Abstract:Intellectual property strategy of one country should vary with the importance of intellectual property domain and the creativity of intellectual property. According to the current creativity capacity of intellectual property in China, the whole intellectual property domain can be divided four parts: strong-important domain, weak-important domain, weak-common domain and strong-common domain. Accordingly, there are four strategy: offensive strategy, break-through strategy, defensive strategy and development strategy.

Abstract:Intangible cultural heritage (ICH) is an invaluable treasure for human being and China is a country endowed with rich ICH. Among all the measures of safeguarding ICH, intellectual property (IP) tools are effective while controversial. As China started relatively late in the legal protection of ICH, the gap between legislation and judiciary needs to be filled in. This study examines the IP protection of ICH in China based on the current laws and regulations and then provides a semiotic approach to the relevant legal evolution in China. This study, taking in some experiences outside China, goes further to provide recommendations for improving the IP protection in China.

Abstract:Many studies agree that a weak intellectual property right (IPR) legal system likely reduces innovation or creation; they also predict that increasing intellectual properties (IPs) in developing countries will automatically lead to local needs for stronger formal protection. However, the situation is found to be more complex in China. With a focus on the use of IPs and relevant protection mechanisms in China, this study points out that many companies acquire IPs for purposes that do not depend on their enforcement; many companies have informal ways of protecting their IPs without resorting to court enforcement. Both the alternative functions and the alternative enforcement mechanisms are shaped by industrial characteristics, especially in four aspects: technological features, administrative regulation, market characteristics, and network structure. Based on studies of different industrial sectors in China, this article develops a general framework for analyzing the role of IPRs in industrial practice.

Abstract:The traditional cultures passed down through generations among various ethnic groups around the world constitute intangible cultural heritage. This heritage is closely tied to the cultural spaces and expressions of people's lives, bearing a myriad of traditional cultures. However, under the influence of rapid globalization and comprehensive digitalization, the ecological environment of intangible cultural heritage in China has undergone significant changes, challenging the inherent protection models of intangible cultural heritage. Due to the current inadequacy of related laws in China, there are many flaws in the legal protection of intangible cultural heritage. Therefore, by exploring the significance, characteristics, and issues related to the legal protection of intangible cultural heritage in China, corresponding measures and solutions are proposed to address the problems encountered in practice.

Abstract:While the intellectual property(IP) system has evolved to be an important intangible property system in China for about thirty years since its initiation with the Reform and Openning-up Policy in 1978,but its impact and function have not been well assessed.Statistical data and econometric analysis indicate that the IP system,including patent,trademark and copyright,has been playing well in its institutional function,notwithstanding the problems that need to be dealt with are still serious,including the difficult enforcement of the IP rights.The objective assessment of the IP system is also the basis for the diplomatic strategies involving IP rights.For shifting from a comparatively passive position to a more positive role,China shall,among others,maintain fair confidence,get rid of inferiority complex,and take active and defensive measures when necessary.By preventing the irratoinal policies and foreign interference,and respecting for its intrinsic logic,the IP system of China will hopefully develop into a better one.

Abstract:From the point of view of the structure of "Ideas-IP-IPRs", the essential attributes of IPRs are both non-materiality of intellectual property, which is the object of IPRs, and informationality of the ideas which intellectual property conveys. These attributes make IPRs have a rigth attribute, i.e.the second-order of right, which is different from the right attribute of jus ad rem. The second-order of IPRs determines that the right of claim of IPRs has priority in the remedy system of IPRs.

Abstract:With the development of globalization, intangible cultural heritage (ICH) has come under increasing threat, making the safeguarding of ICH a crucial task for the governments and peoples of the world. This paper examines China’s current state of intellectual property (IPR) protection for ICH and proposes that ICH be placed under China’s legislative protection as intellectual property. Due to the immense diversity and complexity of ICH and the difficulty in reconciling various interests involved, the existing IPR protection mode faces many obstacles in practice. We present two case studies and three sets of recommendations on improving the protection of ICH in China. The first set relies on improving copyright protection for ICH, the second set relies on improving trademark and geographical protection for ICH, and the third set relies on improving patent protection for ICH.

Abstract:Intellectual property (IP) significantly influences the construction industry, which thrives on innovation to meet the escalating demands for environmental sustainability, energy efficiency, and project uniqueness. This article elaborates on the critical role of IP in enhancing the market value and competitive edge of construction companies, alongside a detailed exploration of various IP forms prevalent in this industry, including patents, copyrights, trademarks, and trade secrets. The narrative underscores the essential role of patents, which protect technical innovations such as new building materials and construction technologies that offer improved thermal insulation, durability, and even self-healing properties. These patents safeguard the inventor's rights and fortify the company's market position by enabling a temporary monopoly on innovative products. Copyrights are highlighted as vital for protecting architectural designs and project management methodologies. These legal tools ensure that the artistic expressions and unique designs remain exclusive to the creator, thus fostering a culture of innovation and protecting the economic interests of the designers. Trademarks are discussed in the context of their importance in branding, significantly impacting a company's image by distinguishing it from competitors. The article also emphasises the strategic importance of managing IP effectively, noting that companies with a robust IP portfolio are more likely to attract investment and less likely to encounter financial instability. This management involves protecting innovations from competitors and leveraging these assets to secure financial resources and explore new market opportunities. Furthermore, the article advocates adopting comprehensive IP management strategies to ensure long-term business growth and success. Effective IP management is presented to navigate the competitive and challenging landscape of the construction industry, highlighting the potential of IP assets to drive innovation, attract investments, and enhance the overall market value of the companies involved.
