Abstract:Conflicts and tensions among major powers are often seen as clashes of interests between entities with significant influence. Nevertheless, from a historiographical standpoint, one would challenge the validity of such a simplistic view. The themes of nations that have to be considered full are undeniably formed by comprehensive historical and cultural components. Hence, it is essential to comprehensively evaluate cultural disparities to have a comprehensive understanding of interstate conflicts. This research uses case studies and qualitative methodologies to conduct a comparative analysis of the ideologies and national value identities that underlie Chinese-American interactions during the last decade. It focuses on the cultural distinctions inherited from China and the United States in order to get a deeper understanding of these connections. This research posits that the concept of democracy is firmly ingrained in the cultural and political fabric of these societies, giving rise to divergent ideologies. Numerous pieces of evidence indicate that the cultural aspects of a country significantly influence its political evolution.

Analytical and Comparative Jurisprudence

Abstract:A comparative analysis of the constitutions of Japan in 1889 and 1946, their common features and differences. It is concluded that both Basic Laws meant the second, after ancient Chinese law, and the third reception of foreign law. The common features and differences inherent in the constitutions, due to the combination of the influence of foreign law with Japanese traditions, and the importance of constitutions in ensuring rapid and effective political and socio-economic development of the country at two historical stages. Common features include small volumes of texts, the proclamation of Japan as a constitutional monarchy by both basic laws, the consolidation of the principle of separation of powers, the duty of subordinates and citizens to pay taxes, the emperor's right to dissolve the lower house of parliament, constitution by foreign legal ideas, foreign law with Japanese traditions, promoting rapid and effective political and socio-economic development and improving the legal culture of the population. The differences are the enshrinement of the 1946 Constitution, the principle of people's sovereignty, the radical limitation of the emperor's powers, the proclamation of parliament as the supreme body of state power, the abolition of the hereditary chamber of parliament as part of parliament, its replacement by an elected chamber of advisers parliament, the elimination of estates, the consolidation of political and socio-economic rights of citizens, the declaration of their inviolability and the principle of pacifism. Constitutions differ in the responsibility of deputies for expressing opinions outside parliament, the presence or absence of a section in the text on the government, the Secret Imperial Council, the content of the independence of the judiciary, its structure, the status of the emperor, the powers of government. Also among the differences are the formation of constitutions under the influence of different legal families: Anglo-American law on the Basic Law of 1946 and Romano-Germanic law on the content of the Constitution of 1889. The content of the constitutional monarchy is different: the first basic law provides broad executive and legislative powers of the emperor, and the second ‒ a parliamentary monarchy, with purely ceremonial prerogatives of the emperor.

Abstract:With the changes on the state institutions of ROK and Japan after cold war,structural changes have occurred on ROK-Japan relation.Promoted by these changes,crises have gradually emerging on the framework of old values connecting the two countries, the core policies and guidelines of joint foreign strategies established and shared by the two countries,and the major policies of the two countries,which demands a new pattern for mutual relation,which will be adapted to the structural changes.In the future,the ROK-Japan relation will have to experience a transitional period interwoven by conflict and cooperation,before a stabilized pattern of new mutual relation is established out of all these structural changes.

Abstract:Chinese-Japanese relations have become increasingly tense in recent years. It might be concluded superficially that the recent tensions originated from the historical issues and the bilateral sovereignty disputes over some islands. However, these tensions are deeply rooted in the structural contradictions of these bilateral relations, such as the conflicting national strategies of China and Japan, the relative balance of power between them, and the discrepancy of their interests in their games against the background of macro transition of the overall strategic pattern of the Asia-Pacific region. Furthermore, the U.S. strategic dilemma in this gaming process adds destabilizing factors to the development of China-Japan bilateral relations. The outcomes of the China-Japan tensions not only affect the rise and fall of the relative strengths of these two countries, but also have major influences over the general strategic arrangements of East Asia and the whole Asia-Pacific. Therefore, it is very meaningful to probe the deep-rooted causes of the Chinese-Japanese conflicts and to observe current China-Japan relations from the strategic perspective because some solutions might be discoverd in this way.

