Abstract:The global expansion of public-private partnerships (PPPs) has generated interest in risk allocation for PPP projects. Many previous researchers have shown that without proper risk allocation, PPP projects cannot be successful. Current research is limited to equilibrium allocation of risk. The objective of this study is to improve this situation by constructing an alternating offer bargaining game model of risk allocation between two players involved in PPP projects, i. e., the public and private sector. Risk allocation can be analyzed as a game to more fully reflect the bargaining process among the parties. Equilibrium risk allocation outcomes were analyzed for the two cases in which the bargaining process was initiated in the first round by the public or private sector, and shows that risk allocation ratio is associated with the sequence of alternating offer, discount factor, and asymmetric degree of information. The probability, severity, and impact of risk factors were considered to prioritize risk allocation. Demonstrating the proposed model using a PPP project case study validated the model as effective and practical. This study contributes to the theoretical foundation for understanding the process of bargaining risk allocation of participants and provides a practical model to aid the participants to achieve fair risk allocation rather than a crude approach with preferences and biases. It promotes participants' rational and cautious behavior. This work also proposes a new risk allocation tool based on bargaining game theory for PPP project researchers to analyze game behaviors in the construction field. Abstract:Public-Private Partnership (PPP) is a contract between a public entity and a consortium, in which the public outsources the construction and the maintenance of an equipment (hospital, university, prison...). One drawback of this contract is that the public may not be able to observe the effort of the consortium but only its impact on the social welfare of the project. We aim to characterize the optimal contract for a PPP in this setting of asymmetric information between the two parties. This leads to a stochastic control under partial information and it is also related to principal-agent problems with moral hazard. Considering a wider set of information for the public and using martingale arguments in the spirit of Sannikov, the optimization problem can be reduced to a standard stochastic control problem, that is solved numerically. We then prove that for the optimal contract, the effort of the consortium is explicitly characterized. In particular, it is shown that the optimal rent is not a linear function of the effort, contrary to some models of the economic literature on PPP contracts.

Abstract:Construction projects are riddled with risks that should be shared by both owners and contractors alike. The principal-agent theory has proven to be an influential theoretical apparatus in designing optimal risk-sharing rules and provides contractors with proper incentives to improve project efficiencies. According to the principal-agent theory, it is optimal to let the contractor assume all of the risk if it is risk-neutral. However, this article argues that this theoretical model may lead to a biased incentive structure. To demonstrate this point, this article analyzes the necessity of risk-sharing between the owner and risk-neutral contractor in construction projects. Taking into account cases where the respective planning efforts of the owner and contractor are supposed to be unverifiable and mutually complementary in terms of cost overrun risk, we find that either double moral hazard (i.e., both parties take opportunistic strategies) or inefficient breach of contract by the contractor occurs if the contractor assumes the entire cost overrun risk. An optimal risk-sharing strategy, therefore, plays an important role in coordinating both parties to choose efficient strategies.

Abstract:Purpose This study aims to investigate the effects of moral hazard on quality and satisfaction of public–private–partnership (PPP) construction projects in Ghana. Design/methodology/approach After undertaking a literature review, questionnaires were used to elicit responses from respondents. Population consisted of quantity surveyors, project managers, procurement officers, consultants, public agency officers involved in PPP projects, private partners and contractors. A total of 211 questionnaires were received from 250 distributed. Purposive and snowballing sampling techniques were adopted. Analytical tools were Cronbach's alpha for testing reliability, regression, mean score ranking and relative importance index. Findings Reduced mutual trust and respect, poor clarity of project objectives; consequence on decision-making; less effective construction process; and increased construction risks were the significant effects of moral hazard on satisfaction of PPP construction projects. Value-based effects; manufacturer-based effects; product-based effects; user-based effects; and transcendent-based effects were the significant effects of moral hazard on quality of PPP construction projects. Practical implications Construction stakeholders involved in delivering PPP projects ought to take note of the findings and recommendations arising. Further studies should explore the effects on other project performance indicators apart from satisfaction and quality. Originality/value This paper extends knowledge in the area of exploring the effects of moral hazard on PPP project satisfaction and quality. The findings are beneficial to both academia and industry practitioners.

