Abstract:The Article 1 of The Administrative Procedure Law,as the"soul article"of its legislative purpose,is a barricade when involving modification of The Administrative Procedure Law.The understanding of Article 1 of The Administrative Procedure Law mainly includes the following three different views as claim of protecting rights,claim of maintaining supervision and equilibrium theory.Based on the analysis of these three kinds of views,right relief should be the legislative purpose of administrative lawsuit.So,the modification of The Administrative Procedure Law should abide by the principles such as effectiveness,rights protection and non-loophole rights protection.

Abstract:Even if the administrative litigation system is not perfect, it is still a strategy selected in the system, by administrative counterparts struggling for their rights. In front of the administrative counterparts who struggle their rights, the difficulties of agency managing social affair have become increasingly prominent. The court, hardly guaranteed the independence in the litigation relationship, often trapped in a kind of embarrassing situations where it cannot help itself. This issue requires us to reflect on the administrative litigation system under the concept of people-oriented idea, so that a good way solving the problem can be found.

Abstract:Dispute solution is a legislative value transformed from civil litigation into the laws applying to actions against administrative agencies’ decisions, which aims at increasing the ability to solve disputes through actions against administration. However, actions from executive decisions have their own unique nature that may intensify the relationship with supervision of power, another feature inherent in the actions from administrative decisions. By way of easing the tension between dispute solution and power supervision, we can see how far the laws can go in performing the function of dispute solution and can demarcate the legitimacy of the compromise in the actions from administrative decisions so as to further ensure the protection of civil rights.

Abstract:The legislative purpose of administrative reconsideration determines the basic principles of Administrative Reconsideration Law.All the concrete rules of administrative reconsideration also derive from it.From Regulation on Administrative Reconsideration(1990) to Administrative Reconsideration Law(1999) and Regulation on the Implementation of the Administrative Reconsideration Law(2007),the relationship between administrative reconsideration and administrative litigation changes accordingly.The former is not dependent on the latter any longer.They are now independent of each other.Furthermore,the legislative purpose of administrative reconsideration has evolved from supervision to settling administrative disputes.This evolution has also had an impact on concrete institution of administrative reconsideration.The legislative purpose is composite of multiple levels.In different cases,we decide which the first priority is.Settling administrative disputes is not the legislative purpose of administrative reconsideration,but an approach to realizing it.

Abstract:"Administrative Litigation Law" endows people's courts with judicial review of consulting rules when hearing administrative cases. The "refusal to apply rules" in No. 5 guiding case is regarded as the transformation from the doctrine of individual refusal to apply rules to that of universal refusal. That is to say, courts have been authorized to declare rules void. In other words, the case expended the judicial review. According to the hierarchy of legal force established by "Legislation Law", courts should determine first whether the law of lower level contradicts the law of higher level before refusing to apply rules. The standards to determine contradiction are as follows. In the relationship between rights and obligations, contradiction occurs when rights laid down in the law of higher level are restricted or deprived by the law of lower level, and when obligations laid down in the law of higher level are expanded or added by the law of lower level. In the relationship between powers and duties, contradiction occurs when powers laid down in the law of higher level are expanded or added by the law of lower level, and when duties laid down in the law of higher level are exempted by the law of lower level.

Abstract:The system of administrative agreement is one of the important means of contemporary public administration. It is the integration of administrative power and contract spirt. The difference between administrative agreement and other administrative means is that the state can make the public administration objectives more specific in the form of administrative agreement, and tend to be legal, and stipulate the specific rights and obligations of both parties in the form of contract. The advantage of administrative agreement lies in the integration of right elements and contract spirit. Firstly, administrative agreement is an agreement reached by administrative organ and administrative counterpart through reasonable discussion; secondly, as the parties to the agreement, the administrative subject still maintains its original credibility to ensure the realization of its administrative purpose. Through the protection of the administrative agreement system, it is helpful to clarify the rights and obligations of both parties to the agreement, ensure the realization of the administrative objectives, and solve the problems. Based on the analysis of the problems existing in the current administrative agreement system, this paper proposes to standardize the scope of administrative agreement by administrative procedure, clarify the scope of administrative agreement and civil agreement by judicial interpretation, and restrict the exercise of priority, hoping to realize the value orientation of administrative agreement and protect the interests of the people through the above measures.

