Abstract:There are changes in the correlative relation of five aspects in the study of the science of constitution in China. Science of constitution in the past is regarded as a kind of ideology, and now is transforming into a relatively neutral experimental study. The science of constitution used to be self-centered, affirming itself and negating the others. At present a more moderate attitude towards foreign constitution theories and experience is taken in pursuing study. The science of constitution used to focus on the text of constitutions, but now adopts the experience of those countries with advanced constitution, and pays enormous attention to the actual legal effect of the texts of constitutions. The science of constitution used to emphasize some abstract principles embodied in the texts of constitutions, but now attaches importance to how constitutions help us settle the actual problems in practice. Lastly, the science of constitution used to be more interested in the micro concepts such as “ people”, “state”, and “sovereignty”, etc., but now switches its attention to individual rights and constitutional principles embodied in individual cases. The process of China's constitution from “people's sovereignty” to “human right” is actually a symbol of a change that the science of constitution switches from wholeism to individualism in the aspect of methodology. The relevant changes indicate that the science of constitution in China is building its own theoretical system led by pragmatism and positivism.
