Human-Right Guarantee in Chinese Criminal Justice

Abstract:The strengthening of guaranteeing human rights in criminal justice could not only realize practically the human-right protection principle set up in criminal legislation,but also promote effectively the continuous perfection of the necessary measures.So,in order to fulfill the principle,judicial officers should first of all form such ideology,follow the norm of harmonious and fair legislation,and keep a balance between severe punishment and human-right protection.That is,they should benefit from the reasonable points in the two extremes.So in practical criminal justice activities,there should be strict judicial interpretations,particularly in the application of death penalty,the final decision power of which should be recovered for the Supreme People's Court.A judge should use legally and rationally his judicial discretion and the circumstances for the discretionary action of sentence appropriately.He should follow the principle of humanitarianism in punishment,undertakes the community-based treatment actively but steadily,and execute death sentence with civility.
