According to the current creativity capacity of intellectual property in China, the whole intellectual property domain can be divided four parts: strong-important domain, weak-important domain, weak-common domain and strong-common domain. Accordingly, there are four strategy: offensive strategy, break-through strategy, defensive strategy and development strategy.

Abstract:Many studies agree that a weak intellectual property right (IPR) legal system likely reduces innovation or creation; they also predict that increasing intellectual properties (IPs) in developing countries will automatically lead to local needs for stronger formal protection. However, the situation is found to be more complex in China. With a focus on the use of IPs and relevant protection mechanisms in China, this study points out that many companies acquire IPs for purposes that do not depend on their enforcement; many companies have informal ways of protecting their IPs without resorting to court enforcement. Both the alternative functions and the alternative enforcement mechanisms are shaped by industrial characteristics, especially in four aspects: technological features, administrative regulation, market characteristics, and network structure. Based on studies of different industrial sectors in China, this article develops a general framework for analyzing the role of IPRs in industrial practice.

Abstract:Intangible cultural heritage (ICH) is an invaluable treasure for human being and China is a country endowed with rich ICH. Among all the measures of safeguarding ICH, intellectual property (IP) tools are effective while controversial. As China started relatively late in the legal protection of ICH, the gap between legislation and judiciary needs to be filled in. This study examines the IP protection of ICH in China based on the current laws and regulations and then provides a semiotic approach to the relevant legal evolution in China. This study, taking in some experiences outside China, goes further to provide recommendations for improving the IP protection in China.

Abstract:With the continuous development and innovation of science and technology in the current era, at this point, artificial intelligence has been able to generate all kinds of "works" like human beings, which has produced many new intellectual property legal issues in the field of artificial intelligence, which also put forward new legal challenges for its protection. What kind of protection should be given to artificial intelligence products, its copyright, the ownership of the rights of products is the issue of this paper. At present, the author believes that two preconditions should be made clear: first, the "works" of artificial intelligence products are regarded as copyright-protected works from its legal qualitative understanding; Second, the copyright of AI products should be owned by AI investors and users. On this basis, relevant legal protection mechanisms should be established to reduce legal disputes caused by artificial intelligence products.

Abstract:As an intangible heritage of humanity,protection of exorcise has a great historical and practical significance,but its status is worrisome.Beginning with the status of exorcise dance,this article discusses the necessary of protecting it by IP rights and the insufficiency which exists in IP rights protection.In view of the flaw of exorcism which exists in the IP rights protection,the article comes up with countermeasures from the trademark law,the copyright law,the patent law,the domain name and so on.The author wants to find a good solution to solve the problem which exists in the protection of exorcism from the intellectual property rights law to make a positive contribution for its exploration and economic use to enable the exorcism which is called living fossil of dance to maintain and develop.

Abstract:With the development of network technology, "balance of interests" become a new topic of China' s intellectual property field. Really, there is a problem of a balance of interests between the author and the public. There is only the question of infringement and upholding copyrights between the author and the pirate. The author' s interest is in accordance with the public' s in essence. In order to conceal the true features of infringement, network pirates always disguise themselves as the representatives of public interest, so as to confuse black and white and to get the illegal gains. Attacking network piracies is favorable to keep the balance of interests between the author and the public and to further the prosperity of works.

Abstract:Artificial intelligence technology is booming in the digital economy era. In view of the legal attributes of the subject and object of artificial intelligence, there have been many controversies in the theoretical and academic circles. For example, some scholars advocate that products involving artificial intelligence ought to be covered under copyright from the standpoint of "objectivism". However, some scholars think that copyright protection should not be given to them from the perspective of "subjectivism". The copyright ownership of artificial intelligence products is currently debated in three mainstream theories: "producer theory", "creator theory" and "user theory". In fact, the "user theory" is more reasonable from three aspects: the composition characteristics of works, the social significance of legal protection and the principle of unity of rights and obligations. Therefore, at the institutional level, we should try to clarify the status of artificial intelligence products and the copyright subject of artificial intelligence products is artificial intelligence users, in order to achieve legal protection, an artificial intelligence declaration system must be established.

Based on the common understanding that the patent examination system in effect has its defects, most current researches focus on criticism of the system, while a practical scheme to improve the examination system seems hopeless so far. Abstract:The rapid development of artificial intelligence inevitably poses an impact on the old legal system, while in the field of intellectual property, the copyright differences caused by artificial intelligence creations are more violent and urgent. In practice, there is a great disagreement on whether artificial intelligence creations belong to the object of copyright, and the debate on the subject of copyright is more intense. Starting from the purpose and object of copyright protection, the traditional concept of a work has been greatly revised, and “ideological” is no longer an important criterion for the originality of a work. Starting from the dichotomy of “thought” and “expression,” artificial intelligence already possesses “ingenuity” in creations, and the development of artificial intelligence also requires copyright protection of its creations. Compared with other entities, investors and transferees as capital contributors need more copyright protection in the early stage of industrial development, and they should also bear the relevant responsibilities in the process of creation of works.

A comprehensive literature review and legal analysis, coupled with a comparative study of AI and IP regulatory frameworks, informs the discussion. We explore the privacy and data protection issues in AI, the evolving nature of Intellectual Property rights in the AI era, and the liability concerns related to AI applications. A comparative analysis of AI and IP regulation across various jurisdictions provides insights into the effectiveness of international frameworks and the challenges posed by cross-border regulation. The article further discusses the need for flexible and adaptive regulatory approaches that balance risk management with innovation promotion. We then highlight emerging legal and regulatory issues in AI and IP and offer recommendations for policymakers, regulators, and AI developers. It is based on the traditional intellectual property rights such as copyright and industrial property, and broadens the intellectual property rights in the network environment to include areas such as databases, multimedia, electronic copyrights and computer software. This not only greatly enriches the scope of intellectual property rights, but also intensifies the risk of intellectual property infringement. In the context of the network economy, intellectual property protection faces new challenges and requirements. It has also attracted great attention from countries and international intellectual property organisations. They have conducted in-depth studies on the problems faced by intellectual property rights in the era of network economy and actively sought effective solutions to establish a complete and systematic intellectual property rights protection system to alleviate the pressure on intellectual property rights protection brought about by the complexity of the situation.
