Abstract:Presently,the legislation on the way of recalling defect goods can be summarized as voluntary recall being the principle supplemented by being ordered to recall.The recall of defect goods ordered by administrative bodies must be under the premise that producers should recall but fail to.The way of legislation greatly limits the realization of the recall so it must be corrected.In terms of consumer's right,administrative bodies should simulate consumers and initiate by law the order to recall instead of taking the premise above.Although the 23rd clause of Regulations of the Management of Recalling Defect Goods(Draft) shows to some degree the fiction concept,it still needs correcting.
