Abstract:In contrast with legitimate expectation in the UK and European Community, Article 8 of the Administrative Licence Law in the PRC provides a more objective and effective substantive protection.However,there is lack of procedural protection,and the compensation protection is too abstract and vague.

Abstract:"Administrative Litigation Law" endows people's courts with judicial review of consulting rules when hearing administrative cases. The "refusal to apply rules" in No. 5 guiding case is regarded as the transformation from the doctrine of individual refusal to apply rules to that of universal refusal. That is to say, courts have been authorized to declare rules void. In other words, the case expended the judicial review. According to the hierarchy of legal force established by "Legislation Law", courts should determine first whether the law of lower level contradicts the law of higher level before refusing to apply rules. The standards to determine contradiction are as follows. In the relationship between rights and obligations, contradiction occurs when rights laid down in the law of higher level are restricted or deprived by the law of lower level, and when obligations laid down in the law of higher level are expanded or added by the law of lower level. In the relationship between powers and duties, contradiction occurs when powers laid down in the law of higher level are expanded or added by the law of lower level, and when duties laid down in the law of higher level are exempted by the law of lower level.

Abstract:The Article 1 of The Administrative Procedure Law,as the"soul article"of its legislative purpose,is a barricade when involving modification of The Administrative Procedure Law.The understanding of Article 1 of The Administrative Procedure Law mainly includes the following three different views as claim of protecting rights,claim of maintaining supervision and equilibrium theory.Based on the analysis of these three kinds of views,right relief should be the legislative purpose of administrative lawsuit.So,the modification of The Administrative Procedure Law should abide by the principles such as effectiveness,rights protection and non-loophole rights protection.
The Boundary of “Collecting Mistakes Whenever Discovered”

Abstract:Due to the joint efforts made by the scholars of administrative law over the past two decades,theoretical frame on determination of administrative decision and revocation of rules has become more mature. The contents of this theoretical frame is that if any mistakes is found in an administrative act that has been established, the administrative organ should follow relevant rescinding rules rather than the principle of "collecting mistakes whenever discovered". However, according to administrative judgments and official replies and answers issued by the Supreme People’s Court, it is clear that the Supreme People’s Court insisted on the principle of "collecting mistakes whenever discovered" rather than was influenced by the theoretical frame mentioned earlier. The Court does not alter its view until the case of Jiao Zhigang was published as a guiding case on the Supreme People’s Court Gazette. According to the judgment of the case of Jiao Zhigang, once an administrative act has been legally made and come into force, the administrative act cannot be withdrawn at will, it is binding not only on the affected person(s), but also on the administrative organ itself. However, the relevant judgments made by the courts at various levels show that the case of Jiao Zhigang has not been frequently referred to in the judgments, and the principle of "collecting mistakes whenever discovered" is still deeply rooted. It is possibly because the guiding cases are lacking in practical value and statutory tradition. However, the rules made in the case of Jiao Zhigang are still valuable, and its value has not only represented the impact of the theory on the decisions by the courts, but also acted as a sign of the development of the idea of rule of law.

Abstract:Drawing from courtroom discourses in the petition office of a Chinese court, this article analyses an emerging politicised legal discourse, deployed by judges to accommodate petitioners. Embedded in the political context of contemporary China, this discourse reconciles the tensions between the rule of law policy and the stability maintenance concerns and enforces the official perspective of legality. To construct a "lawful" claim and relieve petitioners with reference to the law, petitioners are diverted to exhaust routine legal proceedings and to pursue retrials, most of which end up fruitless. In this process of legality construction, petitioners' resistance against the official discourse dominance is defined as unlawful or even criminalised, and their voicing of grievances is oppressed. The findings and analysis shed light on how the law matters to the management of popular resistance in authoritarian regimes.
Environmental Policy and Compensation in China: An Empirical Analysis of Article Eight of the Chinese Administrative License Law

Abstract:In the past few years, China has implemented environmental policies that negatively affected the property interests of numerous private enterprises. This article offers the first systematic analysis of how China compensates enterprises for losses caused by the implementation of environmental laws and policies. It generates descriptive statistics on the characteristics of the compensation cases and finds that in a majority of the cases, the court allowed the government to set compensation below the value of the enterprise's investment. Statistics also show that China offers weaker protection for private enterprises against newly adopted environmental policies compared to other types of rules or policies, allowing the government to close highly polluting enterprises with relatively low compensation. This article then offers an explanation of the courts' approach and considers whether Chinese courts achieve an appropriate balance between property protection and policy flexibility.

