Abstract:Public cases with major social impact in recent years reflect issues in China's authentication system.Lack of public credibility in authentication opinions,lack of right to know and right to act of on the part of clients,and reluctant attitude of public security and judicial authorities towards court appearance of authentication appraisers,all these issues are hindering the perfection of China's authentication system.We should take the opportunity of amendments to Law of Criminal Procedure,with the guidance of proper legal principle,in an effort to perfect relevant system concerning authentication opinions used as scientific evidence.

Abstract:The legislation providing that an entity may commit a crime and should be subject punishment bears a tinge of "rigidness but not severity." However,for a long time,while misunderstanding the structure of "entity crime," people have been seeking to determine liabilities born by the entity or the representatives thereof within the framework of one criminal act.Consequently,there appear many contradictions and conflicts both in legislative theories and judicial practice.Thus,it is urgent to reconsider the structure pattern of the crime committed by an entity.In deed,it contains two crimes:one perpetrated by the representatives of an entity which is physical while the other committed by the entity which is fictitious.The two crimes are closely linked but they are two criminal acts separate from each other and cannot be held an accomplice.As such,the entity and the representatives thereof are parallel and independent subjects of crime whose liabilities should be attributed to their respective acts.

Abstract:[Foreword] Remodification of China's Criminal Procedure Law has been listed in the agenda by the NPC. In terms of the legislation plan of 2007, the modification draft of this law will be proposed for consideration in October this year. Till now, there still exists some important debatable issues. Abstract:The 425 pieces of crime stipulated in the Special Provisions of China's Criminal Law embodied all the theory, rule and policy underlying its General Provisions. Meanwhile, the application of Special Provisions fed back the General Provisions and their evolution process with the follows: the diversity and levity of crimes committed in real world, as well as the endogenetic limitation of the rule and theory.Starting from six basic concepts such as abstract accusation and further reviewing the main theoretic issues therewith,this article addressed one antique yet frontier problem - the conflict between and among standards of criminal law interpretation.

Abstract:From the amendment of criminal procedure law in 1996 on,many obvious changes emerged in criminal judicial practice including defense,compulsory measures,method of trial and the implementation of the innocence assumption,which reflected both the advantages and limitations of the amendment to some extent.However,new challenges face the theory of criminal procedure such as guarantee mechanism of the procedure law enforcement,judicial remedy for the right to defense,and formalistic trial proceedings.In addition,conflicts between Chinese legal culture and occidental one should not be ignored though unprompted reform of criminal justice is in process of expandedness.The success in criminal judicial reform shall be acquired by establishing the remedy mechanism for the rights,advancing systematic reform,and transforming the procedural conception regarding criminal lawsuit.

Abstract:As an interpretation method, systematic interpretation changes with the evolution from begriffs jurisprudence to jurisprudence of interests, and it is of great significance for supplementing the deficiencies of semantic interpretation. Systematic interpretation is based on systematic thinking, placing the provisions of criminal law in the entire legal system, thereby obtaining a correct understanding of the text of criminal law. In the dogmatics of criminal law, systematic interpretation can be divided into external systematic interpretation and internal systematic interpretation. Among them, the external systematic interpretation adopts the formal-logical analysis method, which mainly solves the problem of coordination between different laws and the same law, so as to provide a jurisprudential basis for the overall application of law. The internal systematic interpretation adopts the value analysis method to trace the meaning of legal norms and provide common value standards for understanding legal meaning.

Abstract:Based on copious material, this paper fully describes the twists and turns in the progress of Chinese criminal jurisprudence in the past 30 years, discusses the relevance of the criminal jurisprudence and the rule of law in criminal justice, as well as the development of criminal jurisprudence. Meanwhile, an assessment has been made on the theoretical criminal jurisprudence. As a whole, all of those would be of important reference for properly understanding the theoretic development of Chinese criminal jurisprudence.

