Abstract:Labor contract law has been full of controversy,it stems from the lack of consensus on some of the basic problems of it.Such as relationship between the labor contract law and the market economy,labor contract law and the reality,labor contract law and common sense,labor contract law and the national responsibility,the flexibility of the labor,the mediation and arbitration of labor dispute,discharge of labor contract,the development and perfection of labor contract law.The above problems are analyzed and cleared in this paper hoping to help the sound and effective implementation of labor contract law.

Abstract:Combining with the contents of Labor Contract Law,the author puts forward some problems in practices,such as the problems of how to rationally set probation period to deal with the problem of evasion in practice,and how to standardize the employer's right to formulate the rules and regulations.These problems are also the outstanding problems in practice.Based on the experiences of the author and foreign countries,the author puts forward his own viewpoints and suggestions that will be benefit to the formulation of this law.

Abstract:Labor Contract Law established development direction of Chinese labor relations in the future,playing an important role in promoting harmonious labor relations.However,there still exist a few imperfections,reflected in unreasonable single-protection principle,the imperfect items about employer’s layoff,the labor dispatch and workers’relief right on non-fixed term labor,etc.The article,based on the above-mentioned imperfections,makes corresponding suggestions to improve the Labor Contract Law to better protect the labor relation harmony.

Analysis on Defects and Improvement of Economic Compensation System in Chinese Labor Contract

Abstract:Chinese labour contract economic compensation system is a feature item in the Labour Law,it shows the protection principle to the labourers.Based on the Labour Law,the Labor Contract Law expands the condition that the labourers get economic compensation from employing units.It adds the rule that the employing units should pay economic compensation when the contract term comes to an end,cancels the time limitation for normal labourer to get economic compensation,and makes upper limit for those high income earners.Obviously,the new law strengthens the unbalanced protection to the labourer.But as a rule,it has some defects and needs to be explored and studied.

Abstract:This paper analyzes the contractual properties of Japanese life-employment and Chinese fixed-employment system in view of implicit contracts theory.Japanese enterprises have their own assets and the surplus controlling power,and they attach importance to form their reputation and cherish it.Employer and employee reach a tacit agreement of life-long employment and the game between them is a repeated one which forms a standard implicit contract.In contrast Chinese state-owned enterprises had no assets,no surplus controlling power,nor reputation of their own.The country signed a permanent employment contract for employee and himself indirectly,so the game was a one time game and the contract was an implicit one with more properties of explicit contract.Their implementing encouraging and constraining mechanism of the two employment system has many differences which explains their completely different economic growth effect.

Abstract:The status of labor in industrial relations depends not only on the completeness of human capital property, but also generally on the strength of human capital property. This property strength consists of individual dimension, structural dimension and institutional and environmental dimension. The combination with different strength or weakness of labor property gives rise to different status of labor and types of Industrial relations. In current China the labor force, especially country workers, are weak in property strength of human capital so that a kind of employer-directed labor relations prevails. It is necessary for the government to take measures increasing human capital investment and reinforcing legal and institution protection for the weak labor force in order to build a harmonious and balanceable labor relation.

Abstract:The PRC Labor Contract Law has aroused great attention from all walks of life since its promulgation. Simultaneously, there have been many controversial opinions concerning the Law, with no unanimous conclusion drawn from it and even with many extremely negative opinions included. Any law may have shortcomings and flaws and then cause side effects just like a medical prescription, and therefore it is unwise to refuse to face up to its problems. However, the positive effect of the law should not be ignored and needs to be objectively evaluated to bring into full play the protective function for discharging.

Abstract:China's new labor law -- Labor Contract Law has been put into practice for over one year. Since its inception, debates have been whirling around the nation, if not the world. In this article, we take an economic perspective to analyze the possible impact of the core item -- open-ended employment contract, and we find that it deals poorly with adverse selection, with moral hazard problems arise, which fails to meet the expectations of law-makers and other parties.

Abstract:Labor conflicts,centering on the distribution of economic benefits,occur more and more frequently nowadays.This makes it necessary to do a normative analysis of the mechanism of the benefit distribution inside enterprise.Under a contract framework,this paper expounds the sources of employment surplus and the necessity for its division.We also analyze not only the logics between the surplus division and the employment efficiency,but the mechanism of interaction and its equilibrium as well.Based on the above,we conclude that the employment surplus is the essential to the existence of employment relation.Dividing the surplus is the intrinsic need to maintain the relation. Furthermore,it may promote enterprise's employment efficiency and have ultimate effects on both enterprise's present performance and its longterm development.

