Abstract:This is a summary of the experience, reflection and acquisition of my research on Chinese customary law. I think we need to reflect on the attitudes, issues, perspectives, approaches, materials and theories used in our researches. We should not only pursue the quantity of our academic works. We need to improve our judgement and focus on one subject profoundly and persistently.
The Review of Recent Research into Urban Community Sports in China

Abstract:The present study reviews recent research into urban community sports in China. Whilst affirming the validity of the research the study indicates that there are some pitfalls that need to be avoided in such research, for example: the basic conceptual framework is superficial; the research design is inappropriate; and the research instruments employed are inadequate in terms of innovation and depth. The study suggests that Chinese culture, society and sport practices should be taken account of when overseas frames of reference are employed.

Abstract:The paper deals with the problems that customary law may face up in the criminal procedure. Two problems are especially concerned, that is the burden of evidence and the supervision of criminal law. For the former question, the paper holds that we must distinguish the various roles played by customary law in the structure of crimes, and accordingly give the answer. For the latter question, the paper mainly discusses the necessity, content and the standard of the supervision.

Abstract:Today's rule of law construction in China is walking between the conflict and coordination of factors such as reality and ideals, tradition and modernity, local and foreign, and local knowledge and universal principles, all while continuing to strengthen the unification of the legal system and advance the modernization of the rule of law. Traditional customary law, which is the most representative local resource culture, is unquestionably one of the most important themes in the formation of the rule of law. It has far-reaching significance for the development of ethnic jurisprudence, the reunderstanding of traditional culture, and the construction of ethnic unity and harmonious society. Based on this background, this paper uses big data technology to collect relevant experimental data and proposes a traditional customary law value assessment based on BPNN. The completed work is as follows: (1) this paper clarifies the concept of customary law and the difference between it and related concepts and introduces the domestic relevant research on traditional customary law and the interactive relationship between customary law and national law in dynamic legal practice and puts forward the status and influence of customary law in contemporary legal practice. (2) The related technologies of neural network are introduced, and a traditional customary value evaluation system that can be used for experiments is constructed. (3) Experiment with the designed data set to see if the BP model is feasible. The experimental results suggest that the model proposed in this study has a low error rate and performs well while evaluating traditional common law values.

Abstract:This period of 'focus' is, from the views of basic law and special laws, dedicated to these purposes, i.e. to discussing effects of traditional law on the construction of rule of law, to seeking what are the underlying rules of development of law, to expounding what are the appropriate attitudes to traditional law in academic research. The traditional law definitely is the basic discipline of legal research, nevertheless, updating and rebuilding is the foundation of the development of rule of law-the present as well as the future. Not only does treating traditional law with attitude of reason means the respect of the history, but also the cherishment of the present and the future.

Abstract:The primary disadvantage of local judicatory in traditional China is judicature pertaining to administration and unsophisticated judicatory.This is a popular point in academia from Late Qing Dynasty.Considering many judicial archives have been found,it is the time to reconsider that point.In fact it is common sense not professional knowledge that was necessary in local judicatory in traditional China.The common sense includes legal common sense,ethical common sense and local knowledge.So local judicatory in traditional China depended on individual officials.Appraising local judicatory in traditional China is inaccurate in view of judiciary independency and professional judicatory.This angle of view avoids facing the resistance to the establishment of a modern judiciary system in China today.

Abstract:"Ma Xi-wu-styled trial"(an informal,mediation-like trial conducted by Judge Ma Xi-wu) was a specific historical product and no wonder was affirmed at that time.Now its re-advocacy indeed has peculiar reasons which will be detailed in this paper.However,this author maintains that as a trail mode,limited by its own features and notions,Ma Xi-wu-styled trial has already lost general and practical meanings and is away from the development of Chinese society.While reflection of the trial mode now will conduce to reestablishing and strengthening multi-styled alternative dispute resolution,China's civil litigation reconstruction in the primary stage of rule of law should focus on litigation and stress the legitimacy of trial procedures so as to accelerate the transformation of Chinese society.

Abstract:In China,there are invisible rules restraining the behaviors of local governments,which are folk conventions.Although the folk conventions are possibly inconsistent with the contemporary law,they contribute to property right demarcation and social stability,and establish a commonly perceivable baseline of governments' behaviors,therefore restrain the local governments' power in a limited way.To some extent,folk conventions in China are de facto constitutions which sustain economic growth.

Abstract:In Late Qing Dynasty, the Chinese Law Family was disintegrated and the Western Law was introduced into China. Finally, China adopted the European continental Roman law tradition. This paper analyzes the reason for China’s borrowing of such legal system and probes its development and reform in the later years. It also tries to answer the question of what will be the possible impact upon the current Chinese legal system since China now implements the policy of “one country two systems” in order to realize its reunification with Hong Kong, Macau and Taiwan. In addition, it will make some prediction upon the future development of Chinese legal system.
Reformation, Inheritance and the Evolvement of Law: A Cultural Analysis of Confucianization of the Ancient Chinese Laws