Abstract:In the multilateral trading system,the dispute settlement mechanism of US-Japan trade conflicts underwent a gradual transition in the postwar period,namely from a bilateral rule-oriented approach to a result-oriented approach in the early days of Clinton administration and finally to a rule-oriented approach attaching dual importance to bilateralism and multilateralism. Multilateral rules and international laws have been constantly internalized in Japan's traditional non-litigious society. Ever since the establishment of the WTO,the aggressive legalism has increasingly been one of Japan's characteristics in dealing with its trade conflicts with the United States. This phenomenon reflects Japan's endeavors to be a normal state and its pursuit of an equal and more independent relationship with the U.S. This could also be regarded as an epitome of the changing US-Japan relations as a whole.

Abstract:This article extends power transition theory to distinguish political power from capacity and to examine a situation in which a global hierarchical system and multiple regional hierarchical systems can co-exist.Based on this extended power transition theoretical framework,this article analyzes the changes in capacity and political power structures in East Asia,the impacts of these changes to Sino-Japanese relations and stability in East Asia,and the strategies that the United States employs toward Japan to cope with the rise of China.This article argues that the power transition between China and Japan-as a result of the rise of China-has been conducive to stability in East Asia,and that Japan's change from a satisfied great power in East Asia's regional hieratical system to an unsatisfied one since the end of the Cold War has brought uncertainties to regional stability.It also argues that while pushing forward its strategic and reciprocal relations with Japan,China should not concede to Japan's quest for a permanent seat on UN Security Council,as well as to the territorial disputes between the two countries.While China should assume a leadership role in East Asia,it should also refrain from becoming a challenger in US perception.

Abstract:The article is aimed to establish a broader, multinational framework of analysis of the evolution of international relations in the East Asia through a systematic perspective. According to the author, since the turn of the centuries , the US has sought to establish a new order in the East Asia which was considered sharply different from the old order of power politics sponsored by the European countries. American concept of a new world order originated from the age of the American Revolution and was widely accepted and successfully adopted at the Washington Conference. A new international order known as Washington System emerged as the result of the Conference and constituted the setting of the East Asian relations. From early 1920s to the end of the Second World War, the different attitude and policy of the powers towards Washington System formed the main theme of East Asian international relations. The US tried to preserve and defend it and China wanted to integrate into it and identify itself with the Washington System, but Japan came to realize that the System violated its interest and attempted to challenge and destroy it. Contrary to the traditional dunking, the author's argument is that Washington System was not incompatible with China's national interest and was used in certain conditions as an instrument to gain foreign assistance and defend China against Japanese aggression.

Abstract:From 1955,the economy of Japan reached a period of rapid development.With the vast development of industrialization and urbanization,a large number of people went to cities,but most of them became themarginalizedin a city and they were the weak group.At that time,Soka Gakkai,the religious group on behalf of the low-income class in a city,took humanistic care behavior and human revolution claims,which complied with the demand of psychology and values from the weak group and attracted the group to be their members.Meanwhile,Soka Gakkai participated in politics actively to better maintain the corporate interests.New Komeito,as its political representative,could adjust nimbly their own political strategy,which laid a foundation for improving its influence and coalitions.

Abstract:Since the late 1980s,the scope of U.S.-Japanese trade conflicts has expanded from individual products or industries to the extent where political and economic regimes involve.The intensifying U.S.trade gaiatsu towards Japan in negotiations compelled Japan to increasingly open its market,accelerate the domestic deregulation and implement structural adjustments.In order to alleviate its trade conflicts with the U.S.,Japan responded both reactively and actively.This paradox has roots in Japan's rigid system of decision-making.Some interest groups within Japan,however,did take advantage of the gaistsu to effectively promote their desired domestic reforms.

Abstract:To understand why some former adversaries have achieved deeper reconciliation than others, this article conducts an empirical study on five cases of reconciliation and peace building in the post-World War II era: the Franco–German relations, the Polish–German relations, the Polish–Soviet (Russian) relations, the South Korean–Japanese relations, and the Sino–Japanese relations. We distinguish between reconciliation and peace building and propose a series of factors including postwar political arrangements, regime change for perpetrator, alliance, regime type, and regional institutions to explain the variations among the cases in the degree of reconciliation and the degree of peace. It is argued that these factors have impacts on the degree of reconciliation, and that together with the latter, they also affect the degree of peace. It is also argued that there have been structural and historical reasons for the underdevelopment of reconciliation in Northeast Asia.