Abstract:Foremost,this article analyzes the employment situation of China’s university students,and the employment impact on China’s college students of "Labor Contract Law".Afterwards,this paper devides the employment impacts into three categories: policy system,organizational system,and incentive systems.Then it establishes the theoretical models by SWOT analysis tools and uses the quality of labor relations,employment,job satisfaction,employment prospects to measure the "Labor Contract Law" on college students job performance of the labor market impact.This research is conductive for university students to fully play the advantages of market allocation,so as to promote the employment and the ability as soon as possible.

Abstract:Under China's contemporary situations,compared to flexible open-ended employment contracts which is signed on the basis of free choice and mutual agreement between labor and capital,mandatory open-ended employment contracts will increase business cost at the same time it is difficult to effectively improve the situation of workers,also it will lead to a different allocation efficiency of labor resources and macro-economic effects.On the other hand,even if business voluntarily adopts open-ended employment contracts,it needs a series of internal and external conditions.Given the current labor contract law on the term of open-ended employment contracts,how to appropriately determine the cost of terminating the contract in order to maintain the relative stability and flexibility of labor contracts,which is a much-needed break problem faced by the academic and operational departments.

Abstract:Based on the unemployment and government intervention theory of John Maynard Keynes, anatomy the employment predicament in our country, analysis found that total quantity contradictory of the employment problems of labor supply and demand in our country, the structural contradiction of obtain employment, the employment of university graduates difficulties, employment difficult and recruitment difficult coexist; The main cause of these problems is the insufficient amount of total surplus labor supply, labor demand and employment structure is not reasonable and too traditional concept of employment. Draw lessons from foreign experience to deal with the unemployment problem, it suggested that to strengthen the government intervention, by improving the worker quality, adjust the industrial structure, set up correct concept of employment and so on measures to solve the employment problem in our country.

Abstract:The paper,based on Chinese dual labor market,constructs a theoretical model to analyze the impacts of Labor Contracts Law in order to integrate the debates from academic,business and public field.The model indicates that,compared with Labor Law,Labor Contracts Law can improve knowledge workers’ efforts,increase knowledge workers’ and knowledge-intensive enterprises’ benefits;however,Labor Contracts Law reduces manual workers’ efforts,decreases labor-intensive enterprises’ benefits.Though Labor Contracts Law increases incumbent manual workers’ payments,it results that more manual workers lose the opportunities to be employed,for employers will reduce manual job positions.Generally speaking,the new law may lead to triple-win in high-end labor market while result in triple-loss in low-end labor market.

On the Application of Chinese Labor Laws in the Foreign-related Labor Dispute

Abstract:The stipulations on the applicable law to foreign-related labor relation in Chinese law are rather simple, and there are conflicts between the existing provisions.Foreign-related labor dispute is mainly governed by the law of country in which the employee carries out his work in performance of contract. In a case where an employee who works in China, dispute regarding his/her labor contract may be governed by Chinese labor and employment laws. However, it is a controversial problem that whether all of the mandatory rules in Chinese labor and employment laws should apply to the labor contract which the place of contract performance is in China. Foreign-related labor contract which the place of contract performance is outside of China may be governed by the foreign labor laws. While the labor standards in foreign law are lower than those in China, it can be directly governed by the mandatory rules in Chinese labor laws.

Abstract:Implementation of Law of the PRC on Employment Contracts puts forward some important topics which need accurate interpretation,key regulation and theoretical innovation. First of all,we should understand and fulfill the purpose of legislation of Law of the PRC on Employment Contracts from the point of view of combining "affirmative protection" and "benefit balance" and realizing the goal of win-win of labor and management. Secondly,the corresponding counter-circumvention measures should be adopted in legislation to be against the phenomenon that some enterprises take circumvention measures and influence the implementation of Law of the PRC on Employment Contracts. Finally,the labor law academia should bring forth theoretical innovation as soon as possible and provide theoretical support and instruction for implementation of Law of the PRC on Employment Contracts.

Abstract:There are some defects about the new provision of labor services dispatching system in the labor contract law: being lack of matched guarantee system in dispatching organization's qualification limit; the provision is ambiguous in respect of joint responsibility between dispatching organization and employer, and lacking definite limit in dispatching deadline. To consummate the system, the legislators should increase the supporting provision of dispatching organization's qualification, distribute the primary and secondary responsibility in joint responsibility between dispatching organization and employer rationally, and define the longest term of dispatching.

Abstract:The research based on theoretical model indicates that Labor Contract Law will bring win-win to knowledge workers and knowledge-intensive firms and loss-loss to manual workers and labor-intensive firms.The reasons why Labor Contract Law is on fierce debate are mainly attributed to its negative influences on low-end labor market;besides,companies' operation plights and workers' employment problems,both of which are associated with the worsen of external economic conditions,have their own subsidiary effects.What's more,the plan for economic transformation is disturbed when those two effects combine.
