Freedom and Harmony:Restrictions on the Exertion of Real Property Rights within the Framework of Private Law

Abstract:The major purpose and mission of private law is to protect private property rights in general and the real property rights in particular.In modern society,property rights entail social responsibility,so it is generally agreed that the exertion of the property rights should be under certain restrictions.Therefore,when protecting people's freedom of exerting private property rights,the private laws of different countries tend to strengthen their restrictions on the exercise of poverty rights,especially real property rights.The restrictions,however,should be imposed under a series of principles:among others,the citizen's exertion of his or her property rights should avoid abuse of rights,facilitate social order,be in line with social norms and conditions,and fulfill the duty to be tolerant.Only when the freedom of exerting one's rights is under appropriate restrictions can a balance be achieved between different interest subjects in a society,and social justice and harmony be eventually attained.