Abstract:The 1974 joint development agreement between Korea and Japan established an innovative cooperation regime in the East China Sea. According to the agreement, Korea is obligated to conduct jointly with Japan in the defined zone, but Japan holds a negative stance on the potential reservation, leading to a deadlock on commercial activities. The reasons for the stalemate are, on the one hand, due to a lack of motivation because no commercial products pay back, and on the other because the mechanism of the agreement does not envisage a straightforward solution to the predicament. Compared with the 1970s, the incompatible legal positions on the maritime boundaries and vexed political geographical relations between the coastal States make the Joint Development Zone more controversial. This study identifies alternative approaches based on thorough analyses of political and legal factors such as joint development regime, evolving rules of international law, bilateral cooperation, and regional relations.

Abstract:The theory of Japan′s heterogeneity and U.S. revisionism towards Japan arising from later 1980s are the important reflection of U.S.-Japan trade conflicts which extended to the structural issues. These theories resulted from the changes in international political regimes around the end of Cold War and the changes in the climate of U.S. domestic politics, and they also had sophisticated academic and mass-median background. U.S. revisionism towards Japan exerted great influence on U.S. press, academic circles and policy-makers by formulating its viewpoints in the following three aspects: the differences among alternative capitalist development models, the uniqueness of Japanese politico-economical system and its related policy measures, and U.S. trade policy towards Japan.

Abstract:Constituent power and the Basic Norm are the two sides of the boundary tablet that marks the intellectual province of constitutional law.Without reference to constituent power,constitution will have to base its validity exclusively on the Basic Norm which is but a pure fiction of formalism.By introducing the concept of constituent power into constitutional studies,one may easily identify the Common Program as the legitimate Founding Constitution of PRC and specify the founding time of PRC.The dichotomy of"constituent power"and"constituted power"provides us a powerful conceptual tool with which we can form a clear picture of Chinese political structure,locate the constitutional moments of China,and explicate the paradoxical nature of the"reformative constitution."We can also look ahead into the future of a constitutional government,with a qualified guardian of the Constitution chosen by the people.

Abstract:<span>The conflict between Mainland China and Hong Kong regarding the issue of how much autonomy Hong Kong would retain is becoming increasingly intense, especially after the Occupy Central Movement arose in 2014. This paper focuses on the "rule of law" policy under Xi's government and analyzes how and why the CCP's rule over Hong Kong was strengthened. Although Xi promotes the "rule of law," it is different from the one in democracy. This paper, first, outlining the characteristics of the "rule of law" during Xi Jinping's era and explaining the differences between the rule of law in democracy and the one in China. Second analysis is revealing the personal affairs and organizational structure of the party apparatus to see the linkage of the "rule of law" policy under Xi's government with the CCP's control over Hong Kong, and third is examining the reflection and rhetoric of the CCP's "rule of law" governance over Hong Kong based on the politicians' discourses. This paper reveals that the "rule of law" with Chinese characteristics implies standardizing the law, centralizing the power, and stabilizing society. The CCP has continually claimed to be "Governing Hong Kong according to Law" but the CCP would only accept the "rule of law" with these characteristics and, of course, without democratization.</span>

Abstract:Compensation claims brought by Chinese war victims in Japanese courts have va- rious legal bases,most of them are torts and contractual issues.Arguments and judgments,how- ever,have evolved in those litigations from pure Japanese civil law matters to the issue of inter- preting the 1972 Sino-Japanese Joint Declaration.The Chinese government protested such judgments,obviously because they had already fallen out of"matters which are essentially within the domestic jurisdiction",hence the intervention legitimized.

Abstract:This chapter examines two closely connected issues in defining the contents of contracts in Japan: first, the approaches adopted in interpreting the meaning of agreed contractual terms and, secondly, the extent to which additional terms are implied to supplement the express terms. It discusses the underlying philosophy of interpretation with regard to the dichotomy of ‘objective’ and ‘subjective’ approaches; it details the various interpretative aids, such as customs, usages, the commercial background, the negotiations of the parties and good faith; and it shows how Japanese law resolves the tension between literalist and contextualist approaches to interpretation. A number of hypothetical scenarios illustrate how Japanese courts deal with issues of contractual interpretation and gap-filling in practice.