Abstract:Negotiations among project participants in Public-Private Partnership(PPP) especially between government and the private consortium are time-consuming and costly.Disputes often arise during the operation period,due to the characteristics associated with PPP mode which typically involves huge investment,long concession period,high risks and complicated contractual structure.Earlier research works indicated that a fair quantitative risk allocation among the stakeholders is essential for the success of PPP projects;however,actual empirical research on the ground is limited.In light of these,this paper suggests the timing and key points of risk allocation in a PPP project,and then summarizes their influences on value for money and the criteria to allocate risks.A comparative study of several risk allocation schemes is also provided as a reference for further research and practice of PPP projects.

Abstract:This article points out that both the project owners and the contractors probably have moral hazard during the period of project construction, establishes a bilateral moral hazard model of “hidden behavior” applying the principal-agent theory. The model analysis shows that when the information is asymmetric, it is efficient to applying the linear contract mechanism of cost plus incentive fee, but the risk-neutral owners and the contractors only implement the second-best effort level. It also receives the conclusion that when the relative impact rate of the contractors on the project cost increases, the cost sharing coefficient of the linear contract increases too.

Abstract:Since 2014, PPP has been developing rapidly in China and widely used in infrastructure construction such as transport, energy, sewage. The characteristics of long time, large investment and high complexity of PPP projects lead to the high incidence of renegotiation. However, experience at home and abroad indicates that most renegotiations are caused by the speculation of firms, in order to obtain subsidies to avoid taking risks and thus bring social welfare losses. Therefore, how to set reasonable renegotiation subsidy to improve project efficiency is an urgent problem in practice. This paper examines the impact of renegotiation subsidies on moral hazard and project efficiency. The problem of moral hazard refers to the fact that firms choose to make low level of efforts in advance (before risks occur) aiming at private profits. The paper firstly analyzes the intrinsic influence mechanism of renegotiation subsidy on the efficiency of PPP project by building a game model based on the incomplete contract theory and game theory, and then discusses the key factors affecting project efficiency, and finally puts forward corresponding policy recommendations. The research results show that: Moral hazard makes risk events more likely to occur, but enterprises can avoid bearing all the losses with the support of renegotiation subsidies, thereby increasing the incidence of moral hazard. Therefore, over subsidy will reduce the ex-ante efficiency, even if the ex-post efficiency still can be achieved. Controlling the renegotiation subsidy to a certain extent can avoid the occurrence of moral hazard, and achieve ex-post efficacy and financial efficiency at the same time. Optimizing policy variables such as private profit B, opportunity cost of re-tendering τ and legitimate profit of firms R-I can lower the requirement of government's negotiating power, making it easier to control the subsidy to the above scope. The research results can provide government with reference about renegotiation in decision making and provide theoretical support for the practice of PPP renegotiation.

Abstract:PurposeThe purpose of this paper was to assess the causal relationship(s) between moral hazard and adverse selection of public–private partnership (PPP) construction projects. Structural equation modelling (SEM) was used to explore the cause and effect relationship between moral hazard and adverse selection problems in PPP construction projects in Ghana. The study produced a framework to predict, estimate and depict the complex causal relationships (i.e. the directionality) between moral hazard and adverse selection.Design/methodology/approachTo test the proposed framework, a quantitative methodology was used, in which, data were collected using research questionnaires that targeted a sample of 280 PPP stakeholders in Ghana. In total, 210 useable questionnaires were retrieved, representing a response rate of 75 per cent.FindingsThe interrelationships between the eight causes and the nine effects of moral hazard and adverse selection were established using the model. The tested framework showed the degree of association and isolation of the unobserved variables on the indicator factors. Confirmatory factor analysis (CFA) was used to evaluate the fit of items to latent constructs. Because the fit of each model was good and the item loadings were adequate, it was assumed that the indicators of the different variables factors were fitting. Furthermore, a diagnostic fit analysis was conducted using the robust maximum likelihood method to test the statistical significance of the parameter estimates.Practical implicationsThis novel research is one of the few studies investigating the causal relationships between moral hazard and adverse selection of PPP construction projects. The research concluded with future studies that seek to validate the model developed in other countries and/or other industries.Originality/valueThe research findings will serve as a guide for construction stakeholders in the PPP sector on the causes and effects of adverse selection and moral hazard and how to mitigate these.

