Abstract:Constitution stands as normative foundation of the legitimacy of administrative procedure. From the global view, we can find there are three modes to express the legality of administrative procedure in constitution norms: these are "due process of law" ?"legal procedure" and "specified by law". Though our constitution does not provide relative direct normative foundation for the legality of administrative procedure, but we can deduce from the constitution norm of "parties participation" and "government of law", to arrive its logical starting point of the legality of administrative procedure in constitutional norm.

Abstract:Even if the administrative litigation system is not perfect, it is still a strategy selected in the system, by administrative counterparts struggling for their rights. In front of the administrative counterparts who struggle their rights, the difficulties of agency managing social affair have become increasingly prominent. The court, hardly guaranteed the independence in the litigation relationship, often trapped in a kind of embarrassing situations where it cannot help itself. This issue requires us to reflect on the administrative litigation system under the concept of people-oriented idea, so that a good way solving the problem can be found.

Abstract:The Article 1 of The Administrative Procedure Law,as the"soul article"of its legislative purpose,is a barricade when involving modification of The Administrative Procedure Law.The understanding of Article 1 of The Administrative Procedure Law mainly includes the following three different views as claim of protecting rights,claim of maintaining supervision and equilibrium theory.Based on the analysis of these three kinds of views,right relief should be the legislative purpose of administrative lawsuit.So,the modification of The Administrative Procedure Law should abide by the principles such as effectiveness,rights protection and non-loophole rights protection.

Abstract:Dispute solution is a legislative value transformed from civil litigation into the laws applying to actions against administrative agencies’ decisions, which aims at increasing the ability to solve disputes through actions against administration. However, actions from executive decisions have their own unique nature that may intensify the relationship with supervision of power, another feature inherent in the actions from administrative decisions. By way of easing the tension between dispute solution and power supervision, we can see how far the laws can go in performing the function of dispute solution and can demarcate the legitimacy of the compromise in the actions from administrative decisions so as to further ensure the protection of civil rights.

Abstract:The concept of service government has gradually been universal after the high-tide of the western countries' Reinventing Government Movements since 1980. Under the guidance of service idea, administrative organ and other subjects who undertake the administrative tasks determine the forms and types of procedure with discretion in order to accomplish the administrative tasks better. On the one hand, the exercises of procedure discretion make a fuzzy bound between different administrative functions, and also destroy the application premises of the strict principle of legal reservation. In modern administration, intervention administration and supply administration often cooperate with each other perfectly to accomplish the hard administrative tasks flexibly. So it is unadvisable to defend the traditional absolute differentiation between intervention administration and supply administration and to apply the strict principle of legal reservation. On the other hand, the exercises of procedure discretion generate a new phenomenon that several administrative actions achieve one administrative target, which disclose the deficiency of the single administrative action form as the main analytical mean in administrative law. Hence the traditional theory of administrative law, which stereotypes administrative action and then judges its legality according to its constitutive requirements, will obstruct the dynamic administrative process artificially, and will obstruct the court to consider the whole and compound administrative actions comprehensively. To analyze this new type of administrative activity, we should not only abide by the law, but also pay attention to the guidance of the administrative purpose, which requires us to consider the whole administrative process with several administrative actions as dynamic administrative legal relationship, and to explore the compound legal status of administrative organs and other subjects who undertake the administrative tasks and administrative counterparts in interactive and pluralistic relationship. The legality of each administrative action should also be judged in dynamic administrative legal relationship.

Abstract:The academic circles and professional circles have different viewpoint to the function allocating of administrative discretion standard's making.In our opinion,administrative discretion standard is a administrative self-restraint norm,which has features of Rule Doctrine and Administrative Self-restraint contemporaneously.So on the one hand,we should not restrict the power division overly,because it is contrary to discretion standard's essence of Administrative Self-restraint.On the other hand,we should not open the power division to all agencies analogously,because it is also contrary to discretion standard's essence of Rule Doctrine.According to this features,we think the rational point is respecting the essence of Rule Doctrine and Administrative Self-restraint contemporaneously,allocating the power of making discretion standard in a closure range which is from the level of country agency to provincial agency,and making sure the power of discretion standard's making is not legislative.It is just a law enforcement power.

Abstract:The theory for presumed validity of administrative action has never deviated from the administrative law scholars' vision field during the past twenty years' development. However, as regards this imported theory, there have always been two trends among the academics. One is reliance on transplantation in terms of the relationship between transplantation and self-construction. The other is emphasis on principles in terms of the relationship between principles and techniques. Actually, on the value norm, this theory could be renarrated to fit the democratic polity. On the technical norm, its claim that to defy the administrative action with presumed validity may commit the interference with public function could also be supported by the element theory of the action of interference with public function in the criminal law. Therefore, to get rid of the reliance on transplantation and the negligence of technical norms is not only an inevitable road for the rebirth of this theory, but also a direction of further efforts even if we decide to abandon this theory.