Abstract:On administrative law, the invalid administrative act is mainly a concept, theory and system in countries and areas of continental law family. But in today' s China, there is no mature theory and also a lack of perfect system of invalid administrative act. This article tries to consider the people' s right to resist the country as a springboard, giving all-sided pectinataion of actuality on Chinese invalid administrative act system. On the basis of external analysis of its problem, this paper puts forward three aspects to establish our invalid administrative act system, which are uniform system of invalid administrative act, serf-existent litigation of invalid affirmation and special administrative enforcement system.

Abstract:A constitution cannot specify the administrative division of the state,which is left to the legislature.While making laws concerning administrative division,the legislature is subject to certain constitutional principles.Only with power delegated by the legislature can the executive change the administrative division.Unfortunately,in China's Constitution,the provision concerning administrative division seems too over-rigid and no technical legal reservation can be found,which will inevitably lead to constitutional controversies.

Abstract:This chapter explains how, in the current phase of development in the Chinese legal system, administrative law has emerged. China is undergoing a process of subjecting power to the rules which, for administrative law, concern the relationship between state and citizen, and more generally that between state and society. The current evolution is particularly rapid and favoured by changes to the economic structure in recent years, and this explains the fact that administrative law in China is on the eve of great expansion. The chapter examines some theoretical issues relating to judicial review of the exercise of administrative activity, an area which has seen the manifestation of the process of legalization of administrative power, as has happened in Western legal systems. Over the last few years, the development and interpretation of the instruments available has progressed while the availability of instruments has tended to broaden, even if currently legal protection is still in its early stages. However, all this will naturally require a long period of settling, as in Western countries; hence the evident need for gradual change as the fruit of a realistic approach.

Abstract:Research on administrative law over 2005-2006 has achieved progresses in these fields:several important textbooks been published;foreign administrative law continuously translated or introduced;discussion on the transition of public administration and on the ideal type of administrative law deepened;the principles of administrative law further explored;legislative study on Administrative Procedure Law,Administrative Litigation Law and publicity of government information fruitfully made;research on administrative regulation becoming a hot field;several successful cases of empirical or sociological study been seen.Jurisprudence of administrative law,though comparatively young in China,has shown a new vista.However,administrative law research still needs to be improved to respond to the legal reality and feedback to other branches of legal study,and the consciousness of questions,research method and academic criteria should still be stressed.

Abstract:Since constitutional stipulation on administrative division structure cannot be in details,further stipulations are left to national legislature,which should obey constitutional principles when making relevant laws and national administrative organizations should be authorized by national law during the reform on administrative division.This is the constitutional technique reserved by law and constitutional content developed from judicial practice.Chinese constitutions concerning administrative divisions are too rigid,and fail to adopt the technique of legal reservation,so relevant constitutional controversies arise.

Abstract:Judicial review, as a form of external supervision, can effectively improve the lack of self-supervision by administrative subjects. Obviously improper as one of the circumstances of administrative behavior, the definition of the academic community, and the “Administrative Procedure Law” and its judicial interpretation of the lack of clear definitions and application standards, resulting in the court in the judicial practice of the application of “obviously improper” as the basis for review of the standard is not uniform and inconsistent application of the problem, judges and Relying on their accumulated professional knowledge and practical experience to determine whether the administrative subject of the administrative act constitutes “obviously improper”, with a greater subjectivity, which may lead to administrative action as well as the judicial trial of the phenomenon of the same case, undermining the impartiality and authority of the judiciary, not conducive to the construction of the rule of law, the rule of law government. Therefore, in order to solve the above problems, the need for the meaning of clearly improper and its judgment standards, standardize the “clearly improper” the scope of application of the basis for review, the establishment of a unified standard of judicial review, but also to continue to improve the administrative case guidance system. Therefore, clarifying its criteria is of great significance to the people’s courts in correctly adjudicating administrative cases to safeguard the lawful rights and interests of citizens and legal persons, and also helps to standardize the criteria for judicial review, and to regulate and limit administrative power.

Abstract:The dwelling right is a right to freedom prescribed in the constitution, but its protection is still blind in the administrative law. Even if we just concern the protection of dwelling right in the sense of right to freedom, there are still many deficiencies in administrative law. First, the scope of residency and the standard of unlawful intrusion are not clear in the Regulations of PRC on Punishments in Public Order and Security Administration; Second, there exist many negligence in Regulations Governing Urban House Demolition and Relocation and Law of PRC on Land Administration in the protection of citizen's dwelling right. Third, the dwelling right has no remedy actually, and it is regarded as property right in the present, and get few remedy according to administrative litigation law and state compensation law.
