Abstract:Personnel dispute arbitration system is a kind of new procedural system in China, which mainly deals with the disputes raised by resignation and dismissal between the public institution and its staff. There are still lots of obstacles in the operation of this system, such as the confusion in the labor dispute arbitration and the absence of substantial law in the personnel system. However, the defects in personnel dispute arbitration do not mean that this system has no valuein procedure. This system should be used to solve the disputes between public servants, including state functionaries and staffs of the institution post-reform and the organizations they belong to, and promote the reform and legalization of the institution in China through the operation of personnel dispute arbitration.

Abstract:Legal textbooks are the primary carrier of the disciplinary system, academic system, and discourse system of law. They systematically present and reflect the development achievements of the disciplinary system, academic system, and discourse system of law, and directly determine the overall structural arrangement and priorities of law teaching. Overall, the dichotomization of legal textbooks into the sub-systems of basic law and departmental law has lagged behind the progress on socialist rule of law with Chinese characteristics, and the system of textbooks relying on this traditional academic division is also in need of further improvement and reform. “Law-related,” “jurisprudence-related,” and “rule-of-law-related,” the three relatively independent but closely linked sub-systems of legal textbooks can better reflect the current evolution of the rule of law system in China. China’ s legal textbook system should be improved in terms of promoting the development of the main textbooks on law, vigorously promoting the development of textbooks on emerging disciplines and inter-disciplinarity, and courageously innovating the content and form of textbooks.

Abstract:Arbitration of labour disputes, as an important way to protect the rights and interests of workers, aims to achieve better resolution of labour disputes and maintenance of labour relations through the front-loading of arbitration of labour disputes. With the continuous development of the society, labour dispute disputes are increasing, and the procedural rights and interests of workers in labour dispute arbitration are also more and more prominent. Based on this problem, China needs to carry out a series of reforms to the labour dispute arbitration system, to fill the gaps in the existing legal regulations, and to propose a series of targeted measures for the difficulties encountered by workers in labour dispute arbitration.

Abstract:There exist the following serious problem concerning the establishment of the arbitration institution in the current arbitration legal system of China:the provisions on the establishment of arbitration organization in the Arbitration Law are short of social basis and legal foundations,which shakes the footstone of arbitration system-nature of neutrality and nongovernmental feature.Therefore,according to the historical causes for the development of arbitration system,the nature of arbitration and China's realities,the instauration of an arbitration organization shall be under the guidance of the legislatures instead of that of the administrative organs to avoid administrative intervention.

Abstract:Under the background of social change and the great development of "Belt and Road" policy, China's international commercial arbitration is facing a higher level of development needs. In order to solve the existing problems, draw on the experience of the world's advanced international arbitration centers, improve the concept of arbitration, and improve the level of arbitration services, China should take the goal of building a China international commercial arbitration center comparable to the world-class level, and constantly explore the development path of arbitration. This paper analyzes the present situation and trend of international commercial arbitration in China, discusses the connotation and value of China international commercial arbitration center, put forward from government relations, institutional development, system architecture, modernization can assign four aspects to improve the arbitration center construction scheme, and innovatively put forward the horizontal and vertical two lines and special assigned to the development of the framework. Accordingly, China's international commercial arbitration system should be continuously improved, the credibility and discourse power of China's international commercial arbitration should be enhanced, and China should build an international arbitration brand with Chinese characteristics.

Abstract:In recent years, the establishment of Regional Trade Agreements （RTA） has been an intense competition waiting for no country. China raised RTA to the level of national strategy as a clear response to the current status of the international trading system. Based on the analysis of dispute settlement systems under various RTA frameworks, this paper discusses both theoretical and practical aspects of RTA dispute settlement mechanisms, highlights and analyses the contrast between the important systemic role and the low effectiveness of RTA dispute settlement. On this basis, it further explores the reasons leading to such contrast, and makes policy suggestions to China for the establishment of its RTA dispute settlement system.

Abstract:The current administrative reconsideration procedures are over internal-administrative and over-simplified under the orientation of anti-judicial,and it lacks basic system elements of procedural justice,which is not conducive to the just resolution of administrative disputes.The view of administrative reconsideration's judicial orientation is not equal to copy the judicial process completely,but the key is introducing the basic elements of procedural justice to administrative reconsideration,and to establish the basic principles of fair procedure,in order to protect the procedural rights of the applicants effectively.On the basis of the above,administrative reconsideration procedures should be reconstructed including the avoidance system,the public trial system,the oral argument system and the system of reasons to reconsideration decision.

Abstract:The Chinese Arbitration Law of 1995, together with the Civil Procedure Law and other sources of arbitration laws, is served as the legal bases for the Chinese arbitration system. Compared with advanced arbitration systems in the world, there still exist some defects of the Chinese Arbitration Law due to its lack of rich legislative experience and the conservative attitude toward arbitration. However, the Judicial Interpretation by the Supreme Court of China in 1995 makes a progress in Chinese Arbitration Law by strengthening the support to arbitration, but not playing the interventionist role of it.

Review of Public Personnel Administration

Abstract:Despite a consistent task to balance political, managerial, and legal values, China's civil service reform in the past three decades demonstrated a paradigmatic shift from a conflict-oriented to harmony-oriented model. The 2005 Civil Service Law highlighted a legal effort to institutionalize the coexistence of competing values. Such a shift was justified by, besides the changed path of political reform, contextual factors including the convergence of values, the strategy of decoupling, and the validated advantages of a unified system. An examination of the post-2005 developments discloses complex patterns of interaction between values across reform arenas, showing a limit to the harmony-oriented model. Despite its capability to constrain outright conflicts, China's integrated political system faces an urgent demand of institutional capacities to balance the competing values.

Abstract:The selection to set up the right to hold strike is an issue of value evaluation, which can only be assessed in two aspects: (1) value substance, that is strike; (2) value standard, that is social demand and objective. The standard of value is of a historical category, which has distinct contents in dissimilar historic periods and different historic circumstances, and it is affected by such factors as development level of regulations, strike consciousness of laborers. Currently the conditions have not yet been mature for upgrading strike to a Legal Right in our country. In such case, transplanting rashly the institution of right to strike from the West is not in conformity to the reality of our country. Therefore, setting up a legal right to strike should be postponed.