Abstract:In the 1940s, Qu Tongzu put forth the proposition of "Confucianization of the ancient Chinese law", producing a great effect on the academia home and aboard. Due to the discovery of new historic materials born on bamboo slips in the Qin and Han dynasties, different views have been proposed since the 1970s. China’s legal system features two basic characteristics—moralism and mixed law—for the entire Chinese history. The Confucian legal thoughts prior to the Qin Dynasty represent the theoretical summary of legal experience and practice in ancient China. Legalism in the Warring States Period and Qin Dynasty dismisses the patriarchal clan system and advocates "rule by law" on the basis of the centralized state power. Meanwhile, legalists partially incorporated li (rites or rules of proper behavior) into law. After the Western Han Dynasty, ancient Chinese laws began the process to be turned into part of Confucianization in a comprehensive way. The Confucianization of law represents the integration of Confucianization and Legalism in terms of academic thoughts, the integration of Confucianization and luxue (the study of law in ancient China) in terms of judicial professional training, the gradual socialization of the mixedlaw in the mode of law, and the transformation of patriarchal clan system into statute law in the criminal legislation.

Abstract:Abstract The present paper reviews some conclusions deriving from a series of works by a historian of medieval Western law and justice who has applied comparative analysis to the Chinese world. It points to the distance between the two civilizations, in terms of the concept of a “debt of justice” owed by the state, the autonomy of the judicial power, and judicial ethics. It opens a debate on the cultural elements that define the judicial truth-making process in various legal systems.

Abstract:American jurists have a comparatively long history of studying traditional Chinese legal culture.This paper focuses on the China-titled articles published by American Jurists in various law journals since the beginning of the 21st century.It is found that the study of traditional Chinese legal culture in America has revealed certain new characteristics in the new era.Methodologically,though American jurists still apply Western legal theories to analyze the Chinese legal culture,the dominance of Western-centered cultural value in legal studies has undergone gradual lessening.A typical example is that American jurists tend to hold that rule of law is mainly an idea of the West and yet some elements of rule of law can be found in traditional Chinese legal culture.Therefore,Sino-Western legal cultural exchanges are by no means unidirectional;nevertheless,bilateral exchanges and communication between the two are of even greater importance and urgency.

Abstract:The Yao Nationality, as a minority group dwelling in South China, has a long history and rich culture. In its long history this nationality has developed a comprehensive, effective and far-reaching customary law on criminal punishment. This customary law includes crimes, punishments and execution, all of which have unique Yao characteristics.

Abstract:The article does an expansive research on the theory of Hume's "fact-judgment" and "value-judgment " by utilizing the theories of Marx Webber's "ideal type" and Wittgenstein's "family resemblance", helping to draw a conclusion to the transformation of Hume's theory from absolute rationality of the essentialism to relative rationality of non-essentialism reason. Based on non-essential "fact-judgment" and "value-judgment", and illustrating the "Rite-punishment" in the Confucianism theory before the Qin Dynasty, the author puts forward two ideal types of research on the Chinese traditional legal ideology-rehabilitation and explanation, advance and creation. On the basis of the two ideal types, we can overcome the blindness and confusion of research on the traditional Chinese legal thoughts and can establish minimum rules in explanation and dialogue so as to deepen the research on the study, and promote the creativity of thought.

Abstract:In formulating autonomous regulations and separate regulations,the local People's Congress of ethnic autonomous areas respects and accepts customs according to characteristics of the local ethnic groups.Contents of the customs are more diverse,including marriage customs,property customs and so on.In legislative process,the local government is committed to guide and transform backward customs in minority areas.Therefore,this process has a strong sense of social transformation.Obviously,with development of society,there have been changes in the manners and contents.

Abstract:Purpose Academic contention occurs when research evidence is amenable to more than one interpretation. China has a long tradition of Shang Que (商榷), in which authors argue for their preferred interpretation. The modern form of this tradition is the Shang Que article, which often takes the form of research papers in Chinese-language journals and which tends to be question-oriented. Shang Que articles usually take the views of a particular author or article as the focus of independent and complete criticism by another, independent, academic. This paper explains the role of Shang Que articles in Chinese scholarship and their influence on international academia. Design/methodology/approach A bibliometric analysis was used to explore the characteristics and evolution of Chinese Shang Que articles using 30,577 articles published between 1979 and 2018. Microsoft Excel and Gephi were used for data analysis and visualization. Findings Findings suggest a decline in the number of Shang Que articles and an increase in the number of co-authors. Shang Que articles remained particularly prominent in Philosophy and Humanities and Social Sciences, where they focused on local issues such as classical Chinese, the Sinicization of Marxism and Chinese literature. This suggests that the number of Shang Que articles is related to the degree of internationalization of a research field. Originality/value Shang Que articles, which have been influenced by academic paradigms in English, are a fusion of China's Shang Que tradition and of the modern academic system. Through considering Shang Que articles, this paper explores the benefits of local academic traditions in non-English-speaking cultures.

Abstract:The role of urban china research has been the subject of popular topic in recent urban studies overseas. This paper examines the academic research on urban China. It begins with a discussion of the background and overview of main research fields about urban China research. It is argued that although current overseas studies on urban China have improved Chinese relative research theories and methods, they have their own drawbacks. This paper proposes the further considerations: the context of China studies and right to have a voice in the international research field, the cooperation between civil and abroad scholars and the practicality of the abroad research, which aim to sustain the urban China studies.
