of mothers chose a hybrid brand of formula (manufactured in China but owned by a foreign company), over imported (< 32.0%) and domestic brands (< 28.0%), despite their higher level of confidence on the quality of imported brands. Perceived insufficient breastmilk production (86.2%) was the most common reason for giving infant formula, followed by return to work (24.6%). Of the 241 hospital staff, 97 (40.2%) gave no recommendation about infant formula brand for infants at any age. However, 47.2 percent of the remaining staff recommended a hybrid brand in combination with an imported and/or a domestic product.CONCLUSIONS:Perceptions by mothers and recommendations from hospital staff appear to contribute to the widespread usage of infant formula in China. It is important to ensure breastmilk substitutes are prescribed to Chinese infants strictly for medical reasons. Maternal education programs incorporating information on food safety issues and establishment of breastfeeding-friendly workplaces could curtail the common practice of formula feeding in China.

Abstract:China is among the world's largest producers of apples. It has a potentially large export market around the world. However, differences in food safety standards-for example, concerning pesticide residues-often pose serious challenges to Chinese exporters. Focusing mainly on Chinese exports of fresh apples to the European Union (EU), this article analyses these opportunities, related legal obstacles, and the increasingly successful strategies, both domestic and international, used by the Chinese government to meet those challenges associated with them. It considers the gradual alignment of Chinese standards with international standards, the Chinese export strategy based on government support for selected elite export companies, and the conclusion by the Chinese government of new bilateral agreements to open major new markets for Chinese businesses. In doing so, it traces interconnections between: international, EU, and Chinese food safety standards; China's post-World Trade Organization succession international trade strategies; the modernization of Chinese agriculture; relations between public and private standards; the 16 + 1 arrangement between China and the Central and Eastern European countries including Member States of the EU; China's One Belt, One Road initiative; and the development of a China-centred global food economy for apples. The result is an unusual form of regulatory collaboration between China and the EU. These factors are among the main drivers of transnational legal and economic relations in the international food trade today. They represent an emerging world food trade order.

Abstract:This paper analyses how China's inter-governmental arrangements have functioned in different ways to reduce food risk. While there is greater transparency, consistency, and inclusiveness in the process of setting food safety standards than in the past, the central government has almost exclusive power over these standards. Local governments are mainly responsible for gathering timely information and enforcing standards. This institutional design has redistributed costs for both the food producers and regulators alike, and enhanced public participation.

Abstract:Globalization has irrevocably altered the world of food safety. This article focuses on WTO cases about food safety regulation, which arise under WTO agreements other than or in addition to the SPS or the TBT Agreements and which are not directly concerned with relations between the WTO and international standardization bodies. It asks: What do these cases—which are not mainly about relations between WTO and international food standards—teach us about the role of the WTO in food safety regulation? The WTO dispute settlement system deals with food safety more frequently than is sometimes thought. Virtually all such cases were settled, withdrawn or reached stalemate during consultation; in only a very few cases was a panel established. Complainants always won, and the winner was usually of equal or higher income category than the respondent, except when the case went to a panel.

Abstract:Established within the framework of the World Trade Organization (WTO), the Trade Policy Review Mechanism (TPRM) reviews periodically the trade policies of all WTO Members. The review includes many aspects of food safety regulation. China’s trade policy is reviewed every two years. This paper analyses in detail the reviews of China’s trade policy in 2006, 2008, 2010, 2012 and 2014. It focuses in particular on food safety law and types of standards, alignment of domestic standards with international standards, the role of different domestic institutions, transparency and notification of food safety measures under the WTO agreements on Sanitary and Phytosanitary Measures (SPS) and on Technical Barriers to Trade (TBT Agreement), import and export, and geographical indications (GIs). It concludes that the WTO TPRM can contribute, within its mandate, to reform of Chinese food safety law and improvement of food safety in China. It notes that China has already undertaken substantial reforms of its system for regulating food safety. It recommends that China should continue to participate actively in the TPRM, follow its own path with regard to alignment and learn selectively from other WTO Members and undertake selected reforms in its system of food safety regulation.

Abstract:Product standards are ubiquitous in contemporary societies and trade relations. Reflecting a legal perspective, this chapter considers selected aspects of domestic, bilateral and international product standards in EU-China relations. It gives examples of different types of structures, actors and issues. It argues, first, that product standards may be adopted by numerous sites of governance, ranging from domestic, transnational, regional or international sites, or from public bodies to private organisations or both, and may be legally binding or take the form of ‘soft law’. Second, though appearing to be simply the normative expression of scientific opinion, product standards are not neutral but instead result from politics, negotiation and compromise. Third, they are double-edged in protecting public health while also determining market entry; in fact they may actually create markets. Fourth, the EU and China compete in developing international standards, but they also cooperate in making standards in numerous bilateral and multilateral settings. Each develops its own standards, promotes them internationally and seeks to apply them so far as possible to domestic and foreign products. On the one hand, domestic product standards tend frequently to converge, because in many fields product standards are actually highly transnational, not simply domestic, in origin, culture and content. On the other hand, the setting of product standards in EU-China relations, regardless of the setting, must increasingly be sensitive to domestic characteristics and priorities; this imperative renders more complex the long-standing debate about the normative and economic effects of globalisation.