Abstract:After more than a decade of preparation, China finally passed the Anti-Monopoly Law (AML) on 30 August 2007. This paper examines the debate over whether or not administrative monopoly should be included in the ambit of the AML, which took place throughout the drafting process of this new law. Administrative monopoly refers to the abusive use of administrative power by government agencies to engage in monopolistic activities. Owing to the administrative nature of this type of monopoly, the intent to regulate it by an economic law, such as the AML, has stirred up much controversy. Having analyzed the arguments both in support of and in opposition to the inclusion, this paper suggests the need to adopt a more comprehensive scheme in tackling administrative monopoly. Also, the enforcement mechanism of the AML will have to be strengthened in order to prevent this new law from degenerating into ‘a toothless tiger’. Furthermore, the competition law regime of China will benefit from in-depth research in overseas anti-monopoly practices. In particular, the experiences of the former socialist states in Europe should be taken into account, given that they are similarly undergoing the transition from a planned economy to a market economy.

Abstract:The withdrawal and repealing of administrative license,stipulated in article 8 and 69 of Administrative License Law,shows vividly the principle of trust protection in administrative law.According to the principle,administrative units must evaluate all the relations of interests involved in administrative license before making the decision of withdrawal or repealing and compensations can be resulted from the withdrawal or repealing only when the protection can't be maintained to the licensed person.Concerning the actual conditions,the withdrawal and repealing procedure is still blank and needs to be improved.

Abstract:ABSTRACT An important focus of China’s Anti-Monopoly Law (AML) is “administrative monopolies”—government-imposed restraints on competition. Since adopting the AML in 2008, China gradually has strengthened its efforts to curb administrative monopolies. Despite notable reforms such as the creation of the Fair Competition Review System (FCRS), government restrictions remain a major obstacle to competition in China’s economy. The 2008 legislation narrowly defined what constitutes improper government intervention, adopted a permissive standard for determining when public restraints were legitimate, and relied heavily on internal administrative controls to correct infringements. This paper draws upon experience in China and abroad to enhance the ability of China’s competition authorities to challenge administrative monopolies. Suggested upgrades include augmenting the robustness of FCRS, introducing new tools to improve competition advocacy, bolstering the ability of competition authorities to initiate or join litigation to attack administrative monopolies, and narrowing the range of justifications that can immunize public restraints.

Abstract:Through the analysis on three typical cases, it is believed why courts rarely make judgments directly based on the review criteria of “abuse of power” pursuant to article 54 of the Administrative Litigation Law is mostly that the relevant legal provisions are not clear. Besides, in hearings, judges are more inclined to use “conversion techniques”. Meanwhile, it is further revealed of the issues existing in the substantive review of courts.

Abstract:This article analyzes three cases,especially Yi Min Company case in the Supreme Court Gazette.By using the theory of legitimate expectation as an analytical method,this article highlights that,in the traditional administrative remedy regime,the doctrine of trust protection could only improve the justification of decision rather than enlarge the scope and extent of remedy.The introduction of legitimate expectation,however,will improve the due process and will promote the fair decision-making.

Abstract:The social credit punishments have various forms that involve public entities and private actors as well,which are embedded in the joint punishment mechanism,and mostly based on non-legislative rules as the direct basis.Regarding the issue of the litigability of the social credit punishments in administrative litigation,it is necessary to remove the shackles of the doctrine of qualified defendants,and use an analysis framework with a combination of formalistic institution approach,substantive function approach and taking into consideration of the structural arrangements of a specific legal system to discern whether the punishment in question is an action of public administration.And then given that the joint punishments usually constitute a multi-stages administrative procedure or multiple administrative actions,there should be more targeted interpretation and application of the doctrines of "action that have no actual impact" "internal action", "procedural action" and "inheritance of illegality of action".

