Abstract:Many structural defects and deep-seated contradictions of China's administrative procedure law has increasingly been exposed.Since these defects can not be completely solved only by judicial interpretation,it has become an urgent problem to revise the law.The RUC-version of expert recommended draft,which has been formally submitted to authoritive legal institutions,holds that the legislative spirit and the basic framework of current administrative procedure law is still viable,but part of it can not meet the requirement of the development of the rule of law in adminsitration and need to be modified.Therefore,the RUC-version of expert recommended draft proposed a series of specific suggestions.The main innovative high lights include:(1) adjusting the legislative purposes of the administrative procedure law;(2)adding the principle of final judicial adjudication;(3)using "administrative dispute" to alternate "specific administrative actions" as the basic standard of the scope of accepting cases and right of action so as to expand the scope of protection;(4)proposing the reform scheme of current administrative judicial system;(5)systematically designing the designated-outside jurisdiction system;(6)admitting the electronic-data evidence as a new type of evidence;(7)establishing the principle of suspending the execution of the sued administrative act;(8)adding mediation system and simple procedure;(9)systematically designing the system of commonweal administrative suit;(10)formalizing and strengthen the judicial suggestion system;(11)establishing special reserve system of indemnity(compensation) and system of payment order by courts;(12)adding measures of enforcement and enhanced the strength of enforcement.
