Abstract:There are different opinions on how to deal with the relationship of the liability of defect warranty and the liability for breach of contract in the traditional civil law.Since the reformation of German obligation law in 2002,it has no sense to distinguish between the defect of thing and defect of right.The seller's defect warranty liability of thing and defect warranty liability of right have gradual integration.The relationship of defect warranty liability and the liability for breach of contract becomes general and special.The relationship of defect warranty liability and the liability for breach of contract is different from traditional civil law and German new obligation law in our contract law. Defect warranty liability is a special liability for breach of contract which is based on the general principle of contract law.Its specificity is reflected in remedy and accountability methods.

Abstract:Presumption of fault liability is the imputation principle of medical tort in positive law.There are four different opinions among the academic community in China.Whether the 2nd draft of Tort Law adopts the presumption of fault liability principle is still in dispute.In the author's opinion,the 2nd draft of Tort Law has a problem,i.e.,it doesn't deal with basic fact and presumed fact correctly.In legislation,medical tort should be brought into the criterion system of tort law.The fault liability principle gets a morally depreciating property and leaves a safe district for people's act.Medical tort should take the fault liability principle and presumption of fault as its imputation principle.Damage is the basic fact,and fault is the presumed fact.

Abstract:The development history of the laws for the tort act is somewhat the evolution history of imputation principle.In the early society,result liability principle was applied in order to maintain order.As moral principle was advocated,fault liability principle was adopted in the civil law for torts.Fault liability and no-fault liability have to be combined with each other as a result of rapid development of industry and technology.Nowadays,due to the decline in people′s moral accomplishment and the pursuit of economic interests,the system of negligence offset must be considered that the inflictor and his victim should shoulder their respective responsibilities according to the degree of fault,the cause of damage and so on.As to the serial legal cases of compensation of personal injury of electric shock,power supply enterprises should bear no-fault liability first,on the basis of which the victim should be commensurately liable according to the degree of fault in the course of personal injury.

Abstract:According to the Torts Law Draft of PRC,this paper discourses two fundamental issues-liability principle and liability premise, which is also named the scope of rights protection.Distribution of liability principle should be in accordance with the value basis of fault and danger rather than other values.In terms of rights protection scope,the method of result path should be taken,by defining law-protecting interests class,instead of distinguishing violation of protection law from infringement of absolute rights.The Torts Law Draft of PRC takes fault as main basis of liability principle and danger as basis of liability premise.A dynamic system can be established by interaction of these two sides.

Abstract:The liability imputing principles stipulated in article 6,the no-fault liability in article 7 and the fair liability in article 24 of China's <Tort Liability Law> cannot be applied to stoppage of trespass,removal of jeopardize,returning of property and elimination of influence.Seventh and twenty-fourth articles cannot be applied to apology and restoration of reputation.So types of liability such as stoppage of trespass,removal of jeopardize and elimination of influence can only apply article 21 in order to bring about legal loophole,although it is not the legislative intention and not due to legislative technique.Returning of property can apply article 117 or article 34 or article 245.So,matching relation between imputing principles and types of liability exists only in compensation for the loss,restitution,apology,elimination of influence and restoration of reputation.

Abstract:The traditional liability imputation system of tort law is based on fault liability and danger liability, in which danger liability is considered as an exception to fault liability. The traditional fault liability principle consists of two facets, that is "Where there is fault, there is liability" and "No fault, no liability". However, as the rising of intercourse safety responsibility (Verkehrspflichten), the evolution of fault liability and the expansion of liability without fault, the tort law seems to fall into a state of chaos. Behind the chaotic state, the evolution of liability imputation system of tort law demonstrates that the principle of "No fault, no liability" has been gradually replaced by the rising of risk liability. This fundamental change means that the modern tort law no longer adopts the principle of "casum sentit dominus", but distributes the liability of damage without fault between the parties by deciding who should carry on the risk. The elements of deciding the risk domains includes acquisition of interest, initializing and maintaining risk, reliance, possibility of damage distribution, possibility of self—protection, and so on. In addition, the theory of risk domain has the ability to establish an open and dynamic liability distribution system. In individual cases, it can reach the balance among different elements of considerations. The new dual liability imputation system of modern tort law should consist of fault liability and risk liability, and the risk liability can replace all the liability without fault including the danger liability (Gef(a|¨)hrdungshaftung), liability without fault in intercourse safety responsibility (Verkehrspflichten) and equitable liability. The legislation of risk liability can adopt the mode of combining general provisions with specific types of risk liability.

Abstract:Global limitation of liability is one of the most important concepts in maritime law. The Chinese Maritime Code devoted the whole of its Chapter XI to the concept and, since the Code's adoption in 1993, numerous court cases and supplementary regulations concerning the concept have been added into China's legal resources. In view of all these new developments, this article sets out to critically examine the concept with respect to applicable ships, persons entitled to limit, conduct barring limitation, limitation funds and, in particular, the right to invoke. Based on its different trading areas, China divides its limitation into international, coastal and inland, which is a unique and important feature when compared with many other jurisdictions. In addition to traditional maritime claims, discussion is extended to limitation of liability for oil pollution and nuclear damages.

