Abstract:Legal rules is a kind of prescriptive rules that is the reason of action. There are two kinds reasons: first-order reasons and second-order reasons. The former is all thing considered, and the latter is on the contrary. Because the legal rules are second-order reasons, legal reasoning is reasoning with rules. But, since rules defected in its justification, moral reasons, as first-order reasons, will take the place of rules in that circumstance.