Abstract:Previous research examined Chinese tax administration based on the perception of the lack of the rule of law, and the situation of a low rate of tax litigation in China is interpreted as a result of non-rule-based administration. This article, by looking at large enterprises' tax administration in China, establishes that the relatively harmonious relationship between taxpayers and tax authorities is a result of the implementation of preventive tax policies, in particular, a combination of incentives, punishment and respectful treatment of taxpayers. The Chinese government also adopts new legal measures and constraints to improve the legitimacy and fairness of tax administrative work. This article reflects the progress made in China in pursuit of the target of 'governing the country in accordance with law' (i.e. the rule by law) and indicates the potential in further developing the rule of law with Chinese hallmarks.

Abstract:Administrative license is closely related to validity judgments on civil juristic acts. In terms of civil law, an administrative organ, under administrative license, allows citizens, legal persons or other organizations to engage in specific activities. Some of these activities fall under approved factual acts; some are approved civil juristic acts; and some depend on the particular situation, sometimes belonging to factual acts, sometimes to civil juristic acts. Correspondingly, some provisions for administrative license found in law or administrative regulations are mandatory provisions falling under simple norms; some are mandatory provisions falling under complex norms; and some depend on the particular situation, sometimes belonging to the former and sometimes to the latter. Where a party intends to rule out the application of such mandatory provisions by virtue of agreement on the intent of the civil juristic act, Article 153 (2) of the Civil Code of the People's Republic of China shall be cited to hold that the agreement is absolutely invalid. Where the civil juristic act of a party violates mandatory provisions falling under complex norms, Article 153 (1) of the Civil Code of the People's Republic of China shall be invoked to judge its validity.

Abstract:With the rapid development of Internet technology and business model innovation, new network services such as the small program platform and cloud server in our country develop rapidly. However, there are many problems in the judicial practice of the platform that violates the «Notice-and-Takedown» obligation in the new network service. The correct understanding and flexible application of the «Notice-and-Takedown» rule is the necessary meaning of the new online service platform trading services in accordance with the Tort Liability Law of the People’s. In order to balance the interests between Internet service providers and right holders, the legal positioning of «Notice-and-Takedown» rule should be clearly defined in the application of law, so as to correctly apply it as an exemption clause. At the same time, when Internet infringement cases occur, the «necessary measures» that Internet service providers should take should be properly determined according to the specific circumstances. Specifically, the application of the «Notice-and-Takedown» rule to the new network service can be solved by clarifying the disclaimer attribute of the «Notice-and-Takedown» rule, taking the «transfer notice» as an implementable necessary measure and requiring the new network service provider to disclose the information of specific developers when necessary.
Difficulty in Filing a Lawsuit: Thinking on a "Chinese Issue"

Abstract:This thesis analyzes the long—discussed issue of "difficulty in filing a lawsuit" in the area of civil procedure. This issue does not refer to the situation that the court cannot accept and hear a case due to its inconformity with relevant laws. It mainly refers to the situation that the court, considering some external factors, refuses to accept some cases which conform to the required conditions stipulated in laws, regulations and judicial interpretations. This thesis points out that one main reason of this issue is the judicial policy of our country which overcomes law. The judicial policy represents itself in civil jurisdiction as restriction and negativity. It means that judicial policy always restricts the acceptance of cases which are in line with the suing conditions. The court will restrict the acceptance of some cases, such as cases of illegal fund raising, infringement due to false information disclosed by listed company, bankruptcy disputes, tainted milk tort disputes, indemnification due to natural disaster such as earthquake, as well as cases that involve sensitive social, political and economic issues. The reasons for the restriction include the specialty of rule of law in our real Society, the limited judicial system and judicial capacity under the specified power structure, the limited regulating scope and function of existing law, and pragmatism, relativism and particularism in consciousness and methodology. In the reality of China, such adjustment by judicial policy is relative ly reasonable, for some controversies which concern legal disputes actually involve political and other social factors, which cannot be independently handled and solved by judicial departments. In our country, the influence of adjustment and regulation by law is very limited, and numerous social relations are regulated by administrative and policy—based rules. The status of judicial departments decides that they lack the capability of judging independently. However, the adjustment by judicial policy which overcomes law also bears high cost. It will obviously jeopardize the authority of law, and even sacrifice public's faith and dependence on rule of law. The author believes that in the background of social transformation including the transformation of rule of law, the judicial policy restriction on filing a lawsuit would be limited gradually and finally terminated.