Based on the analysis of the problems PPP project management faced with in the aspect of economic, organization and law, this paper studies PPP project cooperation risk formation mechanism from the perspective of risk conduction and evolutionary game. It sets up the adjustment mechanism of right-duty-benefit about the "cooperation dilemma"of the PPP projects on the base of governance performance. This paper also discusses the multi-dementional collaborative governance path of the PPP project among the government, investors and the public , and how to improves the mechanism of interest coordination and supervision. Abstract:Public–private partnerships (PPPs), although widely used to build infrastructure and deliver public services around the world, have confronted transaction hazards of uncertainty, asset specificity, information asymmetry, and contract incompleteness. Drawing from contracting theories, this article takes a holistic approach to identifying eight governance mechanisms to address transaction hazards: cognition and flexibility for uncertainty, safeguards and credibility for asset specificity, transparency and competition for information asymmetry, and reputation and trust for contract incompleteness. We then conduct a comparative study of two PPP power projects, one successful in China and the other failed in India, to illustrate how governance mechanisms function to address those transaction hazards. Among eight governance mechanisms, flexibility, credibility, and competition are especially critical to determine the success or failure of PPP projects.

Abstract:Public private partnerships (PPPs) have gained widespread adoption as an innovative way of procuring public infrastructure projects over the last two decades. Risk identification, assessment, and allocation have received considerable attention from researchers due to the risk heavy nature of PPP projects. Adoption of PPPs has triggered a sudden increase in research interest in the area in recent years. This study attempts to provide an updated systematic review of literature related to risks in PPPs using a PRISMA flowchart. The results of the study offer some valuable insights into the future and current state of research. The study found that the focus of research on PPPs has shifted from an overall risk identification and assessment approach to individual risk analysis. Moreover, this research trend is on the rise in developing countries, and that quantitative methods for risk management in PPP research and qualitative methods in practice are preferred. In developed economies, due to negative public sentiments, transparency concerns, and arguments of value for money not being achieved, PPPs are becoming less popular. For these reasons a shift to availability-based payment mechanisms such as in Design-Build-Finance-Maintain (DBFM) from traditional revenue-based mechanisms as in Build-Operate-Transfer (BOT) has been observed. These shifts in research trends and practice offer researchers future opportunities to investigate these relatively newer approaches.

Abstract:As an important part of market-based reforms, the issue of "risk" has always been a part of the public–private partnership (PPP) debate, and the way in which risks are managed determines the sustainability of market-based reforms. This study systematically examines how the institutional environment and institutional arrangements affect the effectiveness of PPP risk identification and allocation. The study aims to establish a multi-source database of all publicized PPP projects in 31 provinces during the period of 2017–2021 in China, and it incorporates different levels of influencing factors, such as the institutional environment and institutional arrangements, into a framework. Through the application of a multilevel model, the impact of the political–institutional structure at the provincial level and institutional arrangements at the social capital and project levels on PPP risk identification and allocation is judged hierarchically. It is found that only social capital at the institutional environment level can directly and positively contribute to the effective identification and allocation of PPP risks, while both the degree of potential market competition and the degree of integration at the project level have a positive effect on its risk profile. In addition, there are cross-level moderating effects, with social capital, government transparency, and government–business relations positively improving risk allocation and identification through the degree of market competition, with no significant coordinating effect on the degree of contractual integration. This study goes beyond the existing one-dimensional risk profile analysis and risk typology to dismantle the "black box" of risk identification and allocation, which is a process of continuous negotiation, and to provide a sustainable governance mechanism for the market-oriented reform of public services in the institutional arena.

Abstract:Through case studies,this paper identifies the features and hidden dangers of Public Private Partnerships(PPP)model regarding to increasing power rent-seeking,long-term,high-uncertainty and incomplete contract,and heavy reliance on professionalism of consultancies. Since legal and contractual binding force have a lag in dealing with these problems,establishing and implementing a code of PPP professional ethics for PPP participants including public officers,consultants and lawyers,and investors can act as a moreflexible and supplemental regulatory mechanism. This paper further reviews and compares ethics codes set by four representative international professional bodies relevant to construction management,and elaborates the essential elements of professional ethics for participants. In the end,proposes recommendations on the institutional construction of PPP professional ethics.

Abstract:AbstractDuring the past decades in China, the traditional state monopoly has experienced difficulties in meeting the huge demand for new infrastructure and improvement in service levels, engendering the growth of different forms and degrees of private sector involvement. Since the 1990s, China has started experimenting with the public-private partnership (PPP) delivery method in the water supply sector. However, many problems stemming from unsuccessful risk management have been encountered in PPP applications that have eventually led to project failure.