Abstract:<span>This paper critically engages with dynamics of the Chinese food safety governance infrastructure following the melamine crisis. It presents a qualitative analysis of 16 in-depth stakeholder interviews in Hunan, Hubei, and Henan. We reveal tensions between a segmented model of governance and a centralized model, between a centralized top-down model and stakeholder participation, and between a public model and a private, decentral market where corporate reputation must result in transparency and trust. Stakeholders also see gaps between ideals of inclusive, transparent, and participatory governance, and effective problem-solving. Governance of food safety in China, even when targeting inclusion and public accountability, remains heavily dependent on the central state as a pivotal actor.</span>

Abstract:This chapter maps the law concerning pesticide use in China. It deals with international and regional agreements, international standards, and national and selected provincial and municipal measures. It show the interconnection between transnational law and Chinese law, and emphasises the interconnection between hard law and soft law.As local examples, it examines the provinces of Shandong and Shaanxi and the city of Xi'an.It also shows that, though the law concerning pesticide use in China exemplifies the concept of transnational law order, there are also specific features of Chinese society which affect this area of law.

Abstract:Two events that have raised concerns in China and beyond took place in the year 2008. One was the increase in food prices, for which China was, rightly or wrongly, deemed partly accountable. The second was the scandal related to the addition of melamine to milk powder, which was responsible for the death of at least six babies and the sickness of hundreds of thousands of others throughout China. If the first event is related to the quantity of available food and the second to its quality, both showed that China’s agro-food markets and their integration worldwide are of crucial importance. China is now a major importer of cotton, sugar, and soybeans, just to mention a few products. It also exports important volume of garment, tea, and wood products. At the same time, consumers worldwide worry when contaminated pet food is found on the shelves of their supermarkets or when Chinese travellers overseas buy large quantities of milk powder, thereby disrupting local supplies. Yet, if China’s agriculture is fairly well known, its agro-food markets have not attracted the attention they deserve. This book aims to compensate for this gap and provide an in-depth analysis of several key Chinese agro-food markets.

Abstract:To modernize food safety governance, we must carry out basic restructuring of its internal logic at the national level to reflect the features of contemporary Chinese society that shape food safety. This will entail establishing an overarching, macro-level conception of food safety that integrates baseline safety, hub safety, co-constructed safety and endogenous safety. These four dimensions of safety represent four fundamental requirements of food safety governance in modern Chinese society, which is a risk society (Beck 1992) and one that is also complex, open and pluralist. These requirements are: maximum legal liability, a unified, authoritative and efficient supervision system, a concept of social co-governance, and enterprises being the primary entities accountable for food safety. This article uses this analytical framework to interpret the basic contents of the newly revised Food Safety Law of the People's Republic of China, and uses a focus on social co-governance to present the institutional highlights of this law and the transformation of the internal logic of food safety governance.

Abstract:Despite the increasingly sophisticated management systems in China, food safety issues continue to be a persistent problem. This paper examines the underlying issues behind food safety regulation in China, focusing on the recent surge in incidents. Against the backdrop of a risk society, food safety issues have become a hot topic in Chinese society today. Our research on it should not only be limited to interpreting it as a shallow phenomenon of unscrupulous businessmen profiting at the expense of conscience, nor should it be simply attributed to the negative effects of modern food chemical technology development. Instead, we should start from the perspective of the theory of risk society to gain a more thorough understanding and comprehensive reflection. The backdrop of a risk society in transition, China's food safety problem has become increasingly severe. To better withstand risks and move towards a safer society, it is essential to fully recognize the importance of food safety and establish a scientific and reasonable system of risk governance through improving legal mechanisms, risk communication and interest mechanisms.
The limits to the internationalisation of regulation: divergent enforcement strategies in China’s food safety regulation

Abstract:This article empirically analyses enforcement strategies that characterise food safety regulations in China. It demonstrates that the Chinese government has deployed a dichotomous approach, resulting in very different regulations in its domestic and export food markets. The export food sector exhibits strong deterrent measures whereas regulation of domestic food markets is reactive and relies on persuasive approaches to enforcement. These variations between the two sectors result from a combination of the internationalisation of regulatory practice in the case of exports and resource constraints, a lack of institutional capacity and resistance to regulation from intertwined business and government interests when it comes to domestic food markets. This article addresses a gap in existing theories of regulation by showing how an industrialising economy with an authoritarian regime employs an accommodative and pragmatic approach to regulation that balances international pressure and national interests and produces contrasting approaches in different sectors.