Abstract:The new Tort Liability Law of the People's Republic of China was finally adopted at the 12th Session of the Standing Committee of the 11th Chinese National People's Congress (NPC) on 26 December 2009 and came into effect on 1 July 2010. Thus a further great step in drafting a new Civil Code has been taken, after the enactment of the Contract Law in 1999 and the Law of Real Rights in 2007. In drafting the new Tort Law, the Chinese lawmakers have taken considerable account of foreign legal systems, but nevertheless it is a Chinese codification with many specific features which are of great interest for European lawyers. In the following the authors provide an overview of the most important provisions. As there exist no published legislative preparatory materials, no explanatory notes and no scholarly commentaries on the new Law, the authors had to overcome considerable difficulties in interpreting the new Law; the outcome is, of course, only a first and unavoidably subjective opinion.

Abstract:Liability Insurance and Tort Law are the most important rules in today's compensation for damage system.They are interactive in development and collaborative in functions.The three basic functions of the modern compensation for damage system are relief,punishment,and prevention.Relief is aimed at the victim,punishment is directed against the perpetrator,and the prevention function is in the light of the whole society.As far as relief is concerned,Liability Insurance is more superior to Tort Law.But there are still some areas that Liability Insurance could not cover.As for punishment,Tort Law functions only when the perpetrator commits intentional torts or has gross negligence,but for general negligence,strict liability,and fair liability,we could see its punishment functions.As to prevention function,these two rules play equal roles.Both can guide people to prevent the accidents.

Abstract:The modern tort law principle,which provides compensation with priority,has changed the character of tort law,making the latter switch its emphasis from personal liability to loss spreading.The tort law,on the one hand,expands itself to strict liability and is influenced by the insurance ideology,on the other hand,the tort law,whose construction must base on the bilateral structure of plaintiff-defendant relationship,still faces such criticism as huge administrative cost,uncertainty and interpersonal unfairness.What's more,its expansion has caused the crisis in the liability insurance market.Confronting the tort law crisis,the moralists have in the few decades made efforts to again justify tort law with theories of corrective justice and social contract.The functionalists also point out that tort law owns the irreplaceable position in loss-prevention.Moreover,it's the essence of the insurance system that limits the scope of its function,as a result,only part of the damages would be compensated.In conclusion,tort law cannot be replaced by insurance system,but there is also neither positivistic nor theoretical justification for the hyper expansion of tort law as today we have.

Abstract:With the enactment of the Tort Liability Law of PRC,the traditional constituent elements theory of tort has trapped into dilemma both in substance and in form.On the substantial level,the traditional theory does not distinguish interests from rights,so could merely solve simple and traditional cases of tort,and seems of less use when confronts complex and modern cases. On the formal level,there exists conflict between the traditional theory and the literal meaning of Paragraph 1,Article 6 of the Torts Liability Law.The traditional theory could not explain the relationship between Paragraph 1,Article 6 and Article 15 of the Tort Liability Law either. Therefore,it is necessary to reconstruct the constituent elements theory of tort according to the literal meaning of Paragraph 1,Article 6.That is,"infringement on right or interest" as provided by this paragraph should be considered as an independent constituent element of tort.As a result,it replaces the element of illegality in function and the element of damage in position.Thus the general constituent elements of tort include act,infringement upon right or interest,causation of liability establishment,and fault.These four elements are the common constituent elements of all kinds of tort liabilities provided by Article 15 of the Tort Liability Law.Meanwhile,compensation for damage,with two additional elements of damage and causation of liability scope,is merely one sort of tort liabilities. In order to apply the element of infringement on right or interest appropriately,it is suggested to introduce the theory of Interrelation which has been generally accepted in Japan.The theory aims to protect rights and interests distinctly,that is,rights and interests of different levels correspond to different standards of fault.To adapt to the function of this element,tort law should adopt a narrow view of right,in which right refers to absolute right with clear extension in the private law,while relative right,frame right and basic right should be classified as interests.

Abstract:Article 1186 of the Civil Code limits the scope of fair liability and effectively prevents the abuse of fair liability. Fair liability has undergone three legislative changes, and there are disputes as to whether fair liability is an independent imputation principle or a liability distribution rule. Through the understanding of Article 1186 of the Civil Code, the applicable scope of fair liability can be better clarified. The Principle of Culpability and Foreseeablity in Negligent Crime

Abstract:The traditional theory of negligent crime does not distinguish the definition of negligence from the imputation of negligent crime, and this has resulted in the confusing position of foreseeablity in the structure of negligent crime. Foreseeability is a category of empirical fact, and it can only influence the judgment of imputation in negligent crime. The factor of foreseeability has a general meaning beyond the field of negligent crime, and it constitutes the threshold of justification for self-responsibility in criminal law. Based on the shift of a person's image from a moral subject to a social subject in the law system, people need to introduce the dimension of society and correspondingly to propose a theory of socialized culpability. According to it, the nature of culpability lies in the deviation of a conduct from the normative expectation of society. The theory of socialized culpability manages to make the concept of culpability in harmony with the aim of criminal punishment. Such a theory is relatively more reasonable, because it considers preventative effects in the teleological meaning, while still keeping the function of limiting the state power of criminal punishment. On the basis of this kind of theoretical framework, the reconstructed theory of foreseeablity could meet the requirement of the culpability principle. In dealing with negligent crime cases in the judicial practice of China, it is necessary to distinguish the cases involving the problem of foreseeablity from those involving the others in negligent crime.
