Abstract:Paragraph 1,Article 6 of The Law of Tortious Liability is the general clause of tortious acts.The literal interpretation and historical interpretation lead to a conclusion that it protects all kinds of rights and interests in private law,and protects them equally.But this answer will bring about serious negative effects.Therefore,a teleological reduction method must be adopted to clarify the factual elements in this rule,and the German restrictive model shall be followed.Regarding the rules under non-fault liability,fault-presumed liability and the responsibilities of "sharing losses fairly" or "reasonable reparation" ,most of them shall be interpreted to protect rights in rem only,or even certain kinds of rights in rem.The doctrinal arguments in this paper are based on a policy to balance the freedom on the one hand,and the security on the other.

Abstract:The year 2023 was notably marked by a significant number or reports of extreme decisions made by teachers. This paper aims to explore the legal aspects of conflicts and corruption within schools as underlying causes, examining the corruption in educational administration from the perspectives of teachers, parents, and students, and proposing directions for improvement. A consensus has formed among the public regarding the severe damage to teachers' authority, and the Ministry of Education has announced policies to alleviate the burden of addressing school violence from teachers by recruiting external experts to handle these issues while protecting students' rights and preventing indiscriminate parental intervention in educational administration. Additionally, the Ministry has proposed measures to prevent extreme decisions by teachers. Among these measures, revisions were made in September 2023 to the Basic Education Act, the Special act on the improvement of teachers’ status and the protection of their educational activities, the Elementary and Secondary Education Act, and the Early Childhood Education Act, with the Special Act receiving the most significant updates. However, continuous legislative improvements are necessary for the faithful fulfillment of the state's legislative duties based on Article 31 of the Constitution. This paper reviews and evaluates the newly revised or established provisions in the Special act on the improvement of teachers’ status and the protection of their educational activities, including preventing unjust dismissal of teachers, expanding the scope of activities considered as infringement upon educational activities, introducing measures against protectors of educational activity infringement, prohibiting the reduction or concealment of such infringements, mandatory reporting of infringements, and the teacher protection indemnity project provisions. Despite the effort and time invested, many aspects were found lacking, leading to the proposal of new amendments. This study also analyzes four proposed amendments to the Teacher Status Law and offers various perspectives on boosting teachers' morale.

They have deep and lifelong influence on students and the prosperity of a country and even the bright future of the whole world.Teacher should be a person with great virtue that sets good examples for the students. However, nowadays, there exist various problems about teacher’s ethics due to complex social, economical, cultural or personal issues. It’s urgent and imperative for teachers to learn and improve professional ethics to be a better mentor. This paper begins with the definition of ethics, emphasizes the importance of teachers’ professional ethics, talks about current situation in this area, analyzes the reasons why there are immoral problems about teachers and suggests some practical strategies on how to improve it.

Abstract:The relief of right and the freedom of behavior are the basic category of Tort Law,going throughout the whole consideration of the law.Important issues of Tort Law start from this basic category too.Freedom stops in front of right.There is a mutual restriction between the relief of right and the freedom of behavior,since expansion of the relieved right means constriction of the freedom of behavior.Conversely,expansion of the behavior freedom means constriction of the right which can be relieved.In process of constituting tort laws,judging tort cases and giving consideration to the relief of the victims,the mutual restriction between right and freedom should be considered."The more the better" is incorrect here.

Abstract:Since the time when systematical researches on education law arose in the Mid-20 th century,the theoretical system and disciplinary construction of education law has kept winning concerns of scholars,whose discussions lacked consensus and fundamental reflections on relative jurisprudential problems.The theoretical system of education law should be grounded on four groups of elements:the right to education and the duty of state,the academic freedom and self-determination of school operation,the humanism and dignity of thought,and the double obligations with contractual duties.The framework of the system mainly consists of legal relations and activities of education,with special priorities,school governance and professional judgment as its features.This design could build education law as a discipline subordinate to both legal science and pedagogy and frame characteristic arrangement of curriculum,which will make it better develop as an independent subject and promote the rule of law in education.

The professional struggles, of mine and of those that I have observed, might offer an easy entry point for discussing Chinese international lawyers and the China topic in a world of struggle. The article further invites my fellow international law teachers in China to imagine a mode of teaching (and engaging with) international law that breaks away from the purely instrumental understanding of law. Abstract:The Langdell Educational Theory and the Method of Teaching Law has been the most admired and long dominant model of legal education in American law schools. Nevertheless, in theory, it has apparent flaws and, in practice, creates bad consequence of separating students from legal reality. It regards legal science contained in printed books. Seclusion, nostalgia and bookishness form the foundation of the Langdell Pedagogy and constitute a pseudo-scientific system based solely upon book-materials. Law schools must abandon the Langdell Pedagogy, face directly social problems, revert to the apprentice system of law teaching on a more sophisticated level, make law office as the center of law schools, employ practitioners as law teachers, use real legal issues in society as teaching materials and promote educational experiment.