Abstract:From the angle of the history of criminal law,criminal provisions experienced the evolution from specific legislation to general legislation.The division between the General Provisions and the Specific Provisions is a result of accumulation of human experience,a outcome of continuous increase of human understanding of crime and criminal penalty.Important as the General Provisions are,it is impossible to establish crimes for illegal offences without the Specific Provisions.The norms in the Specific Provisions are modes of expression for categories of crime.They not only address technical issues,but imply certain ideas of criminal value.The Specific Provisions of Chinese Criminal Law not only specify criminal charges and statutory punishments but contain other guiding stipulations applicable in criminal law.

Abstract:Modern Chinese criminal law and legal theory cannot be separated from the historical, cultural and political context in which they developed. This article begins with a four-part periodization of the development of Chinese criminal law: (1) Late Qing reform, Republican legislation and the dawn of the modernization of Chinese criminal law from the 1911 Revolution until 1949; (2) the blank period of criminal law from the establishment of the PRC in 1949 until 1979; (3) the 1979 Criminal Law and the special Criminal Law era from 1980 until 1997; (4) the 1997 Criminal Law and the amendment era from 1997 to the present. This article next traces the development of Chinese legal scholarship alongside shifts in the criminal law. Prior to 1949 the academic field of Chinese criminal legal studies engaged with criminal justice systems and philosophies from Germany, Japan and other civil law jurisdictions as they were being introduced into China. After the establishment of the PRC, Chinese criminal law turned away from modeling Germany and Japan and thoroughly adopted Soviet criminal theory, transforming Chinese criminal jurisprudence into socialist criminal jurisprudence. In the 1960s and 70s, with the rising tides of legal nihilism and legal anarchism, research into criminal theory stagnated and was suspended for two decades. Following the promulgation of the 1979 Criminal Law, research into criminal legal theory was reinvigorated. Since the mid-1990s research into theory has flourished as a result of theoretical debates and legislative deliberation around the revision to the Criminal Law in 1997. At the turn of the 21st century Chinese criminal legal theory once again incorporated Germany and Japanese criminal law discourse and knowledge, producing systemic reconstruction in a process of standardization.

Abstract:As the fundamental law of the state,constitutional implication the principles of respect and protection of human rights produced profound influence to our country criminal law system.Criminal law amendment(eight) on the penalty structure was adjusted from the reduction of death penalty,perfection of non imprisonment punishment,strengthen human rights protection of the special groups and other aspects.This adjustment reflected positive response of criminal law on constitutional respect and protection of human rights principles.Although adjustment still has many deficiencies,but the criminal law amendment(eight) on the adjustment of penalty structure actively promote China's criminal law humanity process.It has important significance in light of the constitution to respect and guarantee human rights principle.

Abstract:The judicial interpretation of criminal law should be an application interpretation to individual cases that is guided by judges and participated by the prosecutor and the accused, for which the judicial judgment should be combined with the application of criminal law of specific cases, and the criminal precedents should be as a carrier. The Supreme People’s Court should change from the previous practices of issuing normative and abstract interpretation to the dual approaches of the interpretation of criminal law application through direct creation and indirect acknowledgement.

Abstract:On the disputation of the judicial interpretation of defiling underage girl,the attention does not fully be payed to the differences of the knowledge stipulated in the miscellaneous provisions and the general provisions of criminal law.After hackling the attitudes to the subjective illegal elements in the science of criminal law in Germany and Japan,the concept of expressive crime should be accepted. And it also should be adopted as analysis implements of the knowledge stipulated in the miscellaneous provisions.Based on the logic of expressive crime,the knowledge stipulated in the miscellaneous provisions of criminal law is subjective illegal elements as well as the subjective constitutive requirements elements.But the the knowledge stipulated in the general provisions of criminal law is reprehensible elements.Without the knowledge stipulated in the miscellaneous provisions,it is not illegal.However,without the knowledge stipulated in the general provisions,it is illegal but not reprehensible.The knowledge stipulated in the miscellaneous provisions is not the cognition in general meaning,but the counter—reality.When recognise the knowledge stipulated in the miscellaneous provisions,we should grasp the contents of the knowledge in the sense of exact cognition and use the presumption.
