On Aboriginal Environmental Rights

Abstract:The advocacy and description of “aboriginal environmental rights” is of great importance to form a network of rights in modern society. Aborigines are deemed “the minorities” and “the discriminated” in the modern nationality-state analytical structure. The development of the “environmental justice theory” and the “ecological intelligence theory” makes it possible for us to evaluate the justifiability of “aboriginal environmental rights” free from restraint of the nationality-state framework and to reestablish “super-modernity” “aboriginal environmental rights.” International law remedies should be applied to defend aboriginal rights. Furthermore, municipal law should center around “aborigine participation” so as to assure aborigines’ “autonomy” in environmental protection.