Abstract:This paper dwells on the comparative law basis and theoretical basis that the intellectual property administrative law enforcement should be strictly restricted,which is on the background of the latest revision of the three main intellectual property laws in our country and the perspective of the expansion trends of intellectual property administrative law enforcement in the latest revision.Focusing on the latest revision of intellectual property laws in our country,this paper not only points out the drawbacks in reference to the current revision drafts from both the views of theory and practice,but also provides suggestions for the subsequent revision of intellectual property laws.Intellectual property administrative law enforcement is an important part of the administrative protection of intellectual property rights.Being different from the administrative management and the administrative service,it is the distinctive contents of the intellectual property legal system of our country,which consists of administrative handling and administrative disposal.Recently,our country's three main intellectual property laws are being revised,and the expansion trends of intellectual property administrative law enforcement is rather obvious.However,whether considering from the perspective of comparative law studies,or from the unique nature of intellectual property rights,the cost-benefit analysis of law and economics,the transformation of service-oriented government functions,the expansion nature of executive power,and the change of social conditions,the intellectual property administrative law enforcement should be strictly restricted.As to the comparative law perspective,the administrative protection in other countries is mainly reflected on the administrative management and the administrative service,with few contents about intellectual property administrative law enforcement.And even if there exist something relevant,the powers of the executive branch of government are never as heavy as in our country.As to the unique nature of intellectual property rights,intellectual property rights are private rights,and the majority of the intellectual property rights disputes belong to the pure civil disputes between civil subjects,so executive power should stick to the principle of moderation and should not interfere arbitrarily.The public right nature of intellectual property rights also requests the restriction to administrative law enforcement.As to the cost-benefit analysis of law and economics,the administrative law enforcement is not dominant on cost saving and efficiency increase when compared to judicial litigation.As to the transformation of serviceoriented government functions,the government administrative system reform emphasizes the transformation of government functions,which means from the omnipotent government to the limited government and the service government,so the administrative organization should provide more service for the public rather than intervene the disputes of civil subjects through the methods of administrative law enforcement.As to the expansion nature of executive power,it has the characteristics of expansion and perishes ability,so it should be restrained in a reasonable range.As to the change of social conditions,the emergence and existence of administrative law enforcement has its certain historical conditions,which has changed now,and the construction objective of the rule of law society also requires the check and balance between authority.So it is necessary to restrict the administrative law enforcement.However,it is undeniable that the administrative law enforcement has played a significant role in the establishment and development of the legal system of intellectual property,the disposal and containment of intellectual property infringement and illegal behavior,and the improvement of protection level of intellectual property rights.TRIPs does not exclude the application of the administrative law enforcement.Therefore,the administrative law enforcement can be reserved properly in intellectual property laws in our country,but it should be strictly restricted in the subsequent revision as well.In general,the administrative law enforcement should be gradually weakened,and the judicial protection of intellectual property should be given priority to the administrative protection.It is necessary to treat differently the different types of administrative law enforcement behaviors,i.e.,the administrative adjudication to pure civil disputes of intellectual property should be weakened and even abolished wholly,theadministrative mediation could be promoted,and the administrative disposal should be timely adjusted both in scope and strength.

Abstract:In accordance with political democracy and standard of right,penal penalty administered by local authorities must be avoided when net citizen＇s expression of criticism over public issues is confronted with penal charge.The criminal-law-inclined local policy represented by administrative,personal,and profit influence will directly affect the realization of the supervisory right of network public opinions represented by the right to know,participate,express and supervise.Out of consideration for the protection of citizens＇ political expression,the recognition and verification of the consequences caused by penal offense must be standardized,and the legal responsibilities of the accuser must be strengthened.And the legal proceedings must be improved,the penal penalty system optimized,the legal provisions specified,in order to prevent the abuse of administrative power on the criminal law system and avoid any forms of power-make-guilt.
