Paradigm Adjustment of Environmental Law and Civil Law

Abstract:The dialogue between Environmental Law and Civil Law i s a hot issue in law studies, which reflects the dialogue between the individualism paradigm and holism paradigm. Environmental Law and Civil Law are sharply different from e ach other in issues consciousness, history horizon, world map, thinking mode, an d value regulations, which results from the two paradigms. The necessity of the dialogue lies in the challenge of present environmental issues and the crisis of the paradigms. The dialogue relates with the present law system, the division o f the domain, and the choice of the solution, which is helpful to widen the hori zon, to change idea, to reconstruct value, and to renew methodology. In the proc ess of mutual interactive dialogue, the purpose of Environmental Law is to find the answer to solve environmental issues by means of the theoretical paradigm of Civil Law. Whereas, the aim of the Civil Law is to understand how environmental problems have effect on civil issues, which is the inspiration that the Civil C ode can benefit from. How to define Environmental Law and Civil Law, it is neces sary to divide them based on the new division theory of law branches. The idea o f defining them by domain should be replaced by the idea of defining them by iss ues. To solve environmental issues, it is important to adjust Environment al Law and Civil Law based on the principle of Public Order and to redefine them.
